Ezeakanobi: The drama in Bayelsa State is not yet over. Barely few hours after he emerged as the new governor of Bayelsa State, Sen. Douye Diri faces another battle, which may threaten his mandate.
He has a new date with his arch-rival, Timi Alaibe, who has asked a Federal High Court to declare him as the validly nominated governorship candidate of the Peoples Democratic Party (PDP) in the state. Many in Diri’s camp have been begging Alaibe, a former Managing Director of the Niger Delta Development Commission (NDDC), to withdraw his case.
But loyalists of Alaibe said their confidence has been buoyed by the nullification of the victory of the APC candidate, David Lyon, by the Supreme Court. They said since Lyon’s fate was sealed as a result of a pre-election matter, the new governor at best may be a caretaker.
Alaibe’s camp is now banking on the Judiciary to restore the mandate of its candidate. They want Diri out.

The nation is still stunned by the Supreme Court judgement delivered on the November 2019 governorship elections held in Bayelsa. The five-member Supreme Court panel had invalidated the candidacy of the All Progressives Congress, APC, David Lyon and his running mate and ordered that the Independent National Electoral Commission, INEC, issue a fresh certificate of return to the candidate of the party with the next highest votes who meet the constitutional requirements. While the People's Democratic Party, PDP, and its candidate have rushed to the street and the media to celebrate, a close perusal of the election results of the actual elections last year shows that the candidate of the PDP, Duoye Diri, and his running mate also failed to meet the minimum constitutional requirements to be sworn-in as governor. This may mean that's it's too early to celebrate. The constitution is quite clear that to be declared winner of a governorship election, such candidate must have garnered at least 25% votes in at least two-thirds of the total number of local government areas of the state. Two-thirds means that for a candidate to be sworn-in, he must have garnered at least 25% votes in at least 66.7% of the total local governments in the state. The PDP candidate fell agonizingly short, at about 63 percent. Bayelsa is quite peculiar in this regard with only 8 LGAs, the winner of a governorship election must garner at least 25% of votes in at least six Local Government Areas, LGAs. This means that 25 percent votes in five out of eight LGAs that the PDP candidate got in this case is not enough to have him sworn-in. According to the constitution he needs 25 percent in six states. Even if sworn-in, a strict interpretation of the constitution will have him removed before long. This is surely going to bring up a constitutional crisis because you can be sure that APC and PDP are in for another round of anxious returns to the courtrooms. What apc needs now is to use one the parties to challenge election of Diri cos they have a good case.

A performance audit that was conducted by Office of the Auditor-General of the Federation has revealed that operators of the federal government-owned Integrated Payroll and Personnel Information System (IPPIS) still have access to the backend of the platform that gives them the leeway to manipulate the system at will.
Former auditor-general of the Federation, Mr Ukura Tyonongo said the good intention of government for introducing the integrated payroll system has been defeated (while government is unaware) by the operators. “The intention of government was good but the operators messed it up,” the immediate past AuGF said in an exclusive chart with our correspondent. According to the specialised audit, “some contractors from Soft Alliance Ltd have access to the database and the ability to set up new users and to change live data and could not easily be identified.”
IPPIS is a unified platform for payment of salaries and wages directly to Government employees’ bank accounts with appropriate deductions and remittances.
The report showed that application controls have not been activated in IPPIS to ensure, for example, that: Gross pay is input from salary and allowance tables, rather than the actual amounts being input directly; completeness checks are not activated to ensure that all necessary data has been entered, for example, bank account number, grade level and job title and duplicate checks to check, for example, that bank account numbers or employee numbers are not used by more than one payee.
Reasonableness checks are not activated so that an officer of age less than 18 years or more than 60 years can still be paid,” the report said. “User profiles are not adequately restricted, so for example, an officer in one MDA can amend the payroll date for other MDAs.

As a result of these deficiencies in the controls, the audit identified series of potential overpayments. In the first case, it discovered that nearly 300,000 payments totaling N330 million where the gross pay differed from approved salary scale, with double payments of nearly N30 million in September – December, 2011.
The audit report that was obtained from the website of the AuGF by our correspondent claimed that the password controls for access to IPPIS are not adequate. “This is important as access can be undertaken remotely via the internet.”
The findings of the AuGF audit showed that passwords do not expire after 90 days, so officers could use their password after leaving the service; some user names and passwords were shared by several users; users cannot necessarily be adequately identified as the user name is just “Consultant” or “Technical”; there is no restriction on the number of sign-on attempts and there is no minimum password length. “The audit trail for IPPIS has not been enabled. As a result, it is not always possible to trace which user made particular inputs or changes (for example fraudulent transactions cannot be traced to a particular user).
