This has always been the right judgement like I have said many times. The reason Jegede's wasn't upheld was because Buni wasn't a Party to the suit.

However, I think it will be upturned.

There was no technicality employed.justice agim dealt with it meritoriously... In yari vs marafa anor,once a candidate satisfies 177 and doesnt contravene 182,he is qualified.....sponsorship of a candidate is taken during the primaries and not by nation officers...

Paragraph 15: Part 1 of the Third Schedule made under section 153 (1) of the 1999 Constitution empowers INEC to issue guidelines, manual for the Elections. That INEC obtains name(s) from Parties through the National Chairmen is a law made by INEC subject to 153.

Section 183 of the 1999 CFRN prohibits dual Executive Offices.

So, why they base their decisions on the Electoral Act and the Party Constitution is a bit ironic. The Constitution is Supreme.

They are playing safe. Years from now a panel of 7 will vacate same.


That asides, Oyetola's case at the Tribunal will now be stalled as he must firstly vacate this judgement.

(We are talking about like 2 months).
