Baba you don loose...no way back inec, pdp and apc all agreed there was overvoting. The law is clear it's cancellation not rerun......you nor rig with sense na why

If cancellation is the Law , if over voting is established, then the opposition party to ensure that the strongholds of a candidate is cancelled can just deliberately go there to overvote.
It is injustice to blatantly cancel the votes of eligible voters in a unit simply because some rogues overvoted.
It is disenfranchising the electorates.
Such a law is unjust and evil.
A rerun in the affected places should have been the right thing to do.
So, in a polling unit, if 200 voters are good citizens, only 10 dubious voters from opposition party can just come, vote and invalidate the votes of the 200?
What kind of horrible law is that?

Your solution is very childish. I dont even think you understand what a competitive election means and how transparent things should be.

Over voting could have been a result of preloaded BVAS entries, double voting permitted by INEC personnel or even clever real time hacking into the system but to you it was just a problem that ordinary subtraction. Simpleton sighted.

This is why we say Nairaland is the social media space filled with the most unintelligent comments ever.

Oga you are just talking rubbish, go and read the tribunal result and follow up on the case file and see the reason they gave for the overvoting before coming back to argue.

Let me get you clearly, are you suggesting that INEC should do a forensic scan of all the ballot papers to identify the votes of those that were accredited and separate them from the votes of those that were not accredited?

Even if there was overvoting, that's not an excuse to punish the winner, after all, the runner-up also had overvoting on his favor.
Rerun of election in the polling boots where overvoting took place should be it.

The "New Electoral Law" stipulated that, anywhere that is Over Voting; be it Ward (s) or Polling Unit, such Election area will be cancelled totally and call for re-run Election.
Now, it is unlawful for the Tribunal to cancel 749 Polling Units where PDP won and then declared a winner. It’s impossible and won’t stand.
Adeleke will surely win on appeal and the Supreme Court too.
We need to bring sense back to the Legal system.
Hence, Re-run is the worst case here if you cancelled 749 Polling Units.

You can try the case in your Biafra court. But I can assure you that no court in the land will allow over voting that was confirmed even by INEC to stand except in Banana republic where Kanu the terrorist is their leader

BVAS does the accreditation, so any thumb print on the ballot papers that does not reflect on the BVAS should be removed....

Oops! BVAS is used simply for accreditation and not for voting. We don’t vote with BVAS. BVAS is just to accredit the voter. Thereafter, the voter is manually giving a ballot paper with the logo of all the parties. The voter then thumbprint and drop the ballot paper into the ballot box. At the end of the election, the ballot papers are sorted based on parties and counted. After counting, it was discovered that 150 ballot papers were dropped in the box instead of the 100 that were accredited by BVAS. So, how do you separate the votes of those that were not accredited to vote at this point?

If APC could snatch a win from a winner and gave it to a loser, an Apc member simply because they are the power that be, what they are trying to tell all and sundry is that, even at the presidental election, if another party wins and not APC they can still find a way to manipulate and change the results in their favour. Tinubu spat on the faces of the people of the SE, the nucleus of the Obidients, through his 'e mi locan' declaration, and his subsequent refusal of microzoning in the south for APC presidential candidate to emerge from the SE. There were Igbo presidential materials who formed APC with Tinubu then.
Any Igbo who does what Tinubu did will also be DESPISED by some people of the SW region.

Osun Judgement: Governor Adeleke Addresses Osun People, Says Claim of Over-Voting Unfounded

The Executive Governor of Osun State, Governor Ademola Adeleke has addressed the people of Osun state, restating his rejection of the Tribunal judgement and affirming his appeal to higher court.

In an address to the people of the state, Governor Adeleke observed the discrepancies in the judgement of the Tribunal Chairman, describing the outcome as "miscarriage of justice.

"My good people of Osun state, we have all heard the split judgement of the governorship election tribunal. Two members of the Tribunal delivered two opposing judgements, the Chairman and the member one. The member 2, did not deliver any judgment, she abstained.

"The Chairman's judgment affirmed the claim of over-voting, while the Member One's judgment agreed with our position as captured by the BVAS machines which is the primary source of accreditation data of true accreditation on the day of the Election.
"The reality of my election as the Governor of Osun State is captured in the member one's judgement. The claim of over-voting in the Chairman's judgment was unfounded.This was clearly a miscarriage of Justice. Based on the above, there was no majority judgment.

