Sounds like a civil issue not a criminal one but everything is backwards in 9ja. This is not about reacting nicely, this is about abuse of power and it can happen to anyone even YOU or your future generations.

The charges are bogus, the fact that she was arrested is another error and quite frankly I'm appalled that some of y'all can't see beyond the act itself and focus on the bigger picture of draconian justice but then again this is what I've come to expect of Nigerians, as long as the injustice does not directly affect y'all, it's all GOOD!

You can give bad review. Nobody is against that. There's fine-line between bad review and defamatory review. And as you should know by now, only the court can and will decide what is defamatory. Nobody else can.

Let the court decide. I'm not here to speculate, and I don't really care who wins either. What is important is either ways, companies and the consumer public will learn a thing or two from the whole saga.

Again read the charges, she was not charged with defamation but cyber bullying or whatever, that's ERROR #1!

Furthermore, we all know there's no way she'll get a fair trial, as she's a nobody and human rights activist lawyers are not that good.....The problem here is that absence of any law that protects the consumer in cases like this, the loser will 99% of the time be the CONSUMER!

I'm not vouching for anyone, I'm voucing for the ACT! It is consumer's right to be able to critique items or services they paid for! You cannot silence people all because you don't like their review.

Some decades back, everyone taught smoking was cool and fashionable, now we know better thanks to research and people voicing out on the dangerous effects of smoking.......If we went by your analysis, we would have questioned their motive rather than look at the product itself!

It's not so simple the way you deposit it up there. You have to now show the nexus with that particular product with empirical evidence, i.e any known case of death as a result of consuming that product.

Does everybody that takes sugar have diabetes? No

Was Sugar content stated on the tomato mix can? Yes

Did Chioma read the content before buying or even before reviewing? I doubt!

Was Chioma intended to buy "tomato paste or tomato mix" ?

.......So you can see the fact that Chioma doesn't need Sugar or indeed too much sugar doesn't mean everybody doesn't need it.

Do you know the sugar content in most of the fizzy/carbonated drinks is almost half of the bottle itself?


Again a consumer has the right to review the product or services consumed! This is non debatable! There's something called cause and effect, a product does not need to directly cause harm for it to be harmful.

Exhibit one:
Vegans accuse meat eaters of eating carcinogenic items aka red meat.

We have over 100 scholarly and well researched studies that shows red meat is carcinogenic.

We have thousands of people that die each year due to cancer from bad diet.

Are you saying as a meat company, you would sue such a vegan?

Exhibit two:

Climate change is real

A climate activist claims that deisel factory is polluting the air causing climate chnage which can result in people dying.

If you're the owner of that factory, will you arrest the activist even tho there are empirical evidence that confirms air pollution is having a disastrous effect on climate.

In summary, the charges does not correlate with the offense, it is hogwash and nonsenstical and can only succeed in a dystopian country like Nigeria!

There are many tomato mix out there in the market. If a particular one is not good for you, leave it and buy the one that is.

We can compare degrees and career achievement in order to know which one of us is a dumbo! Just like the warning smokers are liable to die young, it still does not change the fact that the product can cause you to kpai earlier than expected!

If you think a product might be unsafe, say so, and the company would defend its product. But to outrightly say the product is killing people, you would have to show the people that have died from consuming it.

There's a huge difference between Bad review and Defamation.

Again a product does not need to directly cause harm for it to be harmful......I've given you a simple narrative and it is the same argument vegans use, read more about it!

Does the tomato paste have more sugar than alternatives?
Does sugar cause diabetes?
Does diabetes kill people?
Has diabetes killed people in Nigeria?

This is exactly how impunity gets instituted. If you commit a crime, the police should get an arrest warrant from a judge, after they have proven to the judge that you are a person of interest.

If the police invites you, you have a right to know why you're being invited. And if you don't show up, the police has to go to a judge and obtain an arrest warrant. Arrest warrants are given when it's determined that the case is a crime, and the person who is about to be arrested is a person of interest.

In a civil case such as this, it is only a courts that can determine if this is truly defamation, and not the police.

You're wrong and don't know your right, yet you are the first to tell another person that he's wrong.

If the court has already determined the case to be defamation, then it is now a crime.

And before arresting, in this case, kidnapping the guy, the police should also go to his place, and invite him. The fact that they arrested him at his place in Abuja shows that they know his place and have access to him.

The police you're here defending smartly left out the details of the so called defamation. You're turning the law on its head for something that you're not even sure you won't be a victim of tomorrow.

Yea this just shows you know nothing about police code of conduct and the overall Nigerian Constitution. Can you state the part of the Nigerian law that specifically commands the need of a warrant before being invited for questioning?

The fact that they even invited him and gave him the option of coming in honorably is already a positive, under the old police code, they would have bundled him immediately the complaint was made.

Finally, it is not the police job to give you all the detail, it is for you to be conversant with the law and know that defamation suit requires active investigation and is punishable under law. Section 375 of the Criminal Code Act, any person who publishes any defamatory matter is guilty of a misdemeanor and is liable to imprisonment for one year; and any person who publishes any defamatory matter knowing it to be false, is liable to imprisonment for two years.

The court is not the investigvative body, it is the police that investigates.....I HOPE YOU UNDERSTAND THIS AND STOP THIS BASELESS ARGUMENT!

That aside, it is the job of the court to serve him. This is completely a matter that the courts should handle. The police is not the court or a judge.

The answer to your question what the police should have done is simply "NOTHING"

The police does not settle matters. Only the courts do. And it's the duty of the courts to judge the journalist and determine whether he is guilty or innocent.

You're simply wrong! Police have rights to investigate both civil and criminal matters. The case involved is a defamation suit and proper investigation must be done. If police invites you but you refuse to show then they have every right to arrest you as that is obstruction of justice. Defamation can be criminal if it results in imminent threat or loss to the accuser, it is even more imparative if the defamation was written and distributed online as that can be tied to the new cyber law.

There are over 10 different ways that the police could invoke probable cause in situations like this so it is best to comply. Even if you want to act stubborn, get a good lawyer and let him or her navigate the issue.
