Court says it’s abuse of process

There were indications weekend that the federal government may drop the forgery charges slammed against Senate president, Dr. Bukola Saraki, his deputy, Senator Ike Ekweremadu, former Clerk of National Assembly, Salisu Maikasuwa and one other following the ruling of Justice Gabriel Kolawole that it is abuse of court process.

The case was brought against them by the Attorney General of the Federation (AGF) and Minister of Justice, Abubakar Malami, SAN.

The court faulted the charge for being filed during the pendency of a civil action instituted to challenge the propriety of the police report on the alleged forgery of the Senate Standing Rule 2015

Can we see a copy of the court ruling...last I read was that the judge refused to stop the criminal suit.

The OP is out to mislead the people. The judge stressed it that he does not have the power to stop the trial and the AGF has right to institute charges. However, his own grouse was that he thinks the AGF was hasten to file a criminal charge. That was his own opinion.

What else would have been more shameful that the avoidable impunity the PDP has demonstrated in the past 16 years they were in power. This impunity and gross misconduct is hunting them now in Abia state. The Dasuki gate and Metu recent appeal to return stolen fund met to purchase arm. That was the height of shame.

Justice Kolawole called it an abuse of court process but it is not in his power to stop the criminal proceedings because it was filed before a court of co-ordinate jurisdiction. In such an instance, the FG may either withdraw d latter suit pending the conclusion of the former or d High Court hearing d forgery suit may suo motu or at the instance of d defendants strike out the suit before it pending the outcome of the former.

This link reports his ruling on the aspect of abuse of court process. He even said if d forgery suit had come before him he'd have struck it out.

APC & Buhari need to borrow brain from mad people if they wish to succeed.

It will a BIG SHAME if they ever DROP this case without puting IKEORA & SARAKI BEHIND bars.

If Saraki defeats FG in this case I can also assure you that he will walk out a free man from CCT too.

Because IKE & SARAKI will in turn sue the FG fordefermation ofcharacter. 3trillion naira suit against FG loading...

If sariki goes, Buhari goes with him along everyother senator.

They altered their own rules, when someone takes advantage of the loop hole in the new rule, they call it forgery. Funny bunch, why alter your rules in the first place?
