So we now know who bought the judgment...

A black market judgement obtained in a kangaroo court that can not stand the test of time. Ex governor Umahi should vacate the government house and submit himself to EFCC for immediate prosecution due to wanton looting of Ebonyi's scarce resources.
His Excellency Igariwey should address the state now as the people's governor of the state
Jungle justice vs kangaroo court justices....I dey laugh oooo
Lawyers are ever liers

Did the Constitution say that a governor who wins the people's mandate can sell the mandate to another political party?

The constitution only mentioned lawmakers.it doesn't concern governors so stop wasting your time with bitterness

Confusion everywhere. Only in APC Government would you see conflicting court rulings. So which of the rulings is authentic now?
If you are PDP ..Pick the one that favours PDP or otherwise for APC

I am not from Ebonyi state and I believe you are not either, if not you should been aware of the achievements of David Umahi and shouldn't be mentioning his name and looting in same sentence..

Why then do candidates contest election on the platform of political parties?
People like you as Nigerians are reason why Nigeria does not move forward. How could people trust the ideology of a political party, cast votes to elect someone to lead them with the ideology of their choice political party; the person wins and defects to another political party?

...You are morally right but constitutionally wrong.
Until our Constitution captures the executives, they will keep decamping and nothing will happen.

Only a higher court judgment can supersed the judgment of the Federal High Court in Abuja

Yes, and that will be the Supreme Court.

My own question is: is it legal for a court to entertain a case when similar case is already being handled in another court of competent jurisdiction? I will be shocked if there is no law prohibiting such practice in Nigeria as it would create loophole for judiciary manipulation in the country.

garfield1:

Oga,that argument is nonsense.once a court gives a judgment no matter how funny it looks it stands and subsits

Johnnyspute has answered you.the relationship between parties and candidates end after polls.moreover, immunity prevents governors from being sued

You didn't read through , a federal high court in Abakaliki which is same level with the federal high court in Abuja gave conflicting ruling . The Ebonyi high court is hereby correcting the anomaly. They're in order.
You should have a little honour and desist from misinforming people here.

The court in Abakiliki is a state high court and not a federal one.

There is no how a federal high Court judge would have entertained or ruled on the matter if a parĂ llel court or a court of cognate jurisdiction has ruled on it.

What they are doing at Abakiliki now is nothing short of judicial rascality which NJC should come hard on...

The more Umahi acts, the more reckless and desperate he is looking.

He has only himself to blame for these self-inflicted woes...

Nop, you don't get it yourself. A federal high court in Abakaliki on 28th Feb had ruled in favour of Umahi before the federal high court in Abuja. Now the Ebonyi high court has come to say,hey u guys should obey the federal high court judgement entertained first on 28 February

This case get as e be.
PDP started their court case in August 2021 and while the case was ongoing, Umahi got his Abakaliki judgment on 28th of Feb 2022.
Umahi went to court on the 4th Feb and by 28th he got the judgement he wanted.
Why didn't Umahi wait for the verdict of the high court in Abuja?
Finishing submission!

PDP are doing their homework.

Umahi et al entered into defence in the suit filed at the Federal High Court immediately he defected. They have been making appearances.

Because they know they would lose the case, they arranged to procure a kangaroo judgement at Abakiliki.

It is looking ridiculous for Umahi...

Re: Ebonyi: Court Asks Parties To Enforce February 28 Judgment, Umahi Stays by seunayantokun(m): 2:51pm On Mar 11, 2022
The appeal court, and maybe the SC, will sort it out. As it is today, the mandate to rule belongs to the party according to the constitution. Unless a party ceases to exist or breaks up, as in no longer coordinated as one in view of the law, you cannot flee or sneak with its mandate to another party because you represent it and the electorate who believed in and gave it their mandate.

I'm on the side of the law and fairness, not PDP who are equally as corrupt as APC. In fact, what is the difference between them? Thieves moving from one former stealing platform to the current stealing one.

The judgement by the Federal High Court had legal reference from other rulings with the same foundation while that of PDP had absolutely no legal reference and was just manufactured out of thin air.

We can clearly see who bought judgement there

... Read section 37 of the Nigerian constitution. And so you know, blame our political parties for not having a proper constitution that will not allow this decamping but lol do you know why they don't want to enshrine it in? Because they are all greedy and will decamp to the party holding the central government anytime they want just to be protected.

The Eboyin State High Court judgement came b4 that of the FCT High Court, both are High Court's, the order of the Eboyin state High court has not been vacated by an order of a court of higher jurisdiction b4 the FCT High court order came in, do you now want them to obey the order of the FCT High Court and disobey that of the Eboyin state High Court or what? Only the order of an higher court ie an Appellate court can resolve this quagmire caused by these Judges, cause the governor will adhere to the order that will benefit him though he has gotten a stay of execution of the FCT judgement and also gone on appeal.

I'm not sure there's a stay yet. He only filed for a stay
