The Attorney General of the Federation and Minister for Justice, Abubakar Malami, has said for the inconclusive Kogi State governorship election, the All Progressives Congress will only need to substitute its candidate, Abubakar Audu, who died on Sunday.

Malami, who spoke in Abuja at a seminar organised by the Nigerian Law Reform Commission on the reform of the National Environmental Standards and Regulation Enforcement Agency (Establishment) Act‎, said the election has to be concluded.
Malami said the APC would have to substitute its candidate for the purpose of the supplementary election.

He however did not say that the party’s deputy governorship candidate, James Abiodun Faleke, would automatically step in as the candidate.
He said: “The issue is very straightforward.

“Fundamentally, Section 33 of the Electoral Act is very clear‎ that in case of death, the right for substitution by political a political party is sustained by the provisions of section 33 of the Electoral Act.

“And if you have a community reading of that section with Section 221 of the Constitution, which clearly indicates that the right to vote is the right of a political party and and the party in this case, the APC has participated in the conduct of the election.
“It is therefore apparent that ‎the combination community reading of the two provisions does not leave any room for conjecture.
“APC as a party is entitled to substitution by the clear provisions of section 33 of the Electoral Act.

“Also Section 221 of the Constitution is clear that the votes that were cast were cast in favour of the APC.
“Arising from that deductions, it does not require any legal interpretation.
“The interpretation is clear: APC will substitute, which right has been sustained by Section 33 of the Electoral Act.
“So be it.
“The supplementary election that has to be conducted along the line.”
Asked if ‎that substitution should automatically benefit Faleke, Malami said: “It all depends on the appreciation of issues arising from the primaries conducted before now.

“There was a first and a second candidate.“That primaries that had taken place over time had not by anyway been nullified.“And it is recognized by law. “But then a further consideration would be the idea of conducting another primary but that is not envisaged in view of the sustainability of the first primaries.‎”

Well it has to be Faleke because that is why there is a main candidate and a deputy. In case of situations like this. Same happened with GEJ and Yar Adua. It doesn't matter whether they have been elected as long as the process has started. If a ship's captain dies on a journey, the deputy takes over. You don't stop the ship and fly in a new captain to take over. That is absurd.

Deputy taking over is also termed Substitution. However that will be left for the Party to decide.

What is certain, is that, there won't be fresh election! Wada Got to go ASAP!

The court will still have to decide on this matter. No matter the decision taken by INEC, the other party will still have a good ground to go to court.

This is totally unacceptable. The AGF should have called for fresh elections. So as to have a fair and free dispensation, a fresh election is the only thing that should have sufficed. If INEC wants to be taken serious, they should discountenance the AGF's interpretation and announce a day for Fresh elections. This is Fraud.

Initially I felt Faleke shud automatically complete the process and a deputy chosen for him by the party,but on 2nd thought it cannot be right and just. This is because Faleke didn't contest the APC primaries,so how can he now assume the mandate that was won by the APC because Audu was preferred to Wada, not necessarily that Audu/Faleke were preferred to Wada/deputy.
In otherwords, Faleke's electoral value is not that much, left on the ticket as a main, APC might have lost.
So the logical thing I feel shud be done is for APC to organize another primary while Faleke remains the deputy.

...the AGF interpreted the Nigerian Constitution and Electoral Act in regard to the Audu happenings,not street talks. You follow the constitution....

The ball is in APC's court. They have two options left for them. It's either they fill the space with the candidate second in position to Audu at the party primaries or with Abiodun Faleke who is already a joint contestant with Audu for the people's mandate. The mandate primarily belongs to the party and the Party has the sole decision to chose who to give it to among its eligible members.

Only two APC's members are eligible in the circumstance at hand to fill in the vacuum. It's either a party member who contested in the party primaries that produced Audu in the first place, in which case the candidate that came closest to Audu in votes then may most likely fit in, or the candidate in joint contest with him for the party's mandate in the Guber elections, which is still ongoing. As it is now, the APC maintains the right to chose from either of them as there is no law that specifically states they must consider previous party primaries to chose the candidate to fill Audu's position in the circumstance.

Both the constitution and the electoral act did not envisage the situation in Kogi. The elections were declared inconclusive. If the winner had been announced, this would have been the appropriate decision.

Let's be honest with ourselves. This decision, if true, is challengeable at the courts, since the electoral Act or constitution didn't exactly envisage this situation.

This is the only reason the death of late Audu was not announced until after the results were announced. A chieftain of APC asked the question why the family did not announce the death of Audu. He claimed that late Audu died on Saturday after he had cast his votes. In Naija politics anything is possible. The AGF as far as I am concerned just gave the reason why the death was not announced until after INEC announced the election results. QED
