They cannot deny a man a right to his family life nah..... Eventually, they would issue the visa (with good legal representation)....

They are not, will not be the same family life they decided to live in Nigeria?

good legal representation at what cost and time?

But his wife and kid now reside in the UK. He decides if it's worth fighting for, considering the time and financial implications (if only legal aid or no win would take on this case).....

Legal Aid - NO
No win No Fee - NO

Would be an expensive financial fight...

When you get refused a visa in a case like this, the best way of addressing the refusal or reapplying is to be brutally honest with your previous immigration record then submit all the requirements.

The op entered the UK in 2005 with visiting visa and stated the date he arrived in the but immigration record shows that such information doesn't exist and within that period he has made 6 different visa applications to remain in the UK and all were refused.

You can not enter the UK in 2005 through the airport without your record being in the system, getting an immigration lawyer and paying huge legal fees is not the point but addressing the pivotal reason for the refusal will help your case.

Hence he needs to gather all the documentations he can lay his hands on and submit to his brief.......

Also depending on what information he has handed over before, during his back and forth application fillings with the Home Office (some information can be implicating and not assisting).....

Re: UK Spouse Visa/Appeal Process-part2 by tayeby78: 8:23pm On Oct 06, 2017
It has not changed on the tls tracker but we received this email on Sept 7th. Did you get the same email as well?

Your online application has been received at the UK Decision Making Centre. Your application is currently being prepared for consideration by an Entry Clearance Officer.

If you have made a Settlement application (except for applications lodged in USA and Canada): you must ensure that your UK sponsor has sent all relevant supporting documentation to the UK Decision Making Centre in Sheffield. The documents should be arranged in this order: application form and relevant Appendix* (See below); English language evidence; relationship documents; maintenance documents; accommodation documents. If documents are not received a decision will be taken on the basis on the information that has been provided.

If you have already had your supporting documents scanned in at the Visa Application Centre, or if you have already sent them in to us, please ignore the request for documents.

Please note that UKVI aims to complete all Visit Visa applications within 15 working days and all Settlement Visa applications within 12 weeks of the application date. If it is not possible to complete your application within this timeframe a member of our team will contact you to explain why.

If you have paid for Priority Service, your application will be placed in front of the queue and assessed ahead of other non-priority visa applications. As indicated in the terms of service, the amount paid for the priority service, as well as the visa fees, is not refundable if the visa application is refused or if the decision is delayed.

We regret that we are unable to respond to enquiries asking about the status of any application. Any status enquiry should be made to the international enquiry service, details of which are on the GOV.UK website. Staff at Embassies, visa processing centres and visa application centres cannot assist with visa enquiries. You may also wish to view the current processing times for applications made in your country.

A further email will be sent to you to confirm when your application has been assessed and dispatched. If your application was made in a Visa Application Centre, the staff there will contact you when your documents are ready – please do not attend the Centre until you are requested to do so.

Please note that you are advised not to purchase flight tickets until you have secured a visa for travel to the UK.

*List of Appendices:
Appendix 1 - Children / Other Dependants
Appendix 2 - Spouse / Partner
Appendix 4 - Pre-flight family members of Refugees
Appendix 5 - Access Rights to Child

Further information is also available on the UK visas and immigration website.

Kind regards,

UK Decision Making Centre

Good evening house. I have a quick question. Please, what is the address to be put on cover letter? Should it be addressed to the consular in Abuja or the Entry Clearance Officer? Thank you.

Hi I'd like to join my husband in the UK tier as dependent Spouse to tier 4 student hubby with my 2 children.
Last year all 3 of us including my husband applied and we were all refused. As his dependents, we were refused because he was refused his tier 4 pbs student visa.

This year my husband applied alone and got it. Now we want to join him.

I'm concerned about my application and bank statement.

I'm a house wife but with unexplained irregular deposits in bank account. How many months bank statement should I print? Would one month fly?

My hubby sent me the maintenance money from his account which also included his own maintenance he used to apply to process his visa.

Please help want to apply in 2 weeks time. Thanks

Then you got nothing to worry about,

Observe the 28days rule and present it with other documents..e.g family pictures, marriage certificate, kids birth certificates, proof of communication(whatsapp, emails, facebook messenger, text, phone call history etc). Your hubby's passport data page, proof of accommodation for all of you, a letter from his school ,TB test result and pay NHS surcharge

Thanks a lot for your reply.

I have the above.

What if I do some part time work as well as being a part time house wife, how do I represent it without any issues of bank statement?

Yes we have our 9 months maintenance. Do we need to show that my husband can sponsor us during his 3 years course beyond the 9 months?

If yes, how can we show that?

You are only required to show maintenance money for one year.

You can't present evidence of meeting financial requirement without bank statement

Use your tls log in. Email will be sent to you that they have received your application but you won't get any acknowledgement for documents sent. If they are yet to get it within a week after biometrics, they will send a mail requesting for it. Good luck.

Thanks for the reply. Please i need to know what sort of documentation in need to provide. Regarding my entrance. ( I don't have access to that passport due to the fact my dad has past away). The financial requirement is not a problem.

Please help me so I can know what sort of document i need to provide fr the new application. Also for frivolous application and missing 2 reporting section. It's was all bad advice. That's wat u go through when ur dealing with Nigerian solicitors.

Look through your dad's old records, you might just find the important document that saves the day.......

Meeting financial requirements is one part of the puzzle, the other important part of the puzzle, is your historical immigration entry details......

Just look for anything that would assist your spousal visa application.. Anything.........
