Justice Ladiran Akintola of an Oyo State High Court 9 sitting in Ibadan, the state capital, on Tuesday struck out a fundamental human right suit challenging the refusal of the University of Ibadan (UI) International School, to allow female Muslim students wear Hijab on their school uniforms.

Recall that the suit filed against the school, University of Ibadan, Deputy Vice Chancellor (Academic), University of Ibadan, who also doubled as Chairman of the Board of Governors in the school and the School Principal, Mrs. Phebean Olowe, was filed by some parents of female Muslim students in the school on behalf of their children.

The parents; Taofeek Yekinni sued the respondents on behalf of Moridiyyah Ayoka Yekinni, Idris Badiru sued the respondents on behalf of Ikhlas Badiru, Sikiru Babatunde sued the respondents on behalf of Mahmudah Babarinde, Muideen Akerele sued the respondents on behalf of Faridah Akerele, Bello Dokpesi sued the respondents on behalf of Aakifah and Aakiyah Dokpesi while Rahman Akinoso sued the respondents on behalf of Iman Akinoso.

Others were Muhaiminudeen Akinlusi on behalf of Raheemah Akinlusi, Abdulwasiu Moshood on behalf of Faridah Moshood, Dr. Olatunde Olosunde on behalf of Hamdallah Olosunde, Abdulsakur Adebayo on behalf of Aliyah Adebayo and Abdulrahman Balogun, Ridwan Ademola and Bolaji Ajani on behalf of Muslim Parents of the school.

The plaintiffs in the suit number M/706/2018, argued that continues denial of the 1st to 11th applicants the right to use Hijab on their school uniform within the premises of the school is unconstitutional as constitutes violation of the applicants rights to freedom of thought, conscience and religion.

But, Akintola while delivering his ruling on Tuesday, maintained that the originating summon of the applicants contravened the provision of the constitution of Nigeria.

Akintola said that the provision of the constitution does not allow filling of a joint action in a fundamental human right suit.

If Africans ignore religion, and marge all the african countries to become UNITED STATES OF AFRICA, it’s gonna be great. And God even without religion will bless Africa.

Why are these men wasting their time and money when they can easily withdraw their daughters from the school and send them to schools where their rights to freedom of thought, conscience and religion can be sustained and acknowledged through hijab!

The bitter truth about this hijab thing is, some of these girls don’t like the hijab thingy, but being imposed on them by their parents. Are those parents now respecting their daughters’ right to freedom of thought, conscience and religion?

The school sey e no want hijab, na by force?

Instead of them to monitor the performances of their kids in school, hijab is the priority. One thing that is certain, if your kids use hijab does not guarantee a good child.

Yoruba moslems would set yoruba land on fire one day.

Hijab this, hijab that yet 70% of their ladies don't wear hijab except during Jumaat.
Not only that. Most of those Hijab ladies are more promiscuous than those without Hijab. They do unimaginable things in the secret.

Don't send your ward to a school that does not support your religious beliefs. Shouldn't it be that simple?

I absolutely do not see anything wrong, for a female student to put on Ijab,as long as it's moderate.

Very good. Say no to developing terrorist in SW nigeria

Most of hijab users are criminals using religion as cover up.

They say it help cover up yet hijab did not stop their prostitution and marrying under age.

Brood of vampires creating problem all over the world

Ahahaha.... Eventuary!

Mumuric and their terrorist crew won't like this. Always looking to disrupt a peaceful place. If you can't follow the rule, take your ward to a Muslim only school.

Let's take a look at Nigeria's amalgamation as a case of study?

Are we happy cohabiting with each other? Always wants to claim Majority* Our Resources also brings up conflict.....

What a GREAT WAR if Africa becomes 1 Country territory now.

The university is a soft target though.

Let them take the military to court for not allowing female soldiers putting hijab on full military regalia.

What you said is complete rubbish. Nobody should be constricted to certain schools because of discrimination. We are all Nigerians and should be able to access education anywhere without discrimination. This should not be allowed in sane societies. Covering their head is religious prescription and must be allowed. If a Catholic nun wants to school anywhere, she will not be restricted because of her hijab.
On the case, the judge has used technicalities to strike out the suit. The merit of the case has not been examined. They will win in appeal court. Similar judgements have been won at appeal courts.
