whealthy: Falana said "vicariously liable"... It is a principle of law in which the master is held to be jointly or severally responsible for the acts of his servant in a master servant relationship, once the act that injures the victim falls within the duty delegated to the servant.. For instance, your sErvant drives and knocks down a person, the person can sue you or your driver or both of your for compensation.
In this case, Fashola delegated duty to demolish to the police, so MIGHT be vicariously liable, however this is to be determined by a court of competent jurisdiction.
Also, Fashola can argue that he is not vicariously liable as the relationship is not that of a master/servant which is usually mostly based on not only delegatin duty, but tellin them how to do it.
The court would be the final destination


Well, in as much as I do not support Fash on this one, I buy your arguement, particularly the bolded and underlined part because as a matter of fact, Fash does not control the police. the command of the police is not under him because we have a centralised police. So, there couldn't have been a master/servant relationship between them. It is an undisputable fact that Fashola is one of the very few performing governors in the country.
However, it must be said that fashola really got it wrong this time. If lagos state government felt
that these buildings were distorting the free flow of water and the lives of the residents could also
be endangered by continuing resident on this site, the proper and reasonable things to do would have
been to provide alternative site for these people to live.

I became visibly worried while recently watching the commissioner for environment in lagos saying that
government did not have any plan to resettle the affected residents of makoko. Why will a reasonable and
sensitive government ignore its responsibility to ensure provision of habitable shelter for its citizens?

As a governor and chief security officer in lagos state on whom his instruction to demolish the houses of
these settlers, without provision for alternative place, was carried out, Fashola should therefore be held
responsible for the death and injuries that might be recorded during this demolition.

Fashola is a dictator. He can't be operating a democratic government and may he never get his wish for a state police. In situations like these, people will be killed and nothing will be said nor done about it.
Anybody who gives a 72 hour clearance directive is liable for such actions. Why would the police go there with loaded guns in the first place? Was it a fight against thugs or criminals? It seems as if he has woken up from his slumber since he won the elections.

I may not agree that Fashola is as dismal as your post paints him, but i can say that he is not nearly the saint many folks try to paint him as.

Laws and governance in Lagos seems targeted to benefit the elites alone. That is why in lagos state the rubber-stamp House of Assembly will approve extremely draconian penalties for traffic offences all in the name of 'restoring sanity' on the roads...yet 'big men' in Lagos will routinely close down entire roads for funerals/weddings/birthday parties.

The projects he claims to be doing are all located in elitist areas. Nothing in Agege, Alimosho, Ikorodu areas etc where the bulk of the masses live. Only sinking boreholes and generators to water flowers/street lights. No single low cost housing estates that low income earners than rent/buy. No single new market has been built for poor women to earn a living from. Even Tinubu with all the misconceptions some people have about him, did all these things for the poor people in the grass roots. Even built more schools. How many schools has Fashola built?

When a governore wakes up in day to tell the whole world that he has sacked the whole 800 medical doctors in the state(many of whome had started practice before he became governor) and goes ahead to call them 'irresponsible' and vows not to recall them until a higher power (god-father) intervened, then we definitely have a dictator in our midst as governor!

Yet this is the person some people call 'best governor'! We must be in serious trouble as a nation.

We will continue to have bad governance with impunity in Nigeria because we have so many shallow thinking and ignorant people/followers who worship and praise mediocrity.

May God grant the soul of the poor man (this will never happen to a rich man in Ikoyi/VI e.g Civic Centre owner) rest in peace.

It is definitely a crime to be a poor man under Fashola's Lagos Govt!

They provided for both the poor and rich. And they are both better than Fashola! All what Lagos state can boast of today are either established/founded by Jakande or Tinubu. Fashola has not done anything nothing new!

Not rejoicing at anyone's death, may his soul rest in peace. And you're quite right, provisions should have been made for people before displacing them from places where they have taken root, foreign born or native born.In my view, Makoko is a place worth designating Heritage Status,its an amazing place that should have been cleaned up and developed not destroyed.

Ist and foremost those guys stating fashola must go or fashola should be taking to court should be checked in at the Yaba-left.
Fashola didnt do anything wrong its our people that are senseless and when they try to help them they take to negativity. I stay at makoko area aman there gave birth to 18 children thats a whole community.
Those places are not safe to live for anyone with its right senses. Their was a 3 storey building of 11 flats that is not justa ground floor it sinkked. they all live on the drainage and built their illegal structures on the canal.
This time last year we couldnt pass makoko cos it was flooded fashola repaired that road cleared the drains and they still rained curses and abuses on this guy.
When ever it rains you pity those peole but you look at them again and ask what are they doing there? what are they looking for.
A stupid man was blaming fashola for no food as at last month and shelther. that he built his wood house himself and fashola should come and help the community.
FALANA is just a waste to the legal family he should get a life and he should stop living a frustrated life since he didnt win the ekiti election twice and he has been going against good deeds.
FASHOLA NEVER DID ANYTHING BAD HE IS HELPING TO REDUCE FLOOD.
These people that are complaining self they are not safe when its raining imagine them been helped.

Billyonaire: If there was no court order to demolish the place, then Fashola should be held accountable for the death of Timothy Agbe and the demolition. Although that demolition was long overdue, there was supposed to be a court order and adequate compensation made to the inhabitants. What is fashola doing with the state allocations and the enormous IGR from Lagos State. Fashola is a lawyer by profession he is supposed to know better not to be unilateral in exercise of the office of governor.

did the constitution say he must use court order before he demolish.
the people came from somewhere, why should come to Lagos and mess things up

However, it must be said that fashola really got it wrong this time. If lagos state government felt
that these buildings were distorting the free flow of water and the lives of the residents could also
be endangered by continuing resident on this site, the proper and reasonable things to do would have
been to provide alternative site for these people to live.

I became visibly worried while recently watching the commissioner for environment in lagos saying that
government did not have any plan to resettle the affected residents of makoko. Why will a reasonable and
sensitive government ignore its responsibility to ensure provision of habitable shelter for its citizens?

As a governor and chief security officer in lagos state on whom his instruction to demolish the houses of
these settlers, without provision for alternative place, was carried out, Fashola should therefore be held
responsible for the death and injuries that might be recorded during this demolition.

if south africa, united kingdom and USA are deporting nigeria citizen for messing their country, why Lagos State government cant send them back to their village before they mess up with Lagos. Eko o ni baje.
