I knew it, Faleke is the biggest casualty in all of the scheme, well, who knows, I might retrieve his mandate via the court of justice and plung Kogi into judicial mess

Faleke will win this very easily in court. This guy cannot come from the clouds to claim votes he never campaigned for. Faleke was on a joint ticket with Audu. So he has more rights to the votes. Faleke should go to court and get an injunction to put the election on hold until the matter is resolved. No time. Such an issue should not be left open to interpretation and abuse. Buhari, tread wisely. We are watching.

Faleke cannot win in courts. There was no way he could have been made a candidate in the election he didn't participate in it's primaries. He could have had a good case had Audu been declared winner. But since it was declared inconclusive, he can't lay claim to being a "winner".

APC has done the most reasonable thing here by picking Yahaya Bello who was second in the primaries. PDP's hope of winning at the court is already dashed now.

Constitution allowed for substitution of candidate in case of death except before the commencement of an election. The same constitution asked the deputy to step in after the election has been validly won and something happens to the boss.

Audu died during not before the commencement of an election.

Election has not been validly won according to INEC rule and electoral guideline.

APC has won this election already. The only battle ground is the Supreme Court. That is where it would be sorted out whether the new substitute or Audu deputy is the right figure to head the government.

PDP has no case here, going to court would amount to wasting of money though that may see to development of our body of law and constitutional provisions.

Nigeria will be great again.
Exactly. APC has done the best they could do in this situation.
Fielding Audu's son or Faleke would have landed them with numerous legal battles but as it is now, it's only PDP they may have to contend with at the law courts, even though PDP will lose there too.

He came second during the primaries, he should be allowed to take over.

am not sure a court can stop election without first going to electoral tribunal. this election will hold as scheduled then tribunal takes care of issues

For me the election is just gonna be a watse of time and resources....
Because if APC still wins...then a whole lot of litigaion fireworks will see the incumbent governor remain on that sit.

Politics is a family birthright neither is a zone birthright as well, we ebiras av come a long way and its d right time 4 rule our beloved state KOGI and 4 Jane faleke come back to Lagos represent our lovely constituency so u won't died of a broken heart....less I forget hope u remember dat d remain polling unit are in kogi central so APC really play their card by choosing yahaya bello.

As an Igala I can say confidently that fielding Audu's son would have been a mistake in itself since that cannot stand the legal fireworks. Also that guy has alot to learn in politics. When his dad was alive, he always shun youths who brought great ideas to him to pass to his dad. His favourite saying then was - "I am not a politician but a businessman; leave me out of this". All of a sudden some people who think he will be controlled by them started throwing his candidature up. That said, who knows if he would have been excellent Gov just like the once unknown Fashola.

On the second note, Yahaya Bello called Fairplus massively funded the Buhari Osinbajo campaign in Kogi donating many buses. Audu supported and rallied Pl delegates for his friend Kwankwaso against PMB. Fairplus ran the most organized campaign when he vied for Governorship. However he disappointed his fans when he refused to support Audu rather he decamped to SDP first and later ran back when he saw that he had a case against Audu's emergence at the APC Hqtrs. When his petition was thrown out, he funded Wada.

Now food is ready and Audu has won the election and he has come to reap the labours.

As for Faleke, he also has a good case. But the case of Fairplus is stronger and can stand the test of time.
I advise both of them to work together to do the kind of developments that Kogi has never seen in all the years ruled by Igalas Govs. That is the only way they can win the hearts of the normal igala populace. Hunger and poverty do not differentiate between tribes and religion. At the market, they don't ask you for your tribe before they sell to you.

It is not a risk, and nothing will happen if he plays his cards right and chooses the right deputy. All these prophets of doom are saying so for their own pockets. That Governorship is Faleke's. Who cares about going against party? Did the senate president not do the same? Yet the ones that supported the senate president in what he did are trying to stop Faleke from legitimately claiming his candidacy. Rubbish.

If APC wins, Certificate of Return will be issued to Yahaya Bello (APC) in this case. He will be sworn in and Idris Wada will handover.

Idris Wada (PDP) can then go to court and start the endless litigation process.

So you see my point now?

Faleke wasn't in any primaries but this Bello dude came second. Just like Amaechi who was in the primaries but didn't contest during the election but was sworn in when the party flag bearer was found wanting.

You are very correct. The law, as of today, allows substitution of candidate in case of death, but only before the commencement of an election, not after a conclusive election. But, in this case, we have an already on-going election, just not conclusive. So, in truth, whatever decision the APC arrives at, can be challenged at the courts. There is simply no logical way to determine who succeeds Audu between Faleke and Yahya Bello. We'll have to rely on the wisdom of the courts to do the right thing.
Falake can only win in court if he proves the election wasn't inconclusive. According to figures, Late. Audu already won the election and there is no need for supplementary election. The votes under contention is 49,000 (registered voters) and not people with the PVC which is 21, 000 people. Since only the use of PVC is allowed for accreditation of voters, this implies that only 21, 000 votes is in contention in the real sense of which Audu/Falake already has above that number. It means INEC erred in declaring the election inconclusive by basing their calculation on the number of registered voters. If this is the case then, late Audu was duly elected as a governor-elect hours before he died, which makes Falake the rightful owner of th mandate according to the constitution.

Amaechi wasn't sworn in because the flagbearer was found wanting rather he was sworn in because the supreme court ruled he was the rightful PDP candidate during the election
