Courts Do have the power to declare a law illegal. It is one of the ways to amend a law.


As for this law the national assembly cannot amend or delete anything from the act without causing problem for the 2023 election because the condition says any law relating to our election must be in place a year to the election date and another law says the elections must hold some specific period before the actual swearing in date of May 29



If they amend as the president demands and he signs, it becomes a new law affecting those two dates thereby making the entire election illegal



If Buhari signed the law when it was first presented and sent his objection to section 84 they would have had the time to delete it and return for his assent, right now it is no longer possible except by the court which can declare that section illegal without the need for the president to sign anything

Where did you get that from?

The Courts have the rights to void any section of any bill, decree or Act inconsistent with the Constitution.

The Federal High Court voided Section 140(2) of the Electoral Act (2010) and it has remained so till date.

The Primaries will be held most likely later May or June 2/3. It will most likely come from a Governor.

The idea is good but they were in a haste and made some notable errors.

Malami does not understand that the legislature has the power to make law today declaring that anybody within the territory of Nigeria that was born a man should henceforth be identified as a woman and it stands. In other words, national assembly's power to make laws cannot be questioned. Political appointees are more or less government workers, there is no violation of the constitution if national assembly makes law that says they must resign from government work three months before any party election in which they hope to vote or be voted for. Are government workers allowed to be partisan before? No!

The Electoral Act 2022 does not prevent you from participating in any election. If you are interested, resign from your appointed position. How is that a deprivation of your fundamental right? Resign and contest or stay as an appointee (if you want to), and look from your window.
