I understand your point. Personally, I wouldn't want him to go to jail, even if he's a rapist. I prefer he repents, confesses his faults, makes restitution and be forgiven. I know that will be impossible if he's convicted in court anyway. If he's found guilty and ends up in jail, so be it. Your third paragraph, or an electronic or taped recording of him or one of the alleged witnesses’ clear admittance is the only reason I can think of for this move, unless they are not planning to actually sue and just want the investigation results out in the open.
