The term 'donor' from 'donation' means given for free.
If money exchanged hands, it is illegal in the UK.
The UK Embassy would also require more proof that David was a potential donor before issuing the visa. Ike Ekweremadu's letter, which the embassy have yet to confirm reciept of is not enough proof that David knew about the arrangement for his kidneys.

I feel sorry for his daughter but her life is no more precious than David's or any other Nigerian. Daughter is in the UK at the moment where she has access to regular dialysis which will help her kidney functions until a donor is found legally. This is a 1000x more than than the average Nigerian in Nigeria with the same medcal issues has access to because of her Father and other incompetent politican failure to provide such amenities in Nigeria

Did you see the letter written to the UK embassy by the sanator? In it he stated the purpose clearly while requesting for visa for the donor.
Furthermore if the UK law requires no financial inducement, where is the evidence the sanator paid or promised to pay the donor? I don't think any such has been proved.

1. Was the boy told he was going to the UK to donate a kidney?

2. If he was told, then why didn't they(Ekweremadu family) check if his kidneys will match in Nigeria before making all that expense?

3. If he was told and they later found out that his kidneys did not match, why not settle him off and let him go back to Nigeria with a signed agreement of confidentiality , at least to keep rumors off the media?

Even if he was paid the question of jurisdiction and validity of the contract would come up.

If he was paid then he must have been paid in Nigeria here... At least a part payment

- Is a contract brokered in Nigeria still binding on all parties while they are in the UK?

- Can such a contract, even though illegal under British law, be enforced in a Crown court?

- Does the court have the power to adjudicate on a contract which ab initio was null and void?

If the contract is declared null and void under English law or the court has no jurisdiction to adjudicate on the matter since it was brokered in another country then the Ekweremmadus are in the clear.

David lied about his age in order to renege on his own part of the deal and possibly get asylum. The birth date on his passport and National ID card are his undoing. If the date on both documents tally, then his assertion that he is 15 years old would be struck out.
