As court on Wednesday postponed judgment on a legal challenge disputing the eligibility of opposition leader Muhammadu Buhari to stand in this weekend’s general election because he cannot produce his secondary school leaving certificate. Mike Ozekhome has warned Buhari supporters against celebrating prematurely as the High Court could overturn Saturday’s result if it finds Buhari lacked the requisite qualification. Buhari’s All Progressives Congress claim the petition is part of a ruling party plot to disqualify its 72-year-old candidate days before Saturday’s vote. “The suit has been adjourned to the 22nd and 23rd of April, 2015,” judge Ademola Adeniyi told the Federal High Court in the capital, Abuja. The petition filed by a private citizen, Chukwunweike Okafor, and argued by Mike Ozekhome, one of Nigeria’s most prominent lawyers with close ties to the ruling party, claimed that Buhari lacked the required academic credentials to stand for president. It also argued that he lied under oath to the Independent National Electoral Commission (INEC) when he swore that the military was in possession of his academic papers. Buhari, a former army general, led Nigeria as a military ruler for 20 months beginning in December 1983 and has stood for the presidency three times previously. Buhari’s lawyer, Akin Olujinmi, said he was “absolutely happy” with the court decision as it removed the air of uncertainty and “pressure” on the INEC with the election just three days away. Ozekhome warned Buhari supporters against celebrating prematurely as the High Court could overturn Saturday’s result if it finds Buhari lacked the requisite qualifications. “In the event, for example, Buhari wins the election, all it simply means is that, when eventually we finish this case and the court found that he was not qualified… the court will simply dethrone him,” Ozekhome told reporters. According to Nigerian law, presidential candidates must have completed secondary school. The whereabouts of Buhari’s secondary school certificate was not raised during his three previous presidential campaigns in 2003, 2007 and 2011. But the emergence of the question this year, with Buhari seen as having his best-ever shot at winning the polls, raised eyebrows in opposition camps. Ozekhome knew that wisdom prevailed in the adjournement of the suit but feared the result of saturday"s election. Either way, what he is trying to tell us now is that even if Buhari wins on Saturday, it will be overturned on the 22nd April and if he doesn't win then no more case. I can predict what GEJ and his followers will try to do after Buhari is declared winner -- they will then break bank to try to get the judge to disqualify him so that Jonathan can crawl back to power through the backdoor. But by then it would have been too late. Truth is, it'll be much easier for PDP to buy a judgement disqualifying Buhari than to meet him at the polls coz as things stand GEJ will surely lose this election. That right there is the source of their panic. They've tried every trick in the book -- from "Jega must go", to rejecting Card Readers and PVCs, and failed, now they're trying this tactic which is also dead-on-arrival. Ozekhome the pdp card carrying member just expressed his worries when he said if for example buhari wins, it seems they have all accepted defeat. But just want to cry a river and console theirselves. Firstly, if GEJ and PDP can massively rig the presidential election and declare themselves the winner, lawsuit against Buhari will die a natural death. On the other hand, if Buhari triumphs, as is expected, PDP will resort to the law court in an effort to invalidate the contest. APC has to remain on guard. I would have loved a categorical dismissal of the case. In the meantime, I believe in the APC's ability to foresee, defend and defeat any PDP demonic tactics. Chanji! 13 Likes 1 Share |

I knew from day one that GMB has no case to answer against PDP,all suits filed aginst him were dead on arrival,because in all honesty they lack substance. I'm equally dissapointed that the court didn't threw out the case once and for all,rather its giving some people the opportunity to run their mouth like a leaky tap. Questionable character like KORO"took a bow"to become a senator despite having dual citizenship which goes against the laws in the constitution,not to talk of a man whose public record is as clean as a whistle.
