Yes. Depending on the circumstances surrounding the child. Google it. Man forced to pay child support for a baby that is not his. It happens from time to time in the abroad.

the man could have made a mistake during love up to use his wife name on some of the properties, so with this the woman can claim them if he fails to acts fast on the original with a compitent property lawyer.

the dna could proof the man is not kind of a real man to father a baby,but I will advise the man never to lost hope but keen in keeping his properties from this irresponsible woman called wife

In the EU, the issue is simply like this : was she in a recognized relationship with you ? if yes then she gets half of the property, child or no child, cheating or no cheating

the problem with many african and asian countries is that half of the time people use traditonal social laws which half of the time were always against a woman

hence you find that most women wanna days women want a civil wedding meaning the protected from tradition were brothers or relatives would take property etc in death situation, in this case she is protected by civil law to get what the bought together even if one was working

Under what laws are they married? Nigerian or Foreign.

If Nigerian; Customary or Federal Laws.

Also under federal laws, infidelity is good grounds for divorce. If the child isn't his, I don't think he will be made to pay Child maintenance. But he may need to speak to a lawyer verse in marital laws to pit him through. I think he may still habe to pay his wife "Spousal Maintenance for a set period of time. All properties purchased under both their names (e.g Mr. & Mrs Smith) will be split and that's it. Everything else should remain with the title owner (not too certain).

Also what people do nowadays is place their assets under a company or business name. The risk being if your business goes into receivership, everything tied to that business goes down with it.

My advise is get a lawyer.

Where does this your friend reside? In Nigeria or Abroad?

In Nigeria, I am not conversant with the marriage laws but i don't think it's 50/50. If it is , your friend should hire a law to read the fine prints for loopholes.

As a general advise, before anyone should file for divorce, it is recommended they do there home work first.. So they could catch the other party unaware and take care of few stuffs before the other party lawyer up.

That is not true in the US. Even if the child is not his, that is completely separate from division of property. If he assumed the role of a father during the marriage, the court views him as the father regardless of DNA.

Let the guy find settlement outside court room, in as much as it's the guy that calls for divorce, law will take its course.... There are 2 solutions for u at the moment

1. Withdraw ur divorce papers and then pressurise her so she could file for divorce herself then ur lawyer can make a better deal on ur behalf
2. If the most properties are owned by you u can make " sale" to another firm for ur safety

In Oghoyone v. Oghoyone (2010), the Court of Appeal essentially held that a respondent has joint interest in property belonging to both parties.
So, if any of the property has joint title i.e. real property such as houses or commercial buildings, the trial court may indeed award half of the property to the wife. Meaning that if they jointly owned, say, two homes, one of the homes could be awarded to the wife by the judge.
