Dear VO, my wife was issued a visiting visa in January 2014 January, but due to issues with my health then, she couldn't travel. By May of that same year ,she wrote asking the embassy If she can now use the visa for child birth. They responded in the affirmative. And she traveled in June. Had the baby in July and came back in August. The problem is that her visa was canceled in January 2015 when she took our first baby to the embassy, she was carrying our last baby and the VO, asked her why she applied for only one child instade of two.after her explanations the VO canceled her own visa n denied our daughter visa . Even when she explained that we sought the permission of the embassy before traveling because of change of purpose. Since then she has been denied Visa 3times without any reason. Please what can we do as I sincerely want to travel with my family. I have a valid visa which I have also renewed, but the truth is that I don't enjoy vacation without my family with me. |

Hello Tanker01. We have addressed this issue many times before. Birth tourism is legal in the US provided the applicant is open about their intention and pays the medical expenses in full. This means that the applicant should declare any such intention they have at the Embassy/Consulate and again at the port of entry. If it happens that the applicant gets pregnant well after the initial visa interview, they will have the opportunity to make their intention, medical preparations and financial resources known at the POE. However, it will remain up to Customs and Border Patrol whether to allow that applicant into the country. Some are not, and they are put on the next flight home. This must be extremely uncomfortable for a heavily pregnant person, to spend 15-20 hours on a flight to America, several more hours being questioned, then another 15-20 hours on a plane home. This is what we want to avoid. Onto some other misconceptions: The concept of the “change of intent” letter is not valid. These e-mails are not read nor correlated with the applicant’s file. Some people who send such letters may get a form letter in response, but it is informational in nature and in no way confers permission to amend the declared purpose of travel. What matters is what you declare at the Embassy/Consulate and at the POE. After the fact e-mails do not carry any weight. Some applicants say, “I applied for only the B2 visa to declare my medical intent.” The B1/B2 visa categories are conjoined, so applying for only one does not make any difference. Other applicants say, “I appeared at the window with a big belly,” as if this alone is enough to declare their medical intent. Again, the responsibility is on the applicant to be honest about what they plan to do in the US. Other considerations: Medical care is expensive in the US, and costs can escalate dramatically if there are complications. Credibility is paramount in the US visa process. If visa officers detect any deception or obfuscation, no amount of excuses, documents or receipts will make up for the loss of credibility. Tanker01: |

Good day house.. please I have a sister who applied for Usa tourist visa last month, and she choose Miami, Florida as her tourist destination. her interview is schedule for the end of this month. but she heard about the weather forecast that the hurricane will get to Florida and people were asked to vacate most of the city.....my question is what can she do, can she change the city or she should still leave it like that, and also how many time can someone reschedule interview appointment. please we need your advice on this |

Dear VO. Someone was denied entry into the USA with his wife and also banned for five years because the individual that was suppose to pick them at the airport did not answer his call as I was told. He believed the case was not fair to him and he wants a salvaging action. Please what can he do? Can this case be revisited? Thank you. |

Hello Abujaniv, Thank you for your prompt response to our numerous questions, I need your response on the below questions: 1. Should the confirmation page be printed out in black & white or preferably colored? 2. Does one need to bring along a passport photograph to the interview even though a copy was successfully uploaded and appears on the confirmation page? 3. Is the Transaction reference no. given on the visa fee payment receipt same as the UID needed for booking an appointment stated on the website? 4. Are watches allowed on the day of interview?(I have heard unconfirmed reports of some specific watches not allowed) 5. Appointment date has not been booked yet, can one cancel/discard an already signed and submitted application, fill another application with the new changes and use the new confirmation number generated to book an appointment? |

Hello Abujaniv, On my application for a B1/B2 visa, I intend to visit New York for tourism, but I booked a hotel in Newark,NJ which is about 50mins away from some of the tourist sites I wish to visit and 1hr 5mins away from JFK airport. Is it out of place to stay in a hotel away from the main city I am visiting? |

Hello ZigZiglar. The color of the paper doesn't matter. Once the photograph is successfully uploaded, we don't need a hard copy. On question 3, you're best off asking customer service; that said, the instructions on our website are pretty explicit. Watches are allowed. You can change the interview date one time. Yet they server complained that my informations has been attached to an email. Was told to login to the email and schedule my appointment. Dear VO, my baby was very cranky during my last interview and it got me so stressed and as a result,I couldn't answer the questions well because I was distracted in a bid to pacify her. I want to reapply because I don't see anything changing in my circumstances for now,I am married with kids, been at my job for close to 12 years and recently got a promotion at work. My vacation date is in October.. I have a notarize d consent letter from her date to travel with her.. What do you advice? |

Read the refusal letter you were given. If you were refused under section 214(b), as the letter says, you are free to re-apply whenever you wish. If you were refused under a different section of the Immigration and Nationality Act, you may be subject to a long term (or lifetime) ineligibility.
