What is age of consent in Nigeria? Is it 11 or is it 18??
Below are comments I read on a thread about how one ward chairman raped two girls, 12 and 13.

VirginFinder:
How does a man rape 2 girls at the same time

It is either the girls gave consent to have a three-some or he got an assistant to help in the rape.

Age of consent is 11, by the way.
..
Modified:
Yinusa Yellow abducted and impregnated 14-yr old Ese Oruru.

Is he in jail today

Modified again: Yinusa Yellow is currently in jail for abduction and rape. Ese Oruru never gave consent. The court determined in count 5 of the charges that she was old enough to give consent.

AthosEsq:
Age of consent is not 11 oga... That's an old and outdated law you are using.
Age of consent now is 18 years.
If you have sex with anyone under the age of 18, even if she was the one that seduced you, and you have it on tape, it doesn't matter... You have raped her. It's called statutory rape.

PoliteActivist:

Stop Spreading falsehood. This is old info. It is 18 not 13 and attracts life imprisonment

shaggy007:

No man, that was ammended.
It's 18 years now.

Omoslim26:

Don't mind dat muntula

PoliteActivist:

Oga stop saying what you don't know. Marriage is an exception for Muslims.
In 9ja sex with anyone under 18 outside marriage is RAPE!
Now u know. Meninmen, Fearlez, Mike008

VirginFinder:

You are the ignorant one here. The latest law in rape is the sexual offences bill of 2015 similar to one which formed the basis for the Supreme Court judgment I quoted. And it stylishly stipulated 11.
Laws are not amended on blogs or articles stating somebody's personal opinion.

Yinusa Yellow is currently in jail for abduction and rape. Ese Oruru never gave consent. The court determined in count 5 of the charges that she was old enough to give consent.

Now let's examine the charges:

The charges against Yunusa read: “That you, Yunusa Dahiru, a male, resident in Opolo-Eipie area of Yenagoa in Bayelsa State, conspired with the duo of Dankano Mohammed and Mallam Alhassan, between August 2015 and February 2016, to commit an offence of abduction and thereby committed offence punishable under section 27(a) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.”

Count two: “That you, Yunusa Dahiru, abducted Ese Oruru by means of coercion, transported and harboured her in Kano State and thereby committed an offence punishable under section 13(2)(b) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.”

Count three: “That you, Yunusa Dahiru induced Ese Oruru by the use of deception and coercion to go [/b]with you from Yenagoa to Kano State with the intent that she be forced or seduced into illicit intercourse and thereby committed an offence punishable under section 15(a) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.”

Count four:
“That you, Yunusa Dahiru, procured Ese Oruru and subjected her to sexual exploitation in Kano State and thereby committed an offence punishable under section 16(1) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.”

Count five: “That you, Yinusa Dahiru, had unlawful carnal knowledge of Ese Oruru without her consent and thereby committed an offence contrary to section 357 of the criminal code Act and punishable under section 358 of the Criminal code ACT, Cap. C.38 laws of the Federation of Nigeria, 2004.”

Read more at: https://www.vanguardngr.com/2020/05/ese-orurus-abductor-sentenced-to-26-years-in-prison/

From the charges above, you can see that Yinusa clearly committed rape as Ese Oruru was abducted, induced, deceived and coerced all the way.

She NEVER gave consent.

Count 5 clearly shows that she is old enough to give consent but never did.

I think each states set their own laws. In Lagos state it is 18, but a quick search online will show you 11 years is the Nigeria age of consent.

The age of consent is 18 in most western countries because that is the age a child is allowed to move out of her parents house, the age a child is allowed to graduate highschool, get into college, buy a cigarette, alcohol etc.

In Naija we have people going to university at 15 years old, finishing secondary school at 14, getting into the club without ID checks. The question is if I meet a girl in 200level in the uni in quilox, am I supposed to ask for her age before taking her home? If I don’t will that be considered rape?

if the girl tells you she is 400level student in university of Lagos with a valid student id card and you both went to knack somewhere.
if a police officer should flag you both down and it happens that the girls real age 17 years 9 months .
the police and her parents have legal standing to throw in jail ,you and you d.k. for a whole baggage of offences stating from 14 years to life imprisonment.

so the next time you enter a club ask for her birth certificate before story that touch!

Lol this isn’t true. The fact that she was in a club where only 18 year olds can go in is sufficient reason to believe she’s 18 and above. The club may be in trouble but not me. I don’t know whether you are being sarcastic with the birth certificate statement.

Defilement of Under-aged Girls: What is the Verdict of the Supreme Court of Nigeria?

