You did not read the article. Guy you are defending made an allegation on facebook against a government official. Asked to prove his case, he had zero evidence.

Of course, he got into trouble for libel

The judge is insane for giving him 12 years.
Even rapist don't get half of that.

The jail term handed out is not in line with the existing legal norms in the first place, unless it has more to do with the other charges than with libel. The criminal code already prescribes either 1 or 2 years. where law is stated in concreto, there is no room for judicial maneuvering.

Social media commentator, Ibrahim Garba Wala, has been sentenced to 12 years imprisonment over offences bordering on criminal defamation and public incitement.

The NAHCON boss had alleged that Wala used his Facebook page to incite the public against him and defame him and that of the commission.

The court agreed with the prosecution that Wala criminally defamed Muhammed after he alleged that the NAHCON boss “made N3 billion for himself” from the 2017 Hajj operations.

The judge said Wala wrote on his Facebook page that he has documents to prove the allegation, but failed to provide the document to prove his claims in court.

What if someone had erroneously shot the accused for what they though was the true picture? What if the accused was fired, or suspended and his health was affected and he died. What will we say afterwards?

The courts dont do judgement based on assumption but on provable facts.. so you dont have a case

You are the one exposing yourself. My first comment was in response to a fellow who claimed that 12 years was suitable for libel. I replied to him that 12 years was extreme for libel. You then jumped into the matter and specifically claimed that no 12 years was not extreme for libel, and that "we" should all be aware of the seriousness of libel. I then showed you the law and proved that libel is a minor offence. Now you want to change tack? In the course of this thread all your comments specifically addressed libel and not any of the other charges.

Do you suffer from memory loss?

I'll be surprised if the Judge handed down a sentence outside that prescribed by law or allowed per the Judge's discretion. There are many parts, sections, and aspects to the Criminal Code - some rather convoluted; so please be circumspect in what you claim and propagate as being applicable to a trial Court and in this particular case.

I think i did highlight the possibility that the sentence may be connected with the other charges preferred against the man. Given the manner in which the report was written, however, readers have been somewhat directed to infer that the sentence was a consequence of the particular charge of criminal defamation, and the discussion on this thread has therefore centered around this issue.

Also, there is nothing so convoluted about the provisions of the Criminal Code that would make it incomprehensible, and certainly not in respect of the provisions concerning defamation. It's quite explicit.

Absolutely not, especially when you obviously fail to understand contextual issues. Pray tell, does it make sense for you to conclude a 12year in isolation without looking at the context or the facts of the judgement of the case? What then was the basis of your "12 years for libel is extreme"?

In the course of my submission, I did mention libel because it is the reference point. I will not be cherry picking other grounds for suit when libel covers everything........

Just like I said, trying to be clever by half.

And who told you my explanation was what the court bases judgement upon? My simple submission is premised on the principle that you don't go malign people as you can't imagine the extent of the damage you can cause.

Still, you should be circumspect in your postulations and conclusions because a Judge is not a robot and does not have to conform to what you think you know or he ought to have done.

As a last resort, I would say we members of the public do not have all the facts of the case as seen by the Judge. We should therefore not be too eager to judge the actions of a Judge on social media or interpret a law for the Judge, otherwise we will be courting anarchy.

Fortunately for all, we are blessed with at least two levels of appeals courts. 'Nuff said.
