Are care workers employed directly by the NHS exempted from the no-dependent rule? Anyone with information about this? A friend told me this but I’m in doubt because there is no information about it on the home office website

NHS healthcare workers can still bring dependents.

Care Workers (SOC code 6145) and Senior Care Workers (SOC code 6146) can no longer bring dependents.

However, (SOC code 6141) covers NHS Nursing auxiliaries and assistants, Auxiliary nurse,
Health care assistant (hospital service), Health care support workers, Nursing assistant and Nursing auxiliary.

Or

Hello guys pls help 😓

I'm currently requesting for COS at the moment since last week. My agent said it might take till end of March before it comes out.

I intend to travel with my wife and kids as my dependants.

But the issue of cancelling Dependant visa by 11 of March is on my mind.

When I asked my agent he said since we already started the process before March 11 that it doesn't mean anything.

But my fear is that, if my COS comes out after March 11th, will my wife and kids still be able to go with me as dependants ?

Or does the March 11 deadline means that I can no longer have dependants since it comes out after March 11th ?

Or does it truly means that since we have started the COS process already, the March 11 deadline doesn't affect us ?

Hi,

What does started the process mean? You must submit your HCW visa application BEFORE the March 11 deadline and you will need your COS reference number for the visa application. I’m sure your agent knows this….

NB- the changes re dependents do not apply to NHS workers.

The kids and I never got that brp mail then we travelled on the 24th may and I have been checking with the post office after ten days of our arrival but the post office is yet to receive it. We are all dependants.

My candidate got her emails in the following order: 1st March - TLS collection email, 3rd March - BRP email and then passport courier 2 days later. From previous posts you’ll see that a number of people got the TLS collection email before the BRP email.

Is the IHS fee still required for a skill worker visa that is not a health-care worker visa?
I'm not sure if this is correct, but I've heard that the IHS fee applies only to student and settlement visas, while ALL skilled worker visas (Health and Non-Health) are currently exempt.Someone with the latest information should please confirm.

Work reference letter stating the start date of the job and how long she has been working there.

In the letter, her job roles was stated like experience personal care,medication administration,etc Google can help

And she already has the reference letter since January,it was one of the requirements before she was issued COS.

So the date on the reference letter showed January,not February that they requested for additional documents.

Qualification
Florence care training certificate she did since October 2022, it is valid for one year. She submitted about 20 CPD training in one pdf attachment.

She did not answer the question of recruitment verbally.

She submitted the letter of interview invitation on the care home company letter head.
The letter answers the questions too. It was sign by the company HR.

My dear, no need to stretch this any longer.
You're right with your own argument that IELTS for UKVI Academic is needed for professional registration; we're also right by trying to enlighten you that IELTS for UKVI both Academic and General are acceptable for the Skilled Worker visa/Healthcare visa, as long as it's IELTS for UKVI.
While IELTS for UKVI General is used solely for visa purposes, IELTS for UKVI Academic has the added advantage of being used for both visa purposes and acceptable by most, if not all, UK universities for undergraduate and postgraduate studies.
Since the first person said he needed advice on which IELTS test to take which s/he could use for either Skilled Worker visa or for studies, we are of the opinion that s/he may wish to take IELTS for UKVI Academic for both purposes.

No arguments over here. Just confirming that for some healthcare sectors that require professional registration, only UKVI Academic will suffice.

According to the link from gov.uk website I posted, it was NOT specified that only one of either Academic or General UKVI IELTS was acceptable for Health and Care Visa/Skilled Worker visa. Both are equally acceptable. The guideline on the British Council website is to guide those who intend to STUDY that only the Academic version will be accepted for their visa application.

However, if you have any other evidence that says otherwise, kindly share so we may be enlightened.

As I stated, some professional bodies require the Academic. The UK’s Nursing & Midwifery Council is an example and state this on their website.

It really depends on what you intend to do. For skilled worker (not Healthcare route) UKVI General will suffice (I’m a sponsor and my candidate did this test and I’m using an immigration lawyer to help me through this process). However, if you intend to go into healthcare that requires “professional registration” then some UK organisations may require UKVI Academic.

It’s 5 years (from UKVI guide for sponsors):

Period of grant
Successful applicants will be granted entry clearance or permission to stay for the period of employment stated on their CoS, up to a maximum period of 5 years, plus any time before the start date on the CoS and 14 days after the end date. You cannot assign a CoS for longer than 5 years. Applications can be made up to 3 months before the start date.

Settlement
Workers who have been continuously and lawfully resident in the UK on the Skilled Worker route (or other eligible route) for 5 years or more may apply to settle in the UK permanently (known as ‘settlement’ or ‘indefinite leave to remain’).

On 24/12/2021 UK Home Office announced addition of Care Workers to the UK Shortage Occupation List under Soc Code '6145 Care Workers and Home Carers'. As a result of this announcement, overseas migrant Care Workers are currently allowed to apply for Skilled Worker Health and Care visa during the one year counting from 15/02/2022.

