Politics › Re: Ministerial Screening: Fashola Indicts Himself Before The Senate by aresa: 8:05pm On Oct 14, 2015
TonyeBarcanista:
At the ministerial screening earlier today ex-Lagos state governor Raji Fashola was asked a direct question regarding the N78million appropriated for the building of personal website. Here was Fashola's response...

While we all agree that award of contract is an Institutional process, FASHOLA refused to tell the Senate that the process is only finalised when the relevant commissioner in charge of the affected ministry append his/her signature according to Section 30 of Lagos state public procurement law (2011) which Fashola signed into law... In fact subsection 5 was very clear...

30.— (1)   There is established by this Law in each of the State’s Ministry, Extra-ministerial Office/Department/Agency, Parastatal, Corporation, a Tenders’ Board.

(2)   Subject to the approval of the Board, the Agency shall from time to time prescribe the membership of the Tenders’ Board.

(3)   The Tenders’ Board shall have power to award and be responsible for the procurements of goods, works and services within the benchmark set in the Regulations to this Law.

(4)   In all cases where there is a need for pre-qualifications, the Chairman of the Tenders’ Board shall constitute a technical evaluation subcommittee of the Tenders’ Board charged with the responsibility for the evaluation of bids which shall be made up of professional staff of the procuring entity and the Secretary of the Tenders Board who shall also be the Chairman of the Evaluation subcommittee.

(5)   The decision of the Tenders’ Board shall be communicated to the Commissioner for implementation.
(EMPHASIS Mine)
http://www.lagosppa.gov.ng/ppa-law/tenders’-boards

Fashola Indicts Himself:
From the section (SPECIFICALLY subsection 5) it is expressly clear that the Fashola's administration through the affected Commissioner 'okayed' the contract to be awarded at that RIDICULOUS amount. We should also note that Commissioners are not elected but appointed by Governors and they report to Governors. That means the affected Commissioner must have reported the said contract to then Governor Fashola while reporting the activities of his ministry to his boss.

Looking at the defence that Fashola put up and placing it side by side with procedure, two things can be deduced;

1. Fashola was aware of the whole thing but deliberately LIED before the Senate to cover his track. He was fully aware of the deal. OR

2. Fashola was not aware thereby making him complacent of his duties as governor of Lagos state. If this is true (which is doubtful), then we beg to ask how many more inflated contracts went undetected by the Governor? This second is a statement of incompetence.

Both 1 and 2 are indicting if we look at them from any angle..

The 'I Never Signed Chequ' Holds No Water
The Fashola's 'I never signed cheque' statement is untenable anywhere. No Governor or Presidents signs cheque for the award of contract in Nigeria. There are Accountants that effect payment. What is required of the political officers is to APPROVE contracts for the Accountants to issue cheques. So why should Fashola use that as defence?

It is however unfortunate that the Senate FAILED to ask relevant question but instead nod their heads in ignorance. It is very shameful that the same Nigerians that called for the head of Princess Stella Oduah over the N260million vehicle were singing Fashola's praise for the shabby defence that he put up.

May God Bless Us All God Bless Nigeria
@ Op the Disgraced and discredited ignorant can't read and comprehend protection seeker.

Please when you are done with your latest idiocy and foolery, show us where Fashola or the commissioner signed any checks and last time the world checked, signing checks and the rubbish you posted are 2 different things..

Many of the nuisance wailers on NL post better half baked than you so you are a lousy and sub par wailer...

absolute nonsense! There is no way a contract of that sum is awarded without his knowkedge, this things are discussed at the state executive council level, who signs the cheque is a technicality
Your internet opinion of course.

So what if it was discussed at council meeting? The state as explained by the governor has a system in place per who sets prices and who signs checks so what's the governor's business with all that?

That's for the legislature to question and deal with if need be so send your concern to the state legislature for them to order inquiry or panel to probe the issue..

You misplaced your concern based on your own poor knowledge per state institutions, responsibilities and oversight authority..

