look at the Osun election, strongholds can be compromised to reduce votes in an opposition stronghold because they will cancel all polling units affected, it doesn't make sense...

There's no special interpretation of that law.

The law says that there should be a rerun.

The two judges in the 3-man jury that ruled that case yesterday need to made to go on compulsory retirement.


Says someone who has never judged a case before and not a judge. Who told you that there's no special interpretation. That's the problem we are facing, we just think we know everything even than the specialist.
I have read that law over and again, and if you are a lawyer, you would know that it can be interpreted in different ways, just because you are interpreting it to suit your view doesn't mean others can't interpret it the other ways too.

After finding out the method used for the judgement on the election tribunal that gave victory to Oyetola over Adeleke, I would say it is a recipe for disaster, the method applied was cancelling all the votes of a polling unit because of over voting in that particular polling unit.

1. As it happened that there were over voting in various polling units in the Osun election, what if each opposition connives to perpetrate over voting in polling units in each opposition strong holds?

3. If there is an election tribunal like this and a rerun takes place, what if the same over voting keeps occurring over and over, would they keep repeating the election tribunal process and back to rerun again?

In my opinion, the law is just an error or a purposeful scheme to rig an election using what I call reverse voting
Just simply tamper with your opposition strong holds and invalidate their votes, So we might be having a case where a carefully selected and protected minority will determine winners of an election instead of the majority carrying the votes.


Implications:

1. It will make elections become very dirty because politicians will be all about scheming to invalidate votes in opposition strong holds.

2. It will make the voters lose confidence in the electoral process, because a voter will not be sure if his vote will be invalidated or not by someone else scheming with a politician in his/her polling unit.

3. It will make voters wear out easily and may cause voter apathy when you have reruns after stressful elections, thereby reducing voters turn-up in reruns.

4. It may not reflect the true will of the people and also reduce the total number of voter participation, just like the Osun election tribunal, the total number of votes cast for both PDP and APC after the cancellation doesn't reflect the true will of the people to declare Oyetola the winner.

5. Elections will cost more because of Tribunal, reruns and time wasting.

6. It could lead to anarchy and total chaos, like in some volatile states in the north where they riot over political results, just imagine after election and INEC says they have cancelled over 20,000 polling units across the north which were all stronghold of a particular candidate, because of over voting of less than 2000 voters, imagine what will happen in the aftermath of such news.

Solution:

In situations of over voting, Why not just deduct the invalid votes(over votes) and count the rest, the BVAS already identifies the number of over votes(invalid votes), doing so, INEC will avoid a lot of election tribunals, scheming by politicians, reduce cost of doing reruns, make more accurate results, increase voters confidence, reduce time wasting, reflect the true will of the people and avoid anarchy.



Your solution is very childish. I dont even think you understand what a competitive election means and how transparent things should be.

Over voting could have been a result of preloaded BVAS entries, double voting permitted by INEC personnel or even clever real time hacking into the system but to you it was just a problem that ordinary subtraction. Simpleton sighted.

This is why we say Nairaland is the social media space filled with the most unintelligent comments ever.

If you appeal the case 200 times, you will get exactly the same outcome 200 times. The only way out for Adeleke is if his counsel can find a technical fault in the judgement just like Oyetola’s counsel did four years ago. If it is on the strength of the evidence o, Adeleke will lose. The certified true copy of the BVAS report is a strong evidence that can’t be jettisoned. That’s why even INEC quickly said they won’t appeal the judgement.

Really the black market judgement in yesterday tribunal court will never stand in appeal and Supreme Court of justice. The last option is to declare rerun in all the polling units where the alleged over voting took place. As it stands today Senator Ademola Nurudeen Jackson Adeleke remain the governor of Osun State
with this appeal, please does it mean he will be on seat until after the appeals judgement?

So, if BVAS accredited 100 voters in a unit and 150 people eventually voted in the following manner:
APC- 50
PDP - 80
LP- 10
SDP - 5
Void - 5
Total - 150

So tell us, how exactly will INEC separate the votes of the 100 people that were accredited from the 50 people that were not accredited by BVAS but still voted?

Osun Judgement: Governor Adeleke Addresses Osun People, Says Claim of Over-Voting Unfounded

••••Writes INEC over Appeal against Judgement

The Executive Governor of Osun State, Governor Ademola Adeleke has addressed the people of Osun state, restating his rejection of the Tribunal judgement and affirming his appeal to higher court.

In an address to the people of the state, Governor Adeleke observed the discrepancies in the judgement of the Tribunal Chairman, describing the outcome as "miscarriage of justice.

"My good people of Osun state, we have all heard the split judgement of the governorship election tribunal. Two members of the Tribunal delivered two opposing judgements, the Chairman and the member one. The member 2, did not deliver any judgment, she abstained.

"The Chairman's judgment affirmed the claim of over-voting, while the Member One's judgment agreed with our position as captured by the BVAS machines which is the primary source of accreditation data of true accreditation on the day of the Election.
"The reality of my election as the Governor of Osun State is captured in the member one's judgement. The claim of over-voting in the Chairman's judgment was unfounded.This was clearly a miscarriage of Justice. Based on the above, there was no majority judgment.

"My good people of Osun state, I am still your Governor. I have the right of appeal on the Chairman's judgement and I have instructed my Lawyers accordingly.

"You gave me your Mandate, our election remains valid and by the Grace of God we will triumph at last. I call on you all to remain calm and go about your normal activities, peacefully. Please Remain Law abiding.
"We have strong faith in God and in our judiciary", the State Governor concluded in his second state address.

Meanwhile, the counsels to the state governor have filed appeal against the Tribunal judgement.

The counsels have also written the electoral commission intimating it of the appeal and seeking non-implementation of the judgement until the determination of the Appeal.

Each party has got a party agent in each polling unit. It’s not possible for over voting to take place with the opposition in the know. What happened is that the PDP actually manipulated the INEC official to transmit the false result without the other opposition being aware.

That is what I am saying, simply remove the invalid votes and count the rest because how are we sure if it was PDP or APC that actually did it, we are not sure, APC can also d that to just invalidates PDP votes with entire cancellation of the polling unit, that is why the law is flawed..

I may be wrong. Someone should help.
Can't we do acreditation, collect ballot paper immediately once you are cleared and go straight and tump print to cast your votes. Once the time to stop voting ends, the papers are counted and results that are signed are automatically transmitted.With this method,I strongly believe there won't be rigging or over voting.
