Illegal detention: Court postpones Zakzaky’s N2bn suit to June 14

A Federal High Court in Abuja has fixed June 14 for hearing in of a suit filed by detained leader of the Islamic Movement in Nigeria (IMN), Sheikh Ibraheem Zakzaky.

Justice Gabriel Kolawole adjourned the suit after Zakzaky's counsel Femi Falana (SAN) acceded for more time to the respondents, who were absent in court.

Zakzaky was arrested following a confrontation between his group and soldiers which resulted in several deaths and destruction of properties on December 12 and 14, 2015.

Zakzaky is demanding an order of court directing his immediate release from custody.

He also wants the court to award the sum of N2 billion against the Nigerian Army, the Chief of Army Staff, the Department of State Services (DSS),the Inspector General of Police, and the Attorney General of the Federation(AGF).

In a fundamental rights application, Falana submits that Zakzaky's arrest and continued detention from 14th day of December, 2015 till date without being charged before a properly constituted court of law is illegal and unconstitutional.

He further submits that the prolonged detention violates his fundamental human rights to fair hearing as enshrined in section 36 (5) of the constitution of the Federal Republic of Nigeria, 1999.

He argues further that: “the arrest of the leader of the movement without access to his medical doctor is unconstitutional as it violates his fundamental rights to personal liberty and health as enshrined in Section 35 of the constitution of Federal Republic of Nigeria, (as amended) and Articles 6 and 22 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act (CAP A10) Laws of the federation of Nigeria, 2004.”

there was a leak that zakyzaky is long dead. zakyzaky is not in any detention but Berried in undisclosed location. burutuai acted on strict order by some oga at the top.

the matter is been suppressed not to heighten the polity with such news.
