After almost two years of intrigues against his recall, the President of the Court of Appeal, Justice Ayo Salami, has thrown in the towel without returning to his coveted seat.

Vanguard learnt from competent judicial sources that the respected judge has finally opted to retire from service rather than continue to wait for reinstatement, as was recommended by the National Judicial Council,which had earlier approved his suspension.

The source confirmed that Salami had already tendered his pre-retirement letter to the NJC and that the council had accepted it.

According to the source, Salami, who is expected to formally retire from service on October 15, 2013, is to proceed on his pre-retirement leave this month.

The source, yesterday, said: “It is true that we have received Salami’s pre-retirement letter and notice in accordance with the rules of National Judicial Service of Nigeria.

“The development has put to an end any possibility of recalling him.”

The retirement notice filed by Salami is expected to pave the way for the emergence of either Justice Dalhatu Adamu or Justice Zainab Bulkachuwa as the substantive FCA judge in the next three months.

Bulkachuwa has, however, been acting in that capacity since November 22, 2012.

A reliable source said, yesterday, that the authorities were more disposed to recommending the female judge to succeed Salami because of her impeccable record of service so far.

It will be recalled that NJC had, in August 2011, suspended Justice Ayo Salami for refusing to apologise to the council and the former Chief Justice of Nigeria, Justice Aloysius Katsina-Alu, after a panel of the council found him to have lied against CJN.

Beyond the suspension, the council recommended to the President to retire him from the Bench, an action that forced Salami to challenge NJC’s action in court.

However, in May 2012, NJC rescinded its decision and recommended the reinstatement of Salami, but Federal Government citing several court actions over the matter, distanced itself from the recommendation of the council.

Although the Attorney-General of the Federation admitted receiving the letter, he however, insisted that President Jonathan would not abide by it until the cases were disposed of by the courts.

Adoke, who described reports of the President’s reluctance to reinstate Mr. Salami as a misconception, stated that no responsible government would proceed to recall the judge when a case against his reinstatement was pending in court.

This is what makes Nigeria unique: impunity.

If a man is suspended for suspected wrong doing, one, I meant a sane mind would expect two possible outcomes.
1. The allegations are proven and the culprit is punished according to appropriate laws.
2. The allegations are found baseless, worthless. In this instance, the accused is returned to his duty post.

Allegations of wrong doing made against Ayo Salami have been found to be spurious. NJC recommended his reinstatement but the president, alas a corrupt president who rushed to approve his suspension following recommendation of same NJC has suddenly refused to do the needful.

That's why a man on suspension is allowed to take pre-retirement leave (Nigeria wonders!!!). That does not sound like a man with hands full of atrocities. What happens to outright sack, disengagement if there are grounds to toe that line? If this is not persecution, I don't know what it is.

Well, thanks for moving against vote robbers and usurpers who stole victories and relentlessly pummeled their own people. Posterity shall judge your persecutors and When the history of these times will be written, the present power wielders would not escape unscathed. Oni and Oyinlola have not only been humiliated by the PDP, both have been consigned to the garbage can of history in SW politics. Justice Katsina-Alu(rtd) eventually paid the price in a mysterious circumstance. The NJC after some soul searching reversed its decision and recommended your recall but as a principled man, you rejected the conditional reinstatement. God dey!

I SUPPOSE IT WAS AYO SALAMI TOO THAT HANDED MOST OF THE HOUSE OF REPS AND SENATORIAL SEATS IJ 2011 ELECTION TO ACN / TINUBU.
THE TRUTH REMAINS THIS: NJC INVESTIGATED ALL ALLEGATIONS AGAINST JUSTICE SALAMI AND CLEARED HIM OF ALL WRONG DOING. WHAT JONATHAN DID WAS PURE POLITICS.

In your attempt to indict the President at all cost, did you guys bother to find out if there were truly pending court cases that militated against a possible reinstatement of Justice Salami as stated by the Attorney General and Minister of justice ?

The same NJC suspended Justice Salami over a proven allegation of "lying on oath" by two investigative panels, he was asked to hand over to the most senior justice of Appeal Court and with a recommendation for his removal to the President.

He was suspended but not removed, the suspension was challenged in court, and also his reinstatement. He was later cleared of his alleged wrong and with a recommendation for his reinstatement.

The question is, was the cases instituted by Salami withdrawn to pave way for smooth reinstatement ? It is trite in law that once a dispute had been submitted to the court of law by one of the parties, every other party must await the decision of the court of law and no action must be taken to pre-empt that decision.

What else could the President have done if the rule of law must be uphold at all times or why has bodies like the NBA and NJC not taken it upon itself to arm-twist the government into reinstating him if it is that easy ?

Did Salami not have cases in court before the President accepted the NJC recommendation to suspend him with the speed of light? Is it not hypocritical for the president to tie his recall to cases pending in court? So it wasn't subjudice to suspend him?

NJC's rescission of the suspension of Salami was greeted with wide acceptance in the legal profession community and outside it. Groundswell of public opinion, newspaper editorials did not sway the president to assent to his recall. High Wire Politics and Politics of Self-Preservation, because he and his party had partisan interest in Salami's case.

It is always easy to blame the usual culprit, but like I posed earlier, how come legal bodies like NJC, NBA, Body Of Benchers et al that understand the nitty-gritty and technicalities involved did not take it up with the Attorney General and minister of justice by instituting a case for his reinstatement in a competent court of jurisdiction if indeed there were no legal obstacles on the way ?

Good riddance to bloody old rubbish. We don't need corrupt Tinubu rats and ACN moles in the judiciary. Let them win at the polls rather than rely on back-door judicial manipulation to claim mandates that they did not receive from the masses.