"My good people of Osun state, I am still your Governor. I have the right of appeal on the Chairman's judgement and I have instructed my Lawyers accordingly.

"You gave me your Mandate, our election remains valid and by the Grace of God we will triumph at last. I call on you all to remain calm and go about your normal activities, peacefully. Please Remain Law abiding.
"We have strong faith in God and in our judiciary", the State Governor concluded in his second state address.

Meanwhile, the counsels to the state governor have filed appeal against the Tribunal judgement.

The counsels have also written the electoral commission intimating it of the appeal and seeking non-implementation of the judgement until the determination of the Appeal.

just simply remove the ballot papers that were invalid, they must belong to a particular party, deduct it from their votes....

It’s very easy from your permutations and combination just take away the extra 50 votes that were not accredited by BVAS and count only the 100 as the legitimate vote and that was the exactly what the tribunal did…QED

Really the black market judgement in yesterday tribunal court will never stand in appeal and Supreme Court of justice. The last option is to declare rerun in all the polling units where the alleged over voting took place. As it stands today Senator Ademola Nurudeen Jackson Adeleke remain the governor of Osun State

There's no special interpretation of that law.

The law says that there should be a rerun.

The two judges on the 3-man jury that ruled that case yesterday need to be made to go on compulsory retirement.





Kindly Quote the section of the Law in reference & don't waste your energy on quoting the ones talking about irregularity on Election day..Quote the one that has to do with the Power of the Tribunals to adjudicate on post election matters.

It is impossible to identify the extra 50 votes given the fact that the said 50 votes must have been casted for more than one Party,How are you going to to that without dispute?Best bet is to cancel all votes in the affected polling Units which includes the votes for all Parties & that was exactly what the Tribunals did.It affected the PDP because the over voting took place in their strongholds.From the Record so far seen..The total votes in dispute was about 180k for all parties out of which the APC had 60k & PDP 112k & all were cancelled.

After finding out the method used for the judgement on the election tribunal that gave victory to Oyetola over Adeleke, I would say it is a recipe for disaster, the method applied was cancelling all the votes of a polling unit because of over voting in that particular polling unit.


The questions I ask are:

1. As it happened that there were over voting in various polling units in the Osun election, what if each opposition connives to perpetrate over voting in polling units in each opposition strong holds?

2. What then is the use for BVAS in over voting if after the BVAS is able to identify the number of over votes only to end up cancelling all votes(valid) and over votes(invalid) ? That is like throwing away a baby with the bath water.

3. If there is an election tribunal like this and a rerun takes place, what if the same over voting keeps occurring over and over, would they keep repeating the election tribunal process and back to rerun again?

In my opinion, the law is just an error or a purposeful scheme to rig an election using what I call reverse voting
Just simply tamper with your opposition strong holds and invalidate their votes, So we might be having a case where a carefully selected and protected minority will determine winners of an election instead of the majority carrying the votes.


Implications:

1. It will make elections become very dirty because politicians will be all about scheming to invalidate votes in opposition strong holds.

2. It will make the voters lose confidence in the electoral process, because a voter will not be sure if his vote will be invalidated or not by someone else scheming with a politician in his/her polling unit.

3. It will make voters wear out easily and may cause voter apathy when you have reruns after stressful elections, thereby reducing voters turn-up in reruns.

4. It may not reflect the true will of the people and also reduce the total number of voter participation, just like the Osun election tribunal, the total number of votes cast for both PDP and APC after the cancellation doesn't reflect the true will of the people to declare Oyetola the winner.

5. Elections will cost more because of Tribunal, reruns and time wasting.

6. It could lead to anarchy and total chaos, like in some volatile states in the north where they riot over political results, just imagine after election and INEC says they have cancelled over 20,000 polling units across the north which were all stronghold of a particular candidate, because of over voting of less than 2000 voters, imagine what will happen in the aftermath of such news.

Solution:

In situations of over voting, Why not just deduct the invalid votes(over votes) and count the rest, the BVAS already identifies the number of over votes(invalid votes), doing so, INEC will avoid a lot of election tribunals, scheming by politicians, reduce cost of doing reruns, make more accurate results, increase voters confidence, reduce time wasting, reflect the true will of the people and avoid anarchy.

His submission is moronic. A party is suppose to have agents at the polling unit, who sign off once the vote is counted. Also how can opposition mobilize against you in your strong hold. Do you people think at all. Can opposition mobilize against APC in Alimosho or Isale Eko?