I assume you are educated and schooled? The purpose of an education is to train the brain to think and analyse, that why sometime companies advertise for graduates in any discipline because they assume if you have undergone a degree programme you have learnt analytical skills.....sadly this is not the case in Nigeria of late.
Meaningless and irrelevant platitudes. Please stay on topic..

So I advise you to read again my post but to help you, he was asked why he paid certain sums for certain projects, the inference being that those sums were far above the norm. The implication being that if you are paying well above the norm, you are either not a good custodian of public finances (i.e contractors are cheateing you) or you are in bed with the contactors considering our environment. no one accused him of embezzling, all that was asked was that he explain, He was given a chance to explain and he evaded it.
Is GEJ responsible or is he going to jail for acts committed by the agency directors and ministers he appointed and supervised?

Is GEJ under probe for Diazani's transgressions?

The state legislature approves spending and not the state governor. They are the lawmakers with statutory responsibility to question spending and expenditures and if something seems out of the ordinary, they have the constitutional power and oversight authority to call the Science and Tech commissioner to explain himself and his spendings..

Oversight and spending authority lies with the legislature and not the Executive...

This is the problem with our country, Africa Magic and religion has dulled our senses. Did I say he embezzled? I may have my views but I did not say he embezzled, I said he evaded the question as to why he spent N70m on a website and N300m on a borehole by saying he doesn't sign cheques. I don't sign cheques doesn't answer the question put before him. what is so special about a website that you spend N70m, what is so special about a borehole that you spend N300m.

Let's take away sentiments and start to engage our brains, I am a yoruba and an APC supporter but Fashola got away with this one.
The highlighted means nothing or has any bearing on thoughts and views..

The man saying he didn't sign checks was him saying he had nothing to do with the process and the institutions charged to do such things took care of it.

Obviously after the fact, the folks in charge are free to scrutinize f probe the folks if necessary?

Is GEJ responsible or is he going to jail for acts committed by the agency directors and ministers he appointed and supervised?

You are not making any sense.

The man lectured you about responsibilities, governance and institutions so take the lesson and thank him for it..

Then why compare his statements with other folks you asserted embezzled?

I'm amazed at those who can't see through fashola. His eloquence seems to dazzle some people. He is a lawyer and as a good lawyer he dazzled and evaded the question put before him. What kind of excuse is I don't sign cheques? Do you have to sign cheques to embezzle money? Did GEJ sign Cheques? Did Abacha sign cheques? Did Diazani sign cheques? The question was is it true you spent amounts in excess of the going rate for Websites and boreholes? As the smart lawyer that he is, he evaded the question and bamboozled most of you. if under your watch as a chief executive inflated amounts are spent on procuring items you are either culpable or incompetent. The importance of the question put before him is if under your watch N70m was spent on a website, how do we know you will get value for us as a minister and not approve inflated contracts but sadly we missed an opportunity.

Please dont be dazzled, lagos has money to spend more than any other state but in many areas considering value for money, lagos actually does qquite badly, the quality of roads they build for instance. I was in Ibadan and I was amazed at the quality of the roads built by Ajimobi, same in Abeokuta. If I were a senator I would have asked of fashola; if you are made minister for works can we expect that you will build better roads than the lekki express way which has no foresight by not having flyovers and is already riddled with potholes and all the other roads that keep failing? Secondly considering the hapharzaed nature of development/ lack of town planning, indiscriminate licensing of business premises with total disregard to impact on traffic/town planning in lagos, what makes you the right person for that ministry?

For me Kemi adeosun and Kachikwu were the stars!
....after all your meaningless rant, you are still yet to precisely explain to us how he embezzled website money. Exactly how and while you are it, was the money discovered in his account?

You need to attend more seminars, listen to more public speakers and stop these 'hypes.'

How can a man of 52 years find it difficult to answer simple questions pertaining to his area of specialization, his state & experience? What baffles me is some of you attended universities where some 30-something year old Lecturers tutor you all on difficult subjects.

