The Court of Appeal , Abuja Division has commenced hearing of six appeals filed against the judgment delivered by the Bayelsa Governorship election petition tribunal.

The tribunal had on 17th August nullified the election of Governor Douye Diri and his deputy, Lawrence Ewhrudjakpo on grounds that the Independent National Electoral Commission unlawfully excluded the Advanced National Democratic Party from the November 16, 2019 governorship election in the state.

The appeals before the court is filed by Governor Douye Diri, INEC, PDP, Ibinene Stephen, Owei Woniwei and Vijah Opuma

The Peoples Democratic Party (PDP) in Bayelsa State yesterday, in party primaries to elect former Governor Seriake Dickson and Cleapas Moses as it candidates for the Senatorial By-election slated for October 31st into the vacant West and Central Senatorial Districts of the state.

Delegates from both Senatorial districts defy the torrential rainfall to cast their votes in the primaries held in Sagbama and Yenagoa simultaneously.

Dickson, who had no contestant for the Bayelsa West ticket of the party however declined the automatic nomination and voted.

The Returning Officer, Barr Nicholas Obhiseh, returned Dickson as the validly nominated candidate having polled 334 out of 338 accredited delegates with four invalid votes.

The members of the PDP from the Sagbama and Ekeremor decided not to pick the party's nomination form as a mark of honour to the former Governor who enjoys unprecedented acceptability and popularity in the area.

Speaking shortly after his return as the PDP senatorial candidate, Chief Dickson commended the people for their unflinching dedication, loyalty, support and prayers throughout his eight years as governor and for finding him worthy of another serious mission....

Whether grassroot or not,the stronger party will win.the ruling party in a state usually wins the lg and assembly polls.right from 2015,apc performs poorly in assembly polls but does very well in other polls.
The same way the won bayelsa east is how they will take central.last year,festus lost narrowly to diri.now that they are stronger and are still nursing the loss of the guber seat,nobody will spare pdp.I don't need to tell you that sylva and Lyon will involve themselves

Let me correct you here. In the last election the people came together to support their son irrespective of their political parties. Secondly, the results were cooked because the people wanted their son to be governor. This time is different and don't even use that last election result to judge at all. There's no Dickson or douye diri here. Its a grassroot election grin

THE All Progressives Congress, APC in Bayelsa State has concluded its direct mode of primaries to fill in candidates for the West and Central Senatorial Districts of the state ahead of the October 31 senatorial by-elections in the state.
Gen. Abdulsalam Dahiru (retd), Chairman of the APC Primary Election Committee announced the results at the State party secretariat on Thursday, he affirmed that Rt Hon Peremobowei Ebebi, a former deputy governor scored 10, 633 votes, to defeat Captain Mathew Karimo his closest rival and two others to clinch the party’s ticket in the West Senatorial primary election.
While Abel Ebifemowei emerged the candidate of the party in the Central Senatorial District with a total number of 24, 734 votes to defeat five others who also aspired to represent the party in the district.

In their separate acceptance speeches, Rt. Hon. Ebebi and Hon. Ebifemowei thanked party faithful for coming out en mass to vote them to fly the party flag in the October, 31 Senatorial elections.
The duo urged other aspirants who contested with them to see the outcome as a brotherly contest, calling on them to join hands together to work towards the victory of the APC in the upcoming bye-elections.

The Court of Appeal sitting in Abuja yesterday dismissed the appeal filed by Hope Democratic Party challenging the judgment of Federal High Court which upheld the power of INEC to deregister the party.

Justices Bitrus Sanga, Lokulo Sodipe and Oniyangi in a unanimous decision adopted its judgment in NUP (National Unity Party) which is on fours with the case put forward by the Hope Democratic Party.
This latest Judgment has once again reaffirmed for a second time at the Appeal Court level INEC’s power to deregister the 74 parties.

This Judgment reinforces INEC position on the deregistration of the 74 parties and their decision to Appeal the conflicting Judgments from the same Appeal court in favour of 22 of the deregistered parties.

