In a statement on Tuesday by its spokesperson, Mitchell Ofoyeju, the NDLEA described the court order as trivial and an attempt to prevent it from performing it's statutory functions. The agency maintained it had received an order from the United States Government to extradite Kashamu for drug related offences and claimed to have served a warrant of arrest on him.


So, in other words, the NDLEA would rather obey the order of the United States government than the order of a Nigerian High Court? Is this not the most shameful manifestation of inferiority complex and 'colonial mentality'? This is ridiculous.

If kashamu is sworn in,will he have diplomatic immunity? Cos d case has been adjorned to June 4th if so that means d man can't be arrested bah? Pls correct me if I am wrong.

Does US law now supersede Nigerian laws?. The moment a Nigerian court have given order for NDLEA to leave his compound, they ought to obey that court order immediately. It appears the incoming government is going to be a western puppet.

By the way, the US do not obey international laws, so they have no grounds to ask for Kashamus's extradition.

Besides..if you have a warrant of arrest, what is stopping you from forcefully entering his house...

Afterall...resisting lawful arrest is another crime.

Final shot: this only confirms why our soldiers have not been able to arrest Abubakar Shekau...cos imagine if it were Shekau in that house...would they be waiting for him to hand himself over? No sting operation? No bulldozer?

Nigerian security outfit keeps working very unprofessional since democracy started. Can any African country write any letter of extradition to the US and such be honoured without obeying the US laws. They leave the real criminals and aired documentaries and start their eye service hob to Buhari. Either you extradite him or not Buhari will change all of you.

Its the major reason most of the corrupt officials evades justice

Nigeria is a signatory to the treaty agreement with the US and the executive branche of government is bonded to obey that extradiction request, but there have to be an extradiction hearing for him in Nigeria, but the Nigeria judiciary does not have the authority to prevent the Nigeria executive branch from carrying out that extradiction unles during the extradiction hearing, the judiciary come to determine that, his rights will be violated if extradited.

The judge that issue that order is in the wrong here.

My guess is, NDLEA does not have an arrest warrant from a Judge yet, hence they have not broken down the barracades to taken him into custody. And they have every right to keep within close distant of the suspect until they obtain that warrant, especially if there is reasonable beliefs that, the suspect will be a flight risk.

I don't know if your problem is comprehension or reading, the OP clearly states that the NDLEA have obtained a warrant and have also served said warrant to his lawyer given he is holding up within his house.

It's the court who are a smack bang out of order insisting the agency relax and let the man make a run. NDLEA know if they loose him now he'll be gone forever. You can be sure any deal Buhari would strike with the US would have him as a clause

Extradiction orders are not letters, they are valid orders from the court of the originating country and yes, if two countries have an extradiction treaty signed and passed into law by both country's legislatives, that order is as good as having been issued by a judge in the destination country.

The US and Nigeria signed an extradiction treaty, that treaty was ratified and passed into law by the Nigeria Senate and it has the same force of law as any other bill or law passed by the Nigeria Senate and NDLEA is bounded to carry out that order.

Only that, they have to arrest him, take him to a court in Nigeria for extradiction hearing. Such hearings have a limited scope, it is not evidentiary, which means you cannot plead your case there...they will look up want he is being charged with, compare it to see if such charges are also illegal in Nigeria, some countries with lots of influences also ensure that, their treaty also provides that intended punishment shall not be such that are illegal in their home countries....eg if the punishment for his crime is the death penalty and hypothetically Nigeria does not support the death penalty, the extradiction judge will refuse to allow him to be extradited until the other country agree not to seek the death penalty, the judge also look to make such that, none of his rights will be violated,etc...after which he will be handed over.

They are obliged by international law and agreements to hand over a criminal with a warrant once the case has been presented as they believe it is answerable.
I believe a court had already granted that he should be extradited a while ago and he has been fighting that a while now and also using the influence of GEJ.
If he is allowed to be sworn in as senator that extradition becomes extremely difficult
