For the record ur landlord can serve u with a quit notice anytime he feels like. The six month notice can end on the day ur rent expires and u'ld still have to move out so long as u were served with d 'six month notice' . ur land lord has done the proper thing by serving u guys dis month and is on his right to do so. My Advice to u: U can seek for a further date within which u wud move out but ur best bet is to move out within the extra 2month given after ur rent expires. If u refuse to give up his property further notices wud follow shortly b4 litigation. Ps: a six month quit notice doesnt operate after the expiration of ur rent it can b served any time from six month b4 its expiration. 8 Likes |

Realdeals: Funny, i pay yearly, I have already paid for the year unless he is willing to refund the money for the remaining months left, till then I have to complete my one year, then my 6months before I pack out, if I don't pack out after then, he can do whatever he likes. |

olaben16: Move out gently, there is no stipulation in the law that he must give u 6months quit notice. Is just a function of the tenancy agreement u have with him. He can as well serve u 1 week quit notice FYI. The day people start building their own houses from foundation to completion if a house, u will feel d pains of a landlord.... 3 Likes |

Did you not specify what notice period is needed by both parties in the tenancy agreement? Imagine you have to move to another city due to work or you are fed up with living in the house, you give him adequate legal notice, would you like him to force you to stay there? If you will not like that why should a landlord who owns his house be forced to have tenants in his house if he wants them to go with adequate legal notice? If you want to do well in life do not listen to advice of those who with their actions and advice are not planning to do well. Aspire to own your own house (if you do not already own one in that city) and work towards it. Not creating problems for a landlord entitled to have his house back. My tenants and their guarantors sign a tenancy agreement clearly stating renewal terms and conditions and the process involved when the tenant wants to leave the property and when the landlord wants the property back. Every savvy tenant and landlord should have mutually agreed ab initio. I think in Nigeria we just like creating problems when such can be easily avoided. Be aware that when you create problems for landlord, you inadvertently encourage tenant profiling. Be it tribal, age, job type, marital status, or other kind of profiling. It is now common in Lagos for landlords to categorically say they do not want people from certain tribes. Due to previous experiences. It may be unfair but humans are largely subjective. 13 Likes |

Biscuits: Wait read your post again, let's assume the landlord didn't give him any quit notice, when will he pay the next rent? Is it not after his rent expires which is April? It's people like you landlords push around and threatened with quit notice. Like I said, unless he is willing to refund the rent for the remaining months so he will join it with money he has to rent another apartment, he has to stay there till his rent expires then use is 6 months. My guy, u re getting too comfortable in another man's house! I have a principle that help me in life; NEVER BEG/DRAG ANYTHING WITH A LANDLORD. If you tell me to move, I initiate moving mode immediately, even when u come back to ur senses(landlord), I move. This has helped me in life, after facing three idiot landlords, last one, I move to my own small apartment. It never going to be easy though, but it will pay u in the long run. 5 Likes |

Dear Poster, Sorry about your predicament. However, let me point out that for a yearly tenant, you're entitled to 6 months notice. This Notice to Quit can be served even during the pendency of a valid tenancy (when your rent has not expired). After the expiration of 6 months from the service of quit notice, you will be further served a 7 days owner's intention to recover property. This is the requirement of the tenancy law of Lagos state, after which if your landlord is serious about evicting all tenants, he may now proceed to court. There is usually no legal defence to recovery of premises by owner, except a very good lawyer can exploit the technicalities and defects in the notices served. If it follows the stipulated and prescribed format, anything asides that will render a notice defective. Which in that case, silence is always best till you get to court, point it out to the magistrate and the matter will be struck out. And also several tactics can be employed to stall tenancy matter, and owner will not have a choice than to negotiate. In your case, i will suggest a negotiation/dialogue with your landlord (with other tenants too), since you may want to avoid a confrontation. Perhaps you may find a solution. In the meantime, I would advice that you get a lawyer to study the quit notice served on you. |

olaben16: Please pack out or see how you can plead with your landlord: As a yearly tenant you are suppose to be given 6 months notice before the expiration of your rent and that's what he just did. Note you are to pay for the 6 months. Some will wait for your rent to expire and after few weeks give you 7 days notice to quit because the law calls it tenant at will. Let me explain the process: 6 months notice or 7 days notice to quit 7 days owners intention to recover property Summon to appear in court Hearing and subsequent adjoinments till the matter is disposed off. If you put in a lawyer, the Lawyer can be helping to adjoin the matter with flimpsy excuses just to prolong the case in court for you to gather enough money to leave the house but you must be prepared to pay the lawyer. It also depends on the magistrate who is in charge of the case. I think this can help a bit |

Don’t go to court yet. Did you sign agreement with him, if yes, what are the terms with respect to notice. Hope you still have the receipt of your payment. He has the right to quit you even with 1month notice if it was stated on the agreement. But if you did not sign agreement, the law says 6 months for yearly tenant on flat. The only place you have to base you argument is on quitting before your rent expires. This is unlawful and that is the only place you have a case but ensure you have your receipt and the letter to quit. The least quit notice must end with the last date of rent, which ought to be on April 2019 as you said. The landlord will be right if he gives a quit notice on or before 1st of November 2018. I understand your landlord's apathy towards you people; he must have met the house in a state he is not happy with. I sense this based on his initial stance of asking which issues you people have coupled with his having to drop the caretaker; it means he is not happy with the state of things. I will try to see the situation from both sides. 1. The landlord believes your inability to work together as tenants may imply inability to peacefully work with him, hence he better do away with you people. Renovating the house will cost quite some amount which you people may be unable to bear so he has a better chance of refurbishing and put the cost on new tenants. Potentially increasing the house rent may not go well with you people so it is better he allows you to go then he can focus on what he wants for the house. Note: His stance is the way many of us here will react when faced with same problem; leave the emotional onslaught. I observed some people advised you to take the legal course; it won't be beneficial because he has by law given you the apportioned six months quit notice starting from January to the June you mentioned so don't try to go on that route. You can't win it; I will have advised mediation and arbitration center in Alausa, Ikeja but obviously, this matter has not gotten to that point. 2. From the perspective of a tenant, you seem to be a model tenant; from what you said, but unfortunately, you have been dealing with the caretaker, so your landlord doesn't know you. You feel you should not be slighted and treated like the other erring tenants but will you prefer that the landlord leaves the house in a state of dilapidation, while you people keep paying rent? You obviously love the house and will prefer to keep staying there. My one kobo advise is that you find your landlord's house, go and meet him man-to-man. Let him know that you like the house and still wish to be his tenant, you understand he needs to renovate the house but you don't have any plans for moving out now, appeal to his sense of reason; you may end up paying slightly more than you presently pay but it will beat paying for new rent outside, while you avoid the stress of looking for a new house and the challenges that come with moving; a win-win situation for both you and the landlord. Don't because of one small issue like a quit notice lose a potentially good relationship with your landlord; I pray that you become a landlord too one day and obviously you will understand things better. Now, this are the two major things that determine when and how the landlord may eject you out of his property... But from your post, I can see that you don't wish to pack out of the property... So I will advice you not to seek a legal way which might only buy you but in the end you will still leave the house for him but try reconciling with the landlord and give him reasons you should stay as a continuing tenant than him rather bringing in new people whom he doesn't even know... 1 Like |
