Doctors Strike: Court Dismisses Lagos Objection Of Lawsuit by free2ryhme: 2:13pm On May 24, 2012





Justice Benedict Kanyip of the National industrial Court (NIC) has struck out the application by the Lagos state government, asking the court to dismiss the suit filed by 788 doctors that were sacked by the state government.

The doctors, in a suit filed by the Chairman and the General Secretary of Medical Guild, Dr. Olumuyiwa Odusote and Dr. Idris Durojaiye, for members of the guild, prayed the court to void the dismissal letters issued to them by the state government.

However, the Attorney-General and Commissioner for Justice of Lagos State, Mr. Ade Ipaye, in a preliminary objection said the court lacked the jurisdiction to entertain the matter.

He therefore asked the NIC to strike out the suit.

He also contended that the first and second plaintiffs filed the matter on behalf of the guild, which he described as an unregistered group.

But the judge affirmed that the court has the jurisdiction and that the suit is competent.

He however ruled that the court would determine whether the claimants case falls under the subject matter or whether the claimants have enforceable entitlement to the Consolidated Medical salary structure.

The judge held that the matter would proceed to trial and adjourned till June 19, 2012.

The sure bus deployed in lagos was not allowed to operate in lagos just because they have FG assited mass transit printed on them. For them to operate they were told to erase the the FG mass transit printed on them! What a shame

If Ʊ want evidence pass through their park at oniru follow their so called alternative route Ʊ can't miss their park stop and ask them why they are covering FG mass transit painted on the buses. If Ʊ stay in lagos and hear what they would tell Ʊ! They now ply on lagos road but the FGN mass transit written on the bus are been covered with paint the only way to knw they are the buses! Ʊ would Ơ̴̴͡.̮Ơ̴̴̴͡ TUC painted on the top back of the truck@al harem if u don't knw where they have their park I can direct Ʊ so Ʊ go find out urself if Ʊ stay in lagos and next Time Ʊ pass their park stop and ask them why they are covering the FGN mass transit program initally written on the truck !but the truth can never be supressed!

Before the coming of the tollgate, a trip from Oniru Bus Stop, near the first tollgate to Ajah cost N100 but it has since been jacked up to N150

Oops! Have I digressed too far? Well, let’s get back to the issue of uniform. In my state of the varied thoughts the silence in the bus was troubled by the conversation between a policeman and the driver at the Oniru bus stop along Ozumba Mbadiwe Road on Victoria Island. The driver was intercepted by a police man when passenger alighted at Oniru but unknown to the driver some policemen laid an ambush in the dark.

If Ʊ don't knw the place ask an okada man to show Ʊ where they parked the brand new buses for transportation Ʊ can't miss the place anybody that stays in ajah area that goes through the so called alternative route knows where am talking about some of the buses are parked on the road side unless Ʊ don't stay in that area but anybody that stays and use the alternative route coming from ajah knws where am talking about!

You are absolutely wrong, except of course there is cash and carry justice as the judiciary has been turned to looticiary.
Otherwise there is no such thing happening. For the records, they were not sacked for embarking on strike. They were sacked for not replying competent queries from their employers. Read the story very well. The whole brouhaha was caused by industrial action, but the government was wise enough to hinge the sack on a point that is tenable and legally sustainable.

There will be appeals from appeals from appeals till the state government finally stabilize the health sector and moved on from there. Go and ask Uniilorin 44, some did not even live to be reabsorbed. (Unilorin now enjoys the most stable, predictable academic calender in Nigeria). It's still a hot news that's why people are following it with passion. Next hearing June 16 or 19, then adjourn till August something, then November, meanwhile employment of new doctors continues unabated, guy, wake up, the sacked doctors are the losers and nothing, absolutely nothing, will affect Fasola et al.

Exactly. This is just the beginning and will advise doctors not to rejoice yet. Besides, I don't like this court route. Am also not happy with the state government stance. The state has an agreement with them, let them fulfill their part of the agreement.

The National Industrial Court will give its rulings, either party would head to the proper court and there will be appeals upon appeals, those doctors are gone, they better start applying afresh.

hercules07: The National Industrial Court will give its rulings, either party would head to the proper court and there will be appeals upon appeals, those doctors are gone, they better start applying afresh.
