There are indications that President Muhammadu Buhari may take sides with the Comptroller-General of the Nigeria Customs Service, Col. Hameed Ali (retd.), in his ongoing face-off with the Senate over his failure to wear his uniform.

A source within the Presidency said that the position of the Presidency on the disagreement is that; no law compels Colonel Hameed Ali to wear a uniform.
This position was based on legal advice made available to the President by the Attorney General of the Federation and Minister of Justice, Abubakar Malami (SAN).

The source added that the government’s stand is that there is a clear separation of powers among the three arms of government.

He said the position of the Presidency was that lawmakers could not make laws and enforce the laws themselves.

“The AGF has advised that no law compels a political appointee to wear any uniform. And again, the legislature makes laws, but they don’t have the power to enforce those laws,” the source said.

When contacted on the face-off on Saturday, the Senior Special Assistant to the President on Media and Publicity, Garba Shehu, directed one of our correspondents to the Public Relations Officer of the NCS.
When asked if the CG would heed the Senate’s order on Wednesday, the Public Relations Officer of NCS, Mr. Joseph Attah, said Ali would do the appropriate thing.

“I am confident the CG will do the appropriate thing. Thank you,” he stated.

If only Saraki will not put his personal interest above that of the Senate, the Senate ought to bark and even bite the Executive in order to reset the latter's brain.

The Presidency needs to respect other arms and institutions of government. They've technically destroyed the judiciary and will not obey the decisions of the Courts while parading the Legislature as he most corrupt whereas the Executive is the carrier.

Since no law compels CG of wearing his uniform, shall we then say that wearing of uniform among custom officers is a matter of choice and not an obligation? undecided

If Ali wouldn't wear his statutory uniform, then other custom officers have no business wearing it!

Gbammmmmm!

Who the uniform help.

If Hammed Ali is qualified for the job let him focus on the it.

The position of the law is very clear on this issue. NASS has the responsibility to make law but not to enforce it.

If nothing else is involved. I don't know why this issue of uniform as become a priority. Of all that is affecting the Nation, The Senate just decided to see to personal interest than the Nation's interest.

Ali was never a carrier custom officer
He is a retired army officer
This created the lacuna

I think officers should wear their uniform and the CG should lead by example

I support your view on this issue. Let Saraki and his house calm down a bit and seek their pound of flesh some other ways in some other time.

The salient point in the matter is that they feel that baba has bastardised the Nigerian Customs by that appointment and the appointee has carried on like he is a "Deputy President" of the country.

The Nigerian Police Force is in dire need of reforms, from the Nigerian Army was in total disarray, did they consider retired Civil Servants with impeccable records to head those organizations?

The baba is the CG of Customs, his style won't help him achieve anything. When he enters the Senate chambers, they want to see a representative of Nigerian Customs QED.

The presidency should check the history of fights they have embarked upon with the Senate, which have they won? Saraki will go to the courts till the end of the tenure, they won't secure conviction. But they would be frustrated, their already stinking government would fail totally and in 2019 they would not be able to campaign. Most of the guys in senate would decomp leaving them with a dying party with no reasonable achievements.

That man should just wear the uniform he would want his subordinates to wear on daily basis...

There is a difference between custom officers and Mr Ali.

Custom officers are not political appointees so they must wear uniforms while Mr Ali is a political appointee hired by the executive aka the president only the president can sack him, the senate can not because of the constitution and separation of powers.

Mr Ali serves at the pleasure of the president and not the senate.

Do they still teach social studies in Nigerian schools at all?

He is a political appointee and the constitution doesn't say he must, he serves the presidency and not the senate.

The senate and the average Nigerian like you must respect the laws and the Nigerian constitution and separation of powers.

There is something in the Nigerian constitution that says separation of power.

The president appoints and the senate approves, but the senate can not discipline of fire the people the executive appoints because they serve under the executive and not the legislature.

Asking the senate to bite or frustrate the presidency based on their flawed understanding of the Nigerian constitution and your own lack of understanding too means you obviously know nothing about Nigeria and the Nigerian constitution and also the meaning and responsibilities of the 3 arms of government.

Supporters of wearing of the uniform and the Senate should just cite the part of the law that backs up their claim and all these back and forth will cease.

Is that too add to do?

There is no sentiment in the issue of law.

And to think that the Legislature doesn't have the powers to sanction an appointee of the Executive is the greatest ignorance.

They need to stop the unnecessary romance with the Executive in order for them to act aright.

Pls go and read any govt textbook. it will help you the more.
