Let's Kill Corrupt Nigerians - Chief Justice Of Nigeria

Chief Justice of Nigeria (CJN) designate Dahiru Musdapher yesterday canvassed implementation of a death sentence for corrupt officials even as he accused state governors of frustrating the independence of judiciary in the country.

Musdapher who spoke when he appeared before the Senate insisted that for corruption to be minimized in the country a capital punishment must be meted out to offenders. He was confirmed by the lawmakers for the office.

He said the judiciary was ready to commence the enforcement of capital punishment for corrupt persons. The CJN argued that capital punishment for anybody who is involved in corruption would help in the fight against corruption in the land.

Musadapher who appeared before the Senate for screening also called for the review of the law governing Nigeria Judicial Council(NJC) stressing that the law was obsolete. He complained of high number of appeal cases pending at the supreme court. He asked the senate to accelerate the review of the Act to limit the number of cases at the Supreme Court.

The CJN maintained that there is need for the review of the Nigeria Judicial Council law for greater performance, as he vowed to reposition the judiciary for better performance in the country.

Asked whether the Judiciary is Independent, Musadapher said" By and large, the judiciary is independent in this country, probably here and there you may find some odd things going on, but by and large we try to do the best that we can.

"But the problems has to do with the problems with state governments in relation to section 121 (3) of the Constitution dealing with the statutory that are given to the state, is often not transmitted to the heart of the courts in the states.

"Sometimes there are problems in the state of getting their due share of what has been granted them by the state governments. We are talking with government to please comply with the Constitutional provision and give the judiciary their dues .

"I want to have better judiciary within the time available to me, I want to call stakeholders meeting. We will do the best thing we can do so that we can restore public confidence and people can be happy that we have a good judiciary that is alive to its responsibility."

Speaking on corruption in the country, Musdapher said any step taken towards reducing the state of corruption would be considered. He however referred the issue to the legislators, noting that capital punishment for serious crimes operate in most countries of the world. He also blamed some of the delays in accessing court judgment on the numerous petitions that judges have to work on.

on the number of cases at the supreme court, the Chief Justice of the Nigeria said:"The truth of the matter is that there should be limitations to the number of appeals coming to the Supreme Court. The cases are there, we sit every day, hear about 20 to 30 cases and then, judge 20 to 30 cases, the amount of work done is too much, that is why it is urgent that constitution is amended to reduce the number of petitions coming to the Supreme Court."

On the power to appoint the Chief Justice, he said the Constitution confers power on the President to do so. "He can pick and chose anybody that the constitution qualifies but NJC procedures have to be followed before the appointment can come true. Some time, the president can appoint but sometime, he can bring it to the senate for confirmation." On the underperformance of Judges, although, the Chief

On the appointment of Judges, he said: "Rules for appointment of Judges have been with us since the establishment of NJC and I think it is due for amendment. We are calling on the stakeholders to come with us and consider the amendment of that law so that appointment would be well defined."

I will support the CJN on this. Kill the Looters because they are killers themselves.

They are killing our people everyday with poverty, bad roads, dangerous hospitals, hunger, police harassment, extra-judicial killings and sentences.

Let us support this idea and push it, LOOTERS of public funds must die.

They are not too worried about him. He retires next year. Any law that will chip away some of the powers controlled by these loooooters is welcomed.

In a three-branch government such as Nigeria has, the executive proposes, the legislature disposes of the executive's proposals and the judiciary adjudicates the constitutionality of the dispositions of the legislature, and only if the constitutionality of said dispositions are challenged in court. It is never the place of the judiciary to suggest laws or the sentencing that violation of any law should carry. That is the exclusive purview of the legislature.

There are only two ways to do things: the right way and or the wrong way.

The Chief Justice designate is out of line in this case. And what greater morons could the legislators who confirmed him be? The Chief Justice designate is already signaling a disposition to crafting extrajudicial sentencing by suggesting capital punishment for officials who are found guilty of corruption. Sentencing requirements are not his domain; sentencing guidelines are.

I think The Chief Justice is only expressing his opinion.

The Chief Justice should ensure that corrupt leaders brought before the courts are dealt with according to the books. That will go a long way in curbing corruption.

I have spoken of this subject b4. The new chief justice is only retirating what I have preached once upon atime see excerpts below.

Face Fireing squad if you steal more than 5 Million Naira.

First and foremost there should be a general amnesty to all politicians and their cronies, the black-board SHOULD be wipe clean, everyone should be giving a second chance to start afresh and clean up their acts.

If we have hope of seeing the promise land this steps must be taking with immediate effect. I promise Nigeria would be a developed nation in less than 15 years if we can pass this resolution into law.

Firing Squad – If you Embezzle, steal, misappropriate N5 Million and above.

20 years imprisonment – If u steal between N3 and N4.99 Million- banned from politics for life

10 years imprisonment – If u steal between N2 and N3.99 Million- banned from politics for Life

5 years imprisonment – If u steal between N1 and N1.99 Million plus 2 years political ban

2.5 years imprisonment – If u steal between N100,000 and N999,999.00 Million plus 5 years political ban

Suspended from all political appointments for 3 years for any amount between N1000.00 and N99,999.00

Salaries of House of Reps and Senators: - N5million for Senators and N4million for Reps men this amount should include all expenses.(Although a luxurious Apartment called “ Assembly Apartments” shall be provided for all members at the expense of the state)

A full audit of all merchandise and stock in all Apartments would be taken before a member assumes tenancy and after term ends or failure to return occurs in the electoral process, this would reduce cases of abject blatant theft and outright brigandage to the barest minimum.

