Port Harcourt court should be obeyed because:-
1..The convention was held in PH and not Lagos.
2..Lagos is not a PDP state and at that stand,they will be biased in judgement.
3..Lagos should not interfer in matters not concerning them because they are just a state like any other and not the fct.

PMB is now the cause of PDP's predicament! He imposed Sheriff on PDP and also used Wike and co to oppose Sheriff again.

For me as a layman, I think lagos Court order is more complete on the issue at hand. It clearly declare the caretaker committee illegal.
While that of PortHarcourt only gave a restraining order pending determination of the motion in Notice. The determination of the motion in Notice can go either way.

Lawyers in the house, in a case of two court of equal jurisdictions giving conflicting judgement on same issue, does the fact that one court Judgement came first matter? does chronology of the judgement relevant in deciding which one is more binding?
The FHC has put itself in a quagmire.... The CJ should consolidate the suit.

There is no problem. Politicians always has way of doing their things.At the end of the exercise PDP will come OUT stronger, even though i do not support the way THEY elect officers.There is no internal democracy.

You are wrong sir.The Federal High Court is seen as One Court with different Divisions across the Country for administrative convenience. Sec 19 of the Federal High Court has said it all.

There are also a Plethora of cases to this effect. In FRN vs MKO ABIOLA. Abiola was arrested in Lagos and tried by the Federal High Court in Abuja. His Lawyer's objected to this on the ground that he was arrested in Lagos and should have been tried in Lagos and not out of jurisdiction. The Court held that Out of Jurisdiction means : Out of Nigeria hence Abiola could have been tried in any other division (any state).
The state were an event occurs isn't an issue for the Federal High Court to have Jurisdiction.


I must commend your view as a Layman. The statement you made has brought a lot of arguments in Legal circles.

The Port Harcourt judgement cannot hold ground since it was referring to the action in port Harcourt as a convention in which there was an earlier order restraining the PDP from having any convention. Did the judge in PH not aware of that order? Anyway what's my own. May the former yam eaters remained divided.

Both court are of concurrent jurisdiction meaning that their decision do not bind on each other or else its of a higher court which is the court of appeal or the supreme court.....(Judicial precedent)
Futhermore, if the judgment should be appealed it will be to the higher court and not to any high court whether state or federal because they are of concurrent jurisdiction.Whereby the two court has given the judgment, it doesn't matter which is the best but the decision of the first court.......This is my humble submission thanks...
