The constitution simply requires that 2/3 of members must support the declaration. If 75 Senators attends the sitting out of 109 and 73 of them supported the declaration, then the requirement of the constitution has been duly met. No issues. Chief, it actually says 2/3 of all members of the Assembly. It is explicitly written. |

ediko5: it's a common occurrence in the Nigeria political space for a sitting governor to fight with his immediate past governor and benefactor. These fights are mostly due to power and political structure control between the current governor and his God father or sometimes due to high level of greed from the God father.
The fight between Governor Siminalayi Fubara and former Governor Nyesom Wike was shocking to many because unlike other former and current governors rift, theirs was too sudden because it started within 2 months after Fubara's inauguration. According to a politician friend close to the Rivers state government house the main foundation of Wike and Fubara's fight is the position of the house of assembly speaker.
According to their political arrangement, the position of the speaker was allocated to Edison Ehie the current chief of staff to the Governor but Wike changed the plan 48 hours to the house of assembly officials election and anointed Martins Amewhule as the speaker of the Rivers state house of assembly. To summarize the story, Edison Ehie felt betrayed and cheated by Wike formed a cartel to convince the Governor about the danger of Wike having control over the house of assembly.
They succeeded in recruiting the governor into their faction and their first action was to impeach the speaker Martins Amewhule but when their impeachment plot failed and the information got to Wike, he ordered that the Governor should be impeach for daring to impeach the speaker he anointed. Boom! that was where Sim vs Wike fight started.
How did Governor Fubara failed in displaying humility and patience ? Firstly I'm not a supporter of Wike or Godfatherism in politics but to succeed in this world you need humility, patience and some cases loyalty (in politics). Fubara was to quick to allow people to use him as a spearhead to wage war on Wike (mostly Wike's political enemies without any strong political structure). He allowed Wike's enemies to use him to fight Wike when he was yet to understand how politics works remember the governor have been a politician before, he has been a civil servant all through his life.
I'm i saying the governor shouldn't have fought Wike's Godfatherism ? NO but he should've endured Wike's insults for sometime while mastering the political game and building his own structure before he start opposing Wike's control. Imagine a sitting Governor only have 4 house of assembly members on his side out of 31, imagine a governor that couldn't have any LGA chairmen he met in office to his camp, imagine a governor where high profiled commissioners resigned from his cabinet - it shows the man is really an infant politician.
The people spearheading the governor to fight Wike are the ones benefiting from the fight ranging from political structure control, political appointment/contract, court litigation and others, there was a time Edison Ehie controlled the government house and will give top orders and approvals before the governor was even informed. According to an insider he approved and published the names of some LGA caretaker chairmen before the governor was informed and it almost caused serious issue between him and the governor but they managed it in house.
It would've been a better idea for the governor to learn the political game under Wike despite the insults he may receive and later use the experience along with other people to fight Wike and build his own structure than allowing different cartels and factions to give him directionless advice all for their personal interest. A wise post.
It is clear that people who were to weak to fight Wike themselves in the open used the governor to do so and now he is fighting a premature fight he never really needed to at the moment.
The funny thing is that people like Wike, who see themselves as giants, will eventually fall, there is no doubt about it, but the way I am looking at it, God has decided that Fubara will not be his David. |

Notice this picture is strategic and the governors portrait still remains visible on the wall, next to the president, for all to see.
This is why you get serious military men to do these kind of roles as I am sure if it had been our typical political appointee the first thing he would have done is cover the governors portrait and put his own.
Anyway, for those who will cry to high heaven, the governor was "suspended" and not "removed", and this picture helps to confirm that to an extent.

How it began (1 & 2) vs. how it ended (3 & 4) There is no u-turn being done, no where does he say the President, representing the FG, cannot suspend a governor under a state of Emergency.
But I do agree with him on his final analysis, Tinubu should have waited for the House of Assembly to approve before swearing in the Sole Administrator.
No sensible person has argued that this thing he is doing can work without the National Assembly's approval and it is now very likely he will fail to get it because of his haste and inability to carry everyone along in a complex country like this. |

Oscarchims: So the suspension of a democratically elected governor is in line with the constitution... Just tell me Its is in line with our history and the 1961 Emergency Powers Act and also in line with the law the National Assembly wanted to pass to replace it in 2018.
Also in this particular situation, where an active party causing the insecurity is the governor as identified by the Supreme Court judgement, it is in line with common sense. |

