Tinubu Certificate Scandal: Constitutional Implications By Aisha Mohammed Agashi by Racoon(m): 7:40pm On Oct 07, 2023
Atiku Abubakar, challenging the declaration of the APC candidate as winner of the election on many grounds, part of which is that he submitted a forged document on oath to INEC to secure clearance for participation in the recent presidential election. Following this claim, Atiku Abubakar had applied to the US District court to an injunction requiring the Chicago State University to release Tinubu’s Academic records for authentication.

In the course of the disposition, the Certificate used by President Bola Ahmed Tinubu to secure final clearance for participation in the 2023 presidential election on the platform of the All Progressive Congress, APC which he claimed he obtained from Chicago State University (CSU) was debunked.

In this latest development, Caleb Westberg a Registrar in Chicago State University on Tuesday 3rd of October 2023 said that the replacement copy of the diploma certificate Tinubu submitted to the independent National Electoral Commission, INEC, which he used to secure clearance for participation in the presidential election, was not issued by their Institution (CSU).

He however, states that a  replacement was indeed ordered, through CSU, and there is indeed an actual certificate in the student file named Bola A Tinubu, but, it is however still in the file because it was never picked up. Westberg speaking under oath further states that he is seeing the diploma certificate copy for the very first time.

Part of the difference noted by Westberg in the certificate submitted by Tinubu, dated 1979 to the electoral body, had in it the board of Trustees. However, Westberg asserted that the institution had no board of trustees in 1979. He also admitted variations in signatures, logo and seal.

Section 137 (1) (j) which provides for disqualification from election to the office of president provides that a person shall not be qualified for election to the office of president if- “he has presented a forged certificate to the independent National Electoral Commission”.

This section is clear in it’s position that nobody who have forged and presented a forged certificate to INEC should be President of the Federal Republic of Nigeria. The constitution in this provision is not pertaining on whether the candidate attained an institution or not, as a matter of fact section 131 (d) which provides for qualification for presidential election, provides that the candidate should have a least school certificate.

In view of this, where a candidate who did not attend a higher institution can still contest for the office of the President as long as such candidate have at least a Secondary School certificate.

Where a candidate however, presents a forged certificate regardless of the type of certificate the candidates have, once it is deemed to be forged such candidate have contravene the position of the law and as such they stand disqualified if found culpable.

This can further be seen in the case of APM v. INEC & ORS (2021)LCN/15161(CA) and  NWOSU UCHE & ANOR v. INDEPENDENT NATIONAL ELECTORAL COMMISSION & ORS (2019)LCN/13765(CA).

In conclusion, if the supreme under special circumstances admits this Academical records and the court further finds the candidate guilty of forgery, the constitutional implications is that such candidate  will be disqualified.

The Registrar of CSU authentication of Tinubu’s studentship is not same concerning the oluwole factory manufactured diploma he submitted to INEC in 2022 that is the crux of the matter here.

Tinubu attended CSU but he forged the diploma certificate you guy are hyperventilating on thereby commiting criminal forgery and perjury offense that are punishable according to the Nigerian law.

Forgery undermines the integrity of educational qualifications, and it's imperative to maintain the sanctity of academic records. Tinubu nah ogbologbo for oluwoleism. Fear the man.He can forge a human being if possible.

Let’s see how the Supreme Court of technicalities and corruption will spurn another narrative with this messy scandal. Karma is a bitch. It does not forgives or forgets.

Attending a school and graduating is one thing.

Forging the school's signature, seal, and other details is another.

The school clearly stated that they allowed third party replacement.
These are case study of two different countries which mean Certificate is ordinary ceremonial paper in US and CSU claimed that they don't issued any replacement so where do you want Asiwaju to get a replacement from ?

Asiwaju no be IPOBidients mate 🤣😂🤣😀😂

Ariwo mogbe and his Justices will take one look at Carl Westberg transcript and affidavit, and would immediately throw out thr rubbish case of Atiku.

Nice try in trying to use the backdoor to become the President of the Federal Republic of Nigeria.

She forged an undue score!

From 249 to like 260 (not sure)

Assuming she used exactly what she scored then there'll be no case against her!

Tinubu is incomparable!

One of the major problems we have in this country is that of our weak institutions....this should have been verified prior to the conduct of the polls by our security agencies.....

Also, we need no stick to the facts here and not mere emotions......

Tinubu did attend CSU.
Tinubu sworn under oath that his certificates including his A levels were destroyed in a fire incidence.
CSU do not issue certificates twice to students
A lost certificate can be replaced by a third party vendor

The next step is for Atiku to verify if the submitted certificate was actually issued to Tinubu by a third party vendor......

To me, Atiku should ditch the case of certificate forgery because following the these facts, he has no case.

But the major achilles heel in this Tinubu saga is how he got admitted to CSU in the first place

He used A levels to gain admission into CSU and these A levels has descripancies

Atiku should investigate these demographic discrepancies in the A levels .....

and if it shows that the A levels belong to another person, his admission into CSU can be nullified and his certificate rescinded......

Then, Tinubu would have failed to meet the minimum requirement of WASC for the position of Nigerian president which will invalidate his presidency.....

But i believe if Tinubu can be triumphant in this case.....Atiku is finished in Nigeria

Let's see if what Tinubu did was legal or illegal

We'll settle this matter right now using this simple test:

Go to the ATM machine and withdraw N10,000 from your bank account

It's your money right? Your hard earned money, nobody else can lay claim to it

Make sure to copy the serial numbers, then destroy the money or throw it in the sea, in essence, lose the money

Go home and use your printer to print N10,000 with the same serial numbers

Now go to the bank and deposit the money you printed

There's your answer grin
