Believe me EFCC is doing a good job. Believe me the non confirmation of Magu has made that man ginger pass hot oil ready to fry those goats eating our yams.I was in their office late last year and bros u will know say these guys are working unlike ICPC which shud be a department in EFCC.
Sadly we ve a dead judiciary that cant follow up well from where EFCC cos EFCC can arrest, investigate but cant be the judge. If only stiffer penalties like life or death sentence is handed to corrupt political office holders
However those recovered cars parked in their premises should be sold or used rather than rot away

I think it is high time Mr President pay attention to his kitchen cabinets, because it is absurb that an executive will sent a list or a person to the national assembly for confirmation and another arm within the same cabinet 'll write against it without the president's consent. I don't think we should blame the national assembly on the issue of Magu... they only found a platform to stand and exercise their own malicious behavior. The executive need to do their home work well before coming out with anything.

The same thing is applicable to the issue of corruption, where they will not do their findings and file their case very well before shouting around that corruption is fighting back...why cannot corruption fight back during the trial of Tafa Balogun, Bode George and sunday Afolabi amongst others. They need to do a tight and clean work before MEDIA prosecution. They need to be consistent...corrupt people neeed to be uprooted in our midst to a bearest minimum.

The EFCC Act is a subsidiary legislation to the Constitution,it does not in any way conflict with Constitutional provisions.Nowhere in the Constitution is there mention of EFCC,how it's to be structured and its leadership appointed.That part came under lawmaking powers of the NASS.
Simple Govt 101 and our VP failed it.
I wonder which law school the VP and Falana attended and what grades they came out with.

D VP has clearly stated where d constitution stands on the matter and d constitution clearly supercedes any other legislation. They have sent d name d first and second time and dey have at both times been rejected. Why are u going ahead to represent the same name to d same Senate who have been rejecting him since they have stated d constitution is clear on dem not necessarily sending d name to d Senate? Do u ppl need tutorials to understand dat part again? They've been wasting time making d same mistakes over and over again but it's becoming obvious most of u are jus a dumb bunch who jus have to kip supporting every dumb move...

Well, I'm not a lawyer, and neither am I in the legal profession to be able to interpret laws or the constitution. But my comment was based a statement by someone who I believe is in better position to understand the laws and constitution of the country by virtue of his knowledge and vast experience in the legal profession. The statements by Femi Falana (SAN) below:

“It will be unfortunate, a tragedy to the country, every public officer has his or her power defined by the constitution. The moment you go outside that you have engaged in impunity. Section 171 of the constitution has vested the power in the president to appoint any person to that office or act in that office and the duration is not specified.

“Of all the positions listed there, positions to be occupied by public officers without any reference to the senate – secretary to the government of the federation, permanent secretaries, head of service and heads of extra-ministerial departments like the EFCC and the ICPC.

“With profound respect, in sending the letter to the senate for confirmation, the president relied on section 2 subsection 3 of the EFCC Act but that section has to be read subject to the constitution.

“So if you do that, section 171 takes precedence over section 2 subsection 3 of the EFCC Act. So does the president need to ask for confirmation? No.

“Unfortunately, the executive is not exposed to sound legal advice on this matter, with profound respect. In that section 171, subsection 2, you also have position of ambassadors and heads of our foreign missions. But that subsection says they shall be confirmed by the senate.”

if every accused person is allowed to say something like Magu did, what is d essence of trying them in the court of law. is PMB a lawyer or a Judge? some people are just too quick to support this current administration without reading their body language. so because Magu is involved, dss no longer have a good evidence. let us try to differentiate between the truth n lies of today

Many of the legislators have EFCC cases hanging on thier neck and you don't expect them to confirm a serious anti corruption c-zar like Magu, impossible. Of course any body can be appointed to head the EFCC like we had in the era of Lamorde and waziri during which EFCC was nearly dead because they wanted to remain in the good books of the legislators and still claimed to be fighting corruption. If that is what you want then forget about fighting corruption and rather declare corruption legal afterall one of our "heros" once said stealing is not corruption !

Idiots! If the enabling act that creates EFCC and determines who and how the Chairman is appointed and should operate, what stops the Chairman of the EFCC from disregarding every other clause as contained in the EFCC act. After all, they are Inferior to the constitution.

There's no law against representing Magu and no law against The President sacking him from Service or Somehow relieving him of his services at EFCC. The President has a MORAL RESPONSIBILITY to respect The Democratic Wishes of The Electorates expressed by their elected Representatives, The Senate.

I am not even a lawyer but it pains me when a lawyer is willing to stand truth on its head for political gain.....

This matter has already been duly resolved in the case of Festus Keyamo VS President and 4ORS. That judgement gave a clear interpretation on what Federal government shouldnt do with respect to appointment.

The Federal government under President Jonathan and previous administrations used to abuse this provision of the Constitution to appoint service Chiefs for military but keyamo was able to challenge this because the enabling acts establishing the armed forces require confirmation from the NASS for such persons to operate in full capacity. Hence, until they are confirmed by the NASS, they are declared as Acting-Chiefs/Heads/Chairman.


The Constitution allows him to be appointed without recourse to the National Assembly, but the enabling act of the EFCC - that creates the EFCC and well as determines the scope and powers of it operation - does not allow him to operate as Chairman without Confirmation from the National Assembly and that is why he is called the "Acting-Chairman" and not Chairman of the EFCC.

They are free to lie to themselves and Zombies alike but that doesnt change the truth......... angry

Also, the Senate House rules, that guides their conduct and operations doesnt permit the Senate to consider Magu for the Job of EFCC Chairman, which explains why they are not even planning on sending Magu back to the Senate.


Order 131 of the Senate Rules states that, ”nominations neither confirmed nor rejected during the session or within 21 working days in the case of ministerial nominees shall be returned by the Clerk to the National Assembly to the President of the Federal Republic of Nigeria and shall not again be made to the Senate by the President of the Federal Republic of Nigeria"

Magu can be considered for confirmation for any other Job except that of EFCC chairman. So they are free to say whatever suits them, the law is clear