Governors shall be paid N4 Million a year including perks, Mr President would be on N7 million a year and VP on N6 million a year.

Britain has already made 25% cuts in its expenses I don’t see a reason why a developing nation like ours should be paying our House men more than the President of America, yet we cannot even produce a needle. This issue should be address now, let some common sense prevail at least for once in our life.

For the law to take root the forecast would be as follows :-

5 Politicians to be shot by firing squad within 3 years of the law becoming operational, this would taper down to zero by year 5 and 6.

20 Politicians to fall within the 20 year imprisonment category within the 1st 3 years.

40 Politicians to fall within the 10 year imprisonment category within the 1st 3 years

80 Politicians to fall within the 5 year imprisonment category within the 1st 3 years

150 Politicians to fall within the 2.5 year imprisonment category within the 1st 3 years

300 Politicians to fall within the N1000 – N99,999.00 category within the 1st 3 years

By year 10 we should have a complete zero corruption especially corruption running into millions and billions of Naira.

El-dorado that fictional utopian would be a reality rather than a pipe dream. In our time we have shot, hanged some good men, Maman Vatsa, Dele Giwa, Ken-Saro Wiwa, why not sacrifice some of these gluttonic thieves for a better Nigeria.

The issue discuss here must be entrenched into our law, how, I don’t know how, but it is something millions of Nigerians would want as part and parcel of our Identity.

The Chinese shot bent and crooked business men for corruption, today they are without a shadow of doubt the most liquid nation on Earth, with untouched funds going to about $300 billion.

China can pay of the UK’s debt in a year, this is the kind of nation we should be trailing and not the old Western Democracies.

i so much agree with this notion. corruption will always be in Nigeria until drastic measures are made to stop it
Re: Corrupt Nigerians Should Be Killed - Chief Justice by nateevs(m): 9:41am On Sep 23, 2011
Yes corrupt politicians should get stiff sentences in the case, the Chief Justice is way out of order. In a country where people don't know what their place is and what they should say in public, you will end up with more chaos. I am ashamed to be associated with a country where a member of judiciary makes such suggestions in public.

The sentences given for corruption haven't been great, but that's not the major issue.

The major issues are the investigation, prosecution and conviction of corrupt officials. Of what use is the death penalty when we know that corruption goes on daily in government offices, yet there have only been a handful of well know convictions.

Anyway, Nigeria is in a catch 22 situation. Is it the corrupt legislators that will vote for the death penalty for corrupt officials? Who in their right minds would sign their own death warrant?

The only way to fight corruption is to fix both our judiciary and our police force then we can be assured that we are on our way to fight corruption.

I support your motion Chief Justice Musdapher. In fact, Nigeria should be ruled by a benevolent Dictator.
Re: Corrupt Nigerians Should Be Killed - Chief Justice by Nobody: 11:07am On Sep 23, 2011
In reaching for low hanging fruit, here, our Chief Justice has really not added any meaningful value to the debate on how best to tackle corruption.
I know @knowall has provided a Key Performance Indicator (KPI) template of his own; showing how one should appraise the success of capital punishment, but even this misses the point.

We need look no further than our Sharia states in the North, where not a single member of the establishment has been prosecuted to date, to see how merely introducing more punitive measures does not necessarily translate into good governance nor enjoin greater civic responsibility.

The truth is, what is being advocated here is nothing short of a knee-jerk solution; one that fails to acknowledge causal factors of corruption like our flawed implementation of the Federal Character project.

Amnesty Report, 2008
More than 720 men and 11 women are under sentence of death in Nigeria’s prisons. They have one thing in common, beyond not knowing when they will be put to death. They are poor. From their first contact with the police, through the trial process, to seeking pardon, those with the fewest resources are at a serious disadvantage. Amnesty International and the Nigerian NGO Legal Defence and Assistance Project (LEDAP) are calling on the Nigerian authorities to declare a moratorium on executions, in line with the recommendations of its own experts.
Re: Corrupt Nigerians Should Be Killed - Chief Justice by SwiftSMS(f): 11:08am On Sep 23, 2011
His recommendations and clamour for the death sentence should begin in the judiciary
It is appalling what they (judges, justices) do in the name of money. angry angry
They actually have more power than legislators & executives to right the wrongs/ills in our society but when a matter gets to their court the parade changes.

Cases are adjourned incessantly and deliberately too, delaying the entire process while they take money from the highest bidder to do all of this and eventually rule or give judgement in favour of the briber.

Re: Corrupt Nigerians Should Be Killed - Chief Justice by Biscute(f): 11:48am On Sep 23, 2011
Yes , corrigendum but lets start from the Judges to lawyers first because they will see what is white and call it black,.
According to Lord Bacon , '" it is like that judges will fly from anything that is in the likeness of corruption [ thought it were at a great distance ] as from a serpent "' Corruption is evil
its a dangerous crime
and it is the greatest sin.
So corrupt Nigerians should be killed , after the we start from Justice Dahiru Masdapher., customs, politicians before the civil servants. then we shall see a new Nigeria,