Will the court or INEC create a special rule to accommodate ANDP? It's still going to be the 30days window if the judgement is upheld. Judgement when specific can't be implied, meaning APC or any other party can't be assumed to be ineligible for a new election should that be the case.
A new election means a new timetable from INEC

For the ANDP to benefit from the judgement of the tribunal, the SC would have to affirm the tribunal ruling, if affirmed, there will be a substitution window which only ANDP can't benefit from, that is, even PDP might try not to present Diri whose candidature was the reason the initial election was lost.
I believe the topic is about APC being on the ballot should there be a new election according to the tribunal ruling, if the ruling should stand, APC will have another opportunity at the poll
APC is not benefiting from ANDP case that will not even stand. ANDP will be added to the election and not along with APC. As far Bayelsa is concerned, APC should prepare for 2023 governorship election.
A similar case like this happened in Anambra in 2015 senatorial election. There's nothing like fresh primaries, nominations and substitutions except by ANDP

The Supreme Court, on Tuesday, fixed August 31 to deliver judgments on two separate appeals that are seeking to nullify the election of Governor Yahaya Bello of Kogi State.

A seven-man panel of Justices of the apex court led by the Chief Justice of Nigeria, CJN, Justice Tanko Ibrahim, okayed the appeals for justice after all the parties adopted their final briefs of argument.

The appeals were brought before the apex court by the Peoples Democratic Party, PDP, and its governorship candidate in the state, Musa Wada, and the Social Democratic Party, SDP, and its candidate, Natasha Akpoti.

The appellants alleged that governor Bello of the All Progressives Congress, APC, was not validly elected by the majority of lawful votes cast.
They prayed the Supreme Court to set aside the concurrent judgments of both the Kogi State Governorship Elections Petitions Tribunal and the Court of Appeal in Abuja, which declined to void the return of governor Bello by the Independent National Electoral Commission, INEC, as a winner of the gubernatorial contest.

Cited as Respondents in both appeals were INEC, governor Bello, and the APC. Meanwhile, the CJN led panel, dismissed a third appeal that was brought against governor Bello by the Democratic People’s Party, DPP, after it was withdrawn by counsel to the party, Mr M.S. Ibrahim.
The panel stressed that the appeal was a “worthless academic exercise”, noting that the party fielded an underaged candidate that was 31 years old as at the time of the election.

It further awarded a cost of N200, 000 against the DPP. It will be recalled that the tribunal had in a two-to-one split decision on May 23, affirmed governor Bello’s election.

Whereas two Justices of the three-member panel tribunal, dismissed the petition by Wada and the PDP, a third member of the panel gave a dissenting judgment that upheld the petition and ordered a fresh election in Kogi State.

In their majority verdict, Chairman of the tribunal, Justice Kashim Kaigama and a member of the panel, Justice Baraka Wali, held that the petitioners failed to by way of credible evidence, substantiate their allegation that governor Bello’s election was not in substantial compliance with both the Constitution and the Electoral Act.

The duo equally agreed that the petitioners were unable to prove any ground of their petition to warrant the nullification of the outcome of the election.

However, in his dissenting judgment, Justice Ohimai Ovbiagele, upheld the petitioners’ case and nullified election results in seven out of the 21 Local Government Areas in the state.

Justice Ovbiagele went ahead and sacked governor Bello by declaring that he was not the winner of the governorship election, having failed to secure the majority of lawful votes and the required constitutional spread.

Meantime, in a unanimous judgment on July 4, the Court of Appeals in Abuja dismissed all the petitions and upheld the verdict of the tribunal that affirmed governor Bello’s election.

A five-man panel of the appellate court led by Justice Adamu Jauro held that the appeals that were lodged by both the PDP and SDP candidates lacked merit.


INEC had on November 18, declared Bello of the APC as the winner of the Kogi governorship election.
She ordered INEC to conduct a fresh election in seven local governments within three months.

The Returning Officer, Ibrahim Garba, who is the Vice-Chancellor of the Ahmadu Bello University, ABU, declared that Bello polled the highest number of votes in the election with 406,222 to defeat Wada of the PDP who scored 189,704 in the election.