Hon. Justice John Inyang Okoro, JSC
The above notable and profound pronouncement forms part of the ipsissima verba of my lord, the Hon. Justice Okoro, Justice of the Supreme Court of Nigeria when he delivered the leading Judgment on Friday, 30th January, 2015 in the case of BONIFACE ADONIKE v. THE STATE (2015) 7 N.W.L.R (pt 1458) 237 at 266 paragraphs B-D. The case of Boniface Adonike (Supra) once more brings to the fore the duty on sentencing authorities to show in the application of the law that society abhors cases of defilement of young girls. The law on defilement of under-aged girls in Nigeria is provided in Section 218 of the Criminal Code, Cap. 42, Laws of the Federation of Nigeria. The section provides that “any person who has unlawful carnal knowledge of a girl under the age of thirteen years is guilty of a felony, and is liable to imprisonment for life, with or without whipping”. Any person who attempts to have unlawful carnal knowledge of a girl under the age of thirteen years is guilty of a felony, and is liable to imprisonment for fourteen years, with or without whipping. A prosecution for either of the offences defined above in this section must be begun within two months after the offence is committed. A person cannot be convicted of either of the offences defined in this section upon the uncorroborated testimony of one witness.

the child's act 2003 states and puts the age of the child as defined by the Nigeria's 1999 constitution to be 18 years and below.
This supercedes and erases the child welfare act or decree of 1989 which the supreme court quoted to be 13 when the 1989 act says 12( but the act is no longer legal except in the four states that has not ratified the child act 2003) which the constitution permits.

what does this mean
it means in places like Lagos and 32 states if you are caught having intercourse with a lady who is a corper during her NYSC and it becomes a police case.
the police now found out that she is 17 years 10 months old.the police and her parents will charge you with sleeping with a child (rape) and ghagaun 21 years to life.
if now your lawyer present this judgement as case.this current will strike it out because.that 1989 act has been replaced with an act of 2003.

so when next you toast girl.ask for her birth certificate first

It's like you didn't check the date of that judgement I stated. Why didn't the Supreme Court judge base his judgement on the child rights act of 2003? Why did he go with the criminal code law of 2004 The judgment was delivered in 2015.

Among other reasons, it was clearly stated that she didn't give consent. I did not see 18 anywhere in the charge sheet.

Also, he was sentenced to 7 years on 3 out of the 5 counts. If the sentences were to run concurrently he will end up serving only 7 years for the heinous crime of abducting somebody's daughter and impregnating her!!! His lawyer was considering an appeal for the sentences to run concurrently.

Why do you keep saying 7years when it said clearly that the sentence was consecutive - 26 years he will serve not 7! The girl herself said she went willingly. He got 26 years ONLY because the mother said she did not give her consent. If the girl were say 23 he would have gone TOYALLY FREE

Pulse.ng is not our constitution. Pulse.ng is a blog. The article is purely the opinion of the writer.

Ageofconsent.net contains the list of countries and their respective/authentic age of consent based on their most recent laws. Go check it out.

It may be just a blog but in this particular instance they seem to know what they are talking about. How do u address the following:

**Are you relying on this judgement to peg the age of consent at 11 or you are relying on what the Constitution says? The child right act pegs the age of consent for sex at 18 years. The recent laws of 2004 and 2015 (whatever those laws says) doesn't invalidate the child rights act. The child rights act of 2003 is still a LAW in this country and that law says the age of consent for sex is 18 years.

**Count five: “That you, Yinusa Dahiru, had unlawful carnal knowledge of Ese Oruru without her consent and thereby committed an offence contrary to section 357 of the criminal code Act and punishable under section 358 of the Criminal code ACT, Cap. C.38 laws of the Federation of Nigeria, 2004.”

###Please how does this count 5 peg the age of consent for sex at 11 years? Are you saying the judgement of a judge overrides the letters of the Constitution?

The bolded didn't make the charge sheet. Below is the charge sheet:

From the charges above, you can see that Yinusa clearly committed rape as Ese Oruru was abducted, induced, deceived and coerced all the way.

She NEVER gave consent.

Count 5 clearly shows that she is old enough to give consent but never did.

This goes to buttress my point that the age of consent is 11 and not 18 as things stand currently.

It says clearly in the story that the girl readily admitted going willingly. It was her MOTHER’S CONSENT that was the problem. If she had admitted consenting the guy would have gone free instead of getting 26 years!

VirginFinder, how does your position tally with this

https://www.nairaland.com/5979519/impotent-arraigned-fingering-minor-osun

It says:
One Makinde Adeoye, 30, was arraigned before an Osogbo Magistrate Court , yesterday, for allegedly using his finger to sexually assaulted a minor.
....
Makinde was said to have indecently inserted his finger into the virgina of the minor, committing an offence punishable under section 360 of the state criminal law.

She didn't give consent. Otherwise, the man wouldn't have been caught.

Consent is the issue here.

Those are figments of your imagination.

Count 5 stated clearly that she did not give consent not her mother.

Previous counts stated the use of force, coercion in addition to abduction. No 14-year old will willingly elope with a much older man for the north.

The laws of 2004 and 2015 override the child rights act of 2003 which is why the courts are basing their judgments on them.

According to count 5, the Ese Oruru despite being 14 years old was said not to have given consent. If her consent did not matter, it would not have be stated expressly that she did not give consent.

Based on the sexual offences bill of 2015, the age of consent is now 11. The link below should enlighten you more.

Also, ageofconsent.net has the authentic age of consent of all countries in the world based on their most recent laws. Check it out and you will find that the age of consent in Nigeria is 11.

Yinusa's lawyers were talking about appealing the judgment to ask for the 4 sentences to run concurrently.

Punishment for rape should life imprisonment, isn't it So why was he sentenced to 7 years for each charge

@bolded is a figment of your imagination.

The court was able to establish that there was abduction, induction, deception, coercion and procurement all the way. The girl stood no chance of giving consent.

If the girl were 23, the sentences will still be the same.
