An FCT High Court has restrained Senate President Bukola Saraki from declaring the seat of former Minority Leader of the Senate, Godswill Akpabio vacant.

Justice Othman Musa on Wednesday also ordered Saraki not to impede Senator Akpabio's access to the Senate building or taking any action aimed at "overreaching his privileges and rights as a Senator pending the determination of the originating Summons of the applicant."

Justice Musa ordered service of the court papers on Saraki through the Clerk of the National Assembly, Clerk of the Senate or any other Clerk or reasonable staff of the National Assembly at the assembly complex.

The orders were made after an ex parte application by Akpabio's lawyers, Chikaosolu Ojukwu and Ebere Ahanonu seeking to stop moves to declare his seat vacant following his defection from the opposition Peoples Democratic Party (PDP) to the ruling All Progressives Congress (APC).

The suit has been adjourned to August 29 for further hearing.

These guys are just inundating and overstretching our already deadbeat judicial system with their spurious suits and countersuits, lacking in any moral judicial bearing positively on the citizenries.

What was he/they even thinking or trying to achieve. He should have led by example by declaring his own seat vacant first.

Smart move, if apkabio , and other decampees can't loose their seat even when there wasn't any fractionalization in PDP, then saraki can't loose his when there was an obvious fractionalization in APC, leading to 23 states with parallel Congress. That is some offensive move, saraki is no more playing defensive. For people who lack understanding of this move; the sole aim is to loose the case and give the loss good publicity thereby setting a precedence that what is good for apkabio is also good for others saraki's lawyers would never contest the ex parte order

Akpabio on his own went to court to avoid his seat been declared vacant and people are now blaming Saraki for that? When he has never ever mentioned that he will do so Both persons defected and it will be stupid for Saraki to declare any seat vacant because he will also be affected.

You should be conversant with what the constitution say about defection from your party.