The burning question that at present is asked by many is what next with the Care Workers after 15/02/2023. Unfortunately, Home Office is to still to provide their answer to this question, although due to the dire shortage of the local Care Workers in the UK, it is highly likely the Soc Code 6145 will remain on the Shortage Occupation List for the foreseeable future.

MAC'S APRIL 2022 REVIEW OF ADULT SOCIAL CARE

Migration Advisory Committee (MAC) in April 2022 published their Review of Adult Social Care in the UK. Migration Advisory Committee (MAC) is an independent public body sponsored by the Home Office and it advises the UK government on migration issues.

According to MAC's April 2022 Report, the UK social care sector faces additional challenges of growing demand and a restricted supply of care due to workforce shortages and budget constraints; problems exacerbated by the pandemic. MAC's projections, based on estimated future care need, suggest that the sector will need to recruit a further 236,000 FTEs over the next 11 years to keep up with growing care need.

MIGRATION ADVISORY COMMITTEE (MAC) RECOMMENDATIONS ON ADULT SOCIAL CARE HEALTH AND CARE VISA

Following review of the Adult Care Sector showing dire staff shortages, MAC provided their recommendations to Home Office. In our summary further below, we focus on those recommendations that are linked to Health and Care work visa.

MAC's recommendations:

We recommend that the Government introduces a fully funded minimum rate of pay for care workers in England that is above the National Living Wage, where care is being provided through public funds. As a minimum starting point, we would recommend a level of £10.50 per hour to be implemented immediately.

We recommend that workers in social care should be paid for the hours while at work, whether this is time spent travelling or sleeping. Whilst these hours are not being properly compensated, low paid workers are being underpaid for their time spent at work. Where care is being provided through public funds, those funds should increase to fully reflect the additional costs involved.

We recommend the removal of the Immigration Skills Charge (ISC) for all Health and Care Worker (H&CW) visas. More broadly, it would be useful to separately conduct a full review of the ISC across the entire Skilled Worker (SW) route, which was introduced some years ago and there have been substantial changes in immigration policy and its objectives since that time.

We recommend that the Government either conduct or commission research to identify administrative burdens for employers and workers that could be eliminated across the SW route.

On balance, we recommend maintaining the current salary threshold for the H&CW visa.
We maintain the recommendation that annual salary thresholds should not be prorated to allow for part-time work for migrants on the Health &Care visa.

We do not recommend any changes to English language requirements for migrants on the H&CW route.

We recommend that workers who spend the full five years working in nursing or care roles on the H&CW visa should either receive a complete settlement fee waiver or pay a lower fee, that is no higher than the unit cost of processing. The cost of this recommendation should not be passed on to other visa fees.

We recommend that there should be a review of all visa application fees more broadly to ensure that fees are affordable for people on middle and low incomes.

The MAC recommends that the decision to make care workers eligible for the H&CW visa should be made permanent, i.e., should not have an automatic sunset date.

We recommend that the Government keep care workers on the Shortage Occupation List (SOL) until the next SOL review is completed, when we will make a further recommendation.
The MAC would encourage DHSC and the DAs to work with local authorities to support the development of the market for individuals to work with a care agency to sponsor a specific care worker.

The Government could consider the introduction of a pilot umbrella scheme. Under the scheme, an umbrella body would be appointed to sponsor care workers from overseas and people who can show their level of need requires live-in care would be able to directly recruit from the umbrella body.

CONCLUSIONS ON THE MAC'S REPORT ON ADULT SOCIAL CARE

There are numerous publications on the staff shortages in UK adult care sector and on 15 December 2022, the House of Lords was scheduled to debate the staff issues in the NHS and social care sectors.

MAC has also been commissioned by the UK government in September 2022 to review Shortage Occupation List and this review is ongoing.

Care Workers and Home Carers (Soc Code 6145) are on the Shortage Occupation List since 15/02/2022 and are officially included in the List as a trial for a year only. However, In light of all the various reports, including the MAC's April 2022 review, Care Workers are likely to remain on the Shortage List for the foreseeable future. However, Home Office decision confirming this has not yet been announced.

1. Apply for jobs that are offering visa sponsorship. Look for care/residential homes, NHS jobs website, Indeed, Total jobs etc. Also, there is a list of organisations/companies on the Uk gov website with sponsorship licence.
2. Cos is issued by the employer, Cos reference number is required for the online visa application.
3. Advisable to do ILETS as it’s valid for 2 years.

My dear I was shocked when I saw the interview mail. Even when I got to TLS VI and told am here for an interview, the guys at gate were a little bit surprised. But I eventually did and it went well but after then I haven’t heard anything from them.

If you don’t mind sharing, which visa did you apply for skilled worker visa or health care visa? If skilled worker visa what job? Also, what questions did they ask you at the interview? Sorry for all the questions but I’m going through the process of sponsoring someone and want to prepare for all eventualities.
