Confusion. Party primaries is not same thing with elections.

I don't see what the debate is here.

The judge while delivering judgment in a suit marked: FHC/UM/CS/26/2022 held that Sections 66(1)(f), 107(1)(f), 137(1)(f) and 182(1)(f) of the 1999 Constitution already stipulated that appointees of government seeking to contest elections were only to resign at least 30 days to the date of the election and that any other law that mandated such appointees to resign or leave the office at any time before that was unconstitutional, invalid, illegal null and void to the extent of its inconsistency to the clear provisions of the Constitution.

This is where the issue lies. Contradictory laws should not/cannot exist. 1 must be scrapped.

Malami position is very valid.

Such a shame that a very debased and unprincipled individual like Malami is the Attorney-General of Nigeria. He’s such a shameless opportunist who has the manners and intelligence of a charge and bail lawyer. Very useless man that has caused more problems for Bihari than the president realises.

The appeal court and the Supreme Court should be considering the competence of malami as the minister of justice and attorney General in line with the gross abuse of office... I guess he's too crude, petty and suburban to occupy such a revered position that ought to be reserved for the educated elite of morals.

This is the kind of task that causes Junior lawyers to sleep in the office until the job is done. This kind of pre-election and post election matters are sweet. But the stress is killing.

You will have money but won’t be able to spend it because there is no time to even enjoy yourself.

It is well.

In any event, I do not think the Court of Appeal will be able to deliver judgment before 31st May 2022.

There must be time for the Respondents to file their briefs before argument of briefs, and then judgment.

Can all these happen before 31st May?

Only time will tell.

1999 constitution said 30 days to Election.
2022 electoral amendment was ... ?
Which of them is valid ?
The should clarify this law .

I’m keen on knowing the outcome of this law and the other Party defection law .

The court of appeal has granted an accelerated hearing of the appeal by giving parties 3 days each to file their briefs and the appeal is to be heard on 4th may 2022. Without any iota of doubt, the judgment of the federal high court wil be set aside

Gbaja is just giving his principal false hope with this his renegade concoctions. What the constitution already makes provisions for, he keeps inventing the wheel. Same thing he did with the direct/indirect/consensus fiasco. They had an agreement with Buhari to amend that provision which they have refused to. When the ever vindictive Buhari starts his own now, noise will not gree us rest especially from the CSOs who are on the payroll of one man like that.

The issue should be the interpretation of the constitution by the Supreme Court whether a political appointee is a public servant?

The rulings said: A political appointee is a Public Servant not employed in the Service of the Federation or State.

However, I think the NA should have stated the Offices involved like: Ministers, Commissioners, et al. Why I said so is this:
Is the HoS a political appointee or a Civil Servant?
Is the Accountant-General of the Federation a political appointee or a Civil Servant?

This is a good judgement I believe.

The section 82(12) was actually suggested by the Buhari regime. It is however obvious that something changed and some powers are affected, hence, the sudden turn around and strong attempts to withdraw the section.

I stand with the new judgement for this exposition.

The Law didn’t say Malami cannot Contest for Political Office, the Law said he should first resign his Position before doing so

Let us Just Thank God Almighty that. Malami was fast asleep when the Senate passed the Law

I am certain about that and it will be 1-1

But then it won’t end there. Will it?

And the court will deliver judgment within how many days?

Then Supreme Court?

The dust won’t settle before 31st.

Based on the appeal court ruling in oni vs fayemi and the definition of public service in the constitution, section 84 12 should stand

Some politicians and the judiciary are in bed in this case. We all know what this section 84 sub 12 is trying to cure. How can political appointees be in same category with civil servants? The courts need to take another look at it for the sake of clarity. The structure of the civil service is totally different from that of an appointee of government. The difference is clear for all to see.
