Speaking at a forum organised by Policy and Legal Advocacy Centre, a public policy think-tank, in Abuja on Thursday, August 11, Dogara said those calling for his prosecution were doing so out of ignorance.

According to Dogara, the laws governing the National Assembly accorded all lawmakers a great degree of immunity from prosecution on the basis of exercising their legislative functions.

Initially it seems Jibrin was having support of APC leadership to effect change of leadership positions in the house.

But with recent events what's the guarantee buboo is not giving him tacit support cos after their meeting at Aso rock Dogara said he won't resign.

Don't be surprised if Jibrin is thrown under the bus soon.

I am so happy the way things are turning out now in this govt. I know this will happen but never knew it will be this early.
When we cried that the fight for corruption is one-sided, selected to attack only PDP members, gullible Nigerian youths who tribalism, nepotism and ignorance have covered their eyes vomited all sorts of things in d name of clamouring support for this govt.
The same Mr integrity said he will deal with those that padded the budget, now we have seen those that padded the budget, what happens?
Dogara can't be probed by EFCC because he has immunity but a sitting governor can be harassed, his account friezed by EFCC and also be probed while he still has immunity and some gullible youths here support such.
I am sorry for the youths of this s country not old people that are nearer to their graves.

N' Assembly Immunity. Where is Femi Falana, the AGF and others prosecuting Saraki on the Senate Standing Rules? Saraki own no even near half of what Dogara committed and the Professional Criminals dragged him to court. Then, them no recognize sey national assembly has immunity for all its members while exercising their legislative duties. APC and BUHARI deserves stoning in this country. The problem I have with Nigeria is that people sensationalise trivialties in the name of settling political scores which are personal, then throw up a temporal lexicon (eg budget padding), and Nigerians begin to debate on an issue that they do not even comprehend.

The media and Police do not even help matters because they do not even know their jobs.

What is budget padding? What crime or tort is committed therein? - These should be what the media and police should investigate and release informative statements upon. Alas, everyone is insinuating fraud and calling Dogara names.

Firstly, a budget is a forecast - it is a shame that in Nigeria, the 2016 budget which should ordinarily have been wrapped up in Q4 Fiscal 2015 is still unresolved in Q3 Fiscal 2016.

Secondly, a budget should ordinarily be an assumptive and discretionary representation of forecasted revenues and expenditure/expenses. The revenues are usually understated by benchmark rules (eg pegging crude oil price at $50/bl) and the expenditure overstated to allow for certain shocks (eg inflation and exchange rate differential).

Ergo, all budgets are padded if I should borrow the contemporary diversionary lexicon.

Jibrin should provide evidence of financial gain directly attributable to Dogara by exercise of that discretion if fair value principles were not adopted in arriving at those estimates. Then we can begin to talk of a financial crime. Then EFCC can invite Dogara. In the absence of this, I dont see any reason why Dogara should even pick a call from EFCC.

This whole new saga is just vague, like every other Nigerian matter. No head, no tail.

The way our politicians talk amazes me. Apparently, they've lost touch with reality and what they want is what they do everything possible within and outside their power to get and when they are caught in the act, they will device all sort of means to cover up their undemocratic acts.

No man or government can determine my life. Where the fear of God is not, people will certainly do all sorts to foster their selfish interest instead of interests of the nation regardless who suffers.

How can these government expect to govern the nation when they have ungoverned individuals in their midst? If this is not dealt with we will keep maintaining status-quo as long as possible regardless which party is in government!

If what Dogara and others did is not corruption then what Jibrin has done is not corruption too. Therefore Jibrin should retain his position as Chairman Committee appropriation. Shike nan.

The Speaker of the House, Yakubu Dogara, on Thursday said those calling for his prosecution for his alleged involvement in the fraudulent manipulation of the 2016 budget were doing so out of sheer ignorance.

Mr. Dogara said the laws governing the National Assembly accorded all lawmakers a great degree of immunity from prosecution on the basis of exercising their legislative functions.

“It doesn’t even make sense and they have forgotten about Section 30 of the Legislative Houses (Powers and Privileges) Act, and others” which says “most of the things we do in the National Assembly are privileged,” Mr. Dogara said.

“They cannot be grounds for any investigation on the procedure or proceedings to commence against a member of parliament, either the Speaker or the President of the Senate, once they are done in the exercise of their proper functions.”

“The Constitution talks about the estimates of revenue and expenditure to be prepared and laid before the National Assembly. The constitution did not mention the word budget. And the reason is very simple. Budget is a law.

”Going by very pedestrian understanding of law which even a part one law student can tell is that the functions of government is such that the legislature makes the law, executive implements and the judiciary interprets the law,” Mr. Dogara said.

“The budget being a law, therefore, means it is only the parliament that can make it because it is a law. And I challenge all of us members the media and civil society organisations to look at our law and tell me where it is written that the president can make a budget,” Mr. Dogara said.

Mr. Dogara’s comments came while accounting for his one-year in office at a forum organised by Policy and Legal Advocacy Centre, a public policy think-tank, in Abuja.

Mr. Dogara, who has faced growing calls for him to resign from office following allegations of budget fraud, said ignorance of legislative duties on the part of some citizens was to blame for the outrage against lawmakers’ role in the 2016 budget.

He said that the National Assembly would now embark on a massive sensitisation of the public about the duties of the legislature in a constitutional republic.

“Recent efforts seeking to discredit the document are a consequence of inadequate knowledge of the legal framework governing appropriation in a presidential democracy.

“This has, nonetheless, opened a new vista of duty for us as a legislature to enhance both internal competences of Members as well as the sensitisation of the public on the role of the legislature in a presidential democracy,” Mr. Dogara said.

Mr. Dogara said the 2016 Appropriation Bill was not entirely perfect in the form it was forwarded to the legislature by the executive, saying lawmakers carried out extensive work on the document to make it acceptable.

“The 2016 budget was controversial from the onset but the House handled the controversy with maturity, employing the democratic tools of dialogue, compromise and consensus by which an implementable 2016 Budget was passed and assented to.”

For three weeks running, Mr. Dogara had been locked in fierce political and media war with Abdulmumin Jibrin, a Kano lawmaker who was removed as chairman of House Committee on Appropriation.

Mr. Jibrin said the speaker masterminded the insertion of fictitious subjects into the budget, an allegation Mr. Dogara denied.

I absolutely gave up on this case when Dogara met PMB last week and he came out smiling evading journalists questions like Messi.

Maybe PMB does not want to risk fighting no3 & no4 men at the same time

Or there is an hidden agenda

Parliamentary immunity/privilege does not preclude the investigation or prosecution of MP's who adopt an unlawful procedure to do their legislative work.
