Note there is a difference between freezing and seizing. In this case, freezng simply means you beleive the assets to be the proceeds of illegal actiivity and you are asking the court to prevent any movement or disposal of the asset till you can prove your case. There are international accords to facilitate the freezing and seizing of illegally obtained assets across international borders. Seizing occurs when you have proved your case.

We are already collaborating with the US Government to attach these assets. “In fact, the EFCC chairman, Mr. Ibrahim Magu, spent about one and a half weeks in the US to work with the relevant agencies to trace Diezani’s properties, some of which are believed to have been secured through business fronts like Kola Aluko. “We have submitted relevant documents to the US authorities in order to facilitate the seizure of the assets.” EFCC cannot seize without a court order and must be entered into the US legal system and must be accepted by a US judge. In fact, it's easier for US to initiate such cases by using existing laws to seize assets. In fact, US shall pursue a criminal case against thay minister if she has something to hide. US is a tough place to hide such huge assets!! |