ElevationD: “In 2004 and 2006, we condemned the illegal dissolution of democratic structures when President Olusegun Obasanjo imposed emergency rules on Plateau State and Ekiti State, respectively. Regrettably, on both occasions, the Supreme Court refused to determine the constitutional validity of the dissolution of democratic structures on the ground that the suit were procedurally incompetent because they were instituted during the six-month emergency period by the suspended legislators in the name of Plateau State without the authorization of the Sole Administration of the state!
However, in 2013, when a state of emergency was declared in Adamawa, Borno and Yobe States by former Presidents Goodluck Jonathan, we urged him to reject the pressure mounted on by anti democratic forces to remove the elected Governors and dissolve democratic structures in the affected States. President Jonathan followed the path of constitutionalism.
In 2021, the then Attorney-General of the Federation and Minister of Justice, Mr. Abubakar Malami SAN announced the plan of the federal government to declare a state of emergency in Anambra State over insecurity and threat to a complete breakdown of law and order in that part of the Federation We advised President Buhari not to demolish democratic structures even if emergency rule was imposed on the state. President Buhari followed the path of constituionalism.
In the cases of Adegbenro vs. Attorney-General of the Federation (1962) 1 NLR 338 F.R.A. Williams V Dr. M.A. Majekodunmi (1962) 1 NLR 328 the Supreme Court of Nigeria validated the Emergency Powers Act 1961 to justify the dissolution of democratic structures as well as suspension of fundamental human rights in western region. As there is no equivalent of the Emergency Powers Act 1961 under the current constitutional dispensation, the suspension of an elected Governor by an elected President is a constitutional anomaly under the 1999 Constitution.
In Attorney General of the Federation v. Attorney General of Abia State & Ors (2024) LPELR-62576 (SC) filed by the Bola Tinubu administration, the Supreme Court of Nigeria held that the removal of elected chairmen and councilors as well as appointment of sole administrators or caretaker committees by State Governors to run local government councils are illegal and unconstitutional. It follows to reason that the suspension of elected governors and elected members of the House of Assembly by the President is illegal and unconstitutional in every material particular.
To that extent, a serving or retired military officer can not be imposed as a Sole Administrator to govern any state in Nigeria. Similarly, a military officer cannot be appointed by the National Assembly as a Sole Administrator to govern the Nigerian people during a war between Nigeria and another country.
In the Speaker, Bauchi State House of Assembly v Hon Rifkatu Danna (2017) 49 WRN 82 and several other cases, Nigerian Courts have held that the suspension of elected legislators is illegal and unconstitutional. Therefore, the National Assembly should not endorse the illegal suspension of the Rivers State legislators that have not defected from the People’s Democratic Party to the All Progressive Congress. Instead of approving the illegal dissolution of democratic structures in Rivers State, the National Assembly should assist Governor Fubara by invoking its powers under section 11 (4) of the Constitution “to make laws for the peace, order and good government of that State”
Therefore, we are compelled to call on President Bola Tinubu to follow the path of constituionalism without any delay. The President should proceed to reinstate the suspended Governor Fubara and Deputy Governor Odu and restore all democratic structures in Rivers State. This call is without prejudice to the duty imposed on the President to adopt extraordinary measures to restore law and order in Rivers State under Governor Fubara in strict compliance with the provisions of the 1999 Constitution of the Federal Republic of Nigeria, 1999 as amended”

All the cases he mentioned above where the Supreme court ruled that governors cannot appoint Sole administrators occured without constiutional state of emergencies being employed, already that is null and void. ( despite this, the same Fubara you people are defending commited the same sin). Falana as usual is adding 2+ 2 to get 22 and it is the same way he wrongly advised Fubara that there was no way the Martins and Co were legislators when they had openly told all of us that they had defected. As usual his garulousness was corrected when the Supreme court made it clear that no judge can declare a seat vacant without first allowing the rightful speaker to declare a seat vacant.
People make mistakes, but Falana is making too many and the quality of his advice has really depreciated ever since Buhari did not make him AGF (and I even supported Falana at that time, as I still rate him as a far better legal mind than that useless bail lawyer Malami).
That 1961 law stands until a court declares it unconstitutional or it is repealed by the National Assembly. I side with common biblical sense (there can't be 2 masters at the same time) and a more solid AGF Olujimi on this (OBJ's AGF at that time).

President GEJ did not suspend the governors because he took legal advice from his AGF Adoke, who will go down as one of the poorest and most corrupt AGFs we have ever had.
In Adoke's book, he states clearly that he was the only person in government who convinced GEJ not to suspend the governors because he felt the 1999 constitution did not support this and the law that Obasanjo's AGF based his own suspensions on was to old and unconstitutional.
One thing everyone must understand is only a court, not an AGF, not a Abati, not a Falana, not the NBA and not even a President can declare a law passed by any assembly in Nigeria of whatever year unconstitutional.

id911: Are you sure you're educated? I've read the Nigerian constitution several times from A to Z and nowhere does the President has power to suspend an elected officials.
Even the Supreme Court ruled that the President has no such powers due to previous case that was why President Jonathan couldn't suspend hose Governors in the North even when he declared SoE First of all, laws of the Federation are different from the constitution. All laws have to do is make sure they do not go against anything the constitution says for a law to be valid or accepted as constitutional.
Now more importantly, please tell us when the Supreme court ruled and said a president cannot suspend a governor when a State of Emergency is declared. Please we ask you provide us the exact scenario when this was determined and not hearsay or conjecture. |

Sheuns: The bill was not signed into law, therefore it’s not law. From a previous post The argument on whether Buhari actually signed this bill and if it is actually a law in Nigeria is actually interesting.
However, even if this bill was not signed by Buhari and the legislature did not do the necessary thing to make it law, the fact that this bill was made to repeal a previous Law in this country shows that the President can actually rely on the older law to suspend the Governor as long as the courts have not declared that older law unconstitutional.