Please remind me again, what has Fashola said that Senator Ben Bruce can't discuss even better? What has Madam Aminat said that Senator Stella Oduah won't discuss even better? Have your nominees said anything Maupe Ogun of Channels TV won't discuss even better? Who among them can transform this nation better than "Sam Adeyemi", a public speaker if the criteria were to be comportment, statistical and business intelligence?

If you must school anyone, beg your nominees to tutor your PRESIDENT who's apparently clueless of certain and key sectors of the Nigerian business.

I also saw some hypocrites insulting the Northern senator who couldn't speak well in the senate, meanwhile these same set of people were among those who installed Muhammadu Buhari, same man we barely hear whenever he talks.

Fashola is a smart man, he would have demanded for public release of more details of the contract if it would help the case.
Where were you when he demanded full disclosure and even challenged the people making the allegations to meet him in court instead of yelling on newspapers and the internet.

And have they responded to his challenge? No. They've all shut their mouth and moved on..

Fashola dis-associating himself with / from the process of the state? Who is giving the final approvals for the process and contracts?

Are there any competitive bidding for the contracts?

Is Fashola now saying their is institutional corruption in Lagos?

However, congrats Minister Fashola.
Institutions are constitutionally charged to perform these functions as asserted by the governor. He did not right any checks to himself and he did not enrich himself and he rightfully challenged people like you to prove him wrong. Finding out who the check was written to a known and in whose account the money landed is not rocket science or hard to find out .

Saying the state spent too much on anything is one thing, and saying the former governor enriched himself is another thing.

You have serious reading and comprehension issues.

Making Over Lagos

By Alex PerryThursday, May 26, 2011

Fashola is not your usual politician. Rather than barging his way across town with sirens blaring and lights flashing like other Nigerian leaders, he chooses to endure Lagos' traffic with his fellow citizens. Also, Fashola reads economic theory for fun. On his bedside table: books by development economists who see potential in poverty, people like the late C.K. Prahalad of the University of Michigan or Hernando de Soto of the Institute for Liberty and Democracy (ILD) in Lima. They argue that the poor may lack money as individuals but together, in their tens of millions, they represent a massive untapped resource.

A recent building should always be better than the former. The Akwa ibom state house of assembly was built by the governor before Akpabio. Trust me if Akpabio was the one who built it, it would ve been uncomparable. But it's not a competition anyways, allocation differs hence one should expert more.
Hence relativity when it comes to what this and that governor is able to do with available resources.

I can bet my life that with akpabio's available resources given to Fayemi means Ekiti very close to looking like Dubai.

Akpabio did not build 1 single hospital in 8 years while Fayemi built a new 300 bed hospital.

Akpabio presided over the richest state and largest state budget in Nigeria came up with just a few roads, flyover, 1 library, 1 cinema and 1 football field.

No new schools

No new hospitals

No new clinics or health centers

No water works

No skills centers

Nothing.

Imagine less than 4 yeye projects after 8 years in office and wasted largest budgets in nigeria.

Lagos state with 20 million people and smaller budgets delivered hundreds of projects and even practically commissioned projects everyday.

Amaechi built hundreds of the best schools in Nigeria

He built new hospitals, roads, bridges, water works and so on. He even delivered more projects than that entire region combined many times over.

Money is not everything, it's the mentality of the person spending the money and what they are able to do with the money..

Btw, the richest state in Nigeria should have a better looking assembly than that absurdity..

This is more about PMB wanting Fashola by any means necessary, regardless Tinubu's wants or choices.

Fashola was the first and only Nigerian PMB personally visited, consulted and pleaded with to help and support his presidential bid and they've been inseparable.

We know how PMB feels about money and corruption, but he picked Fashola to be his campaign finance director and they've been inseparable since.

Something led him to Fashola from the get go so what Tinubu want or prefer is totally out of the question and totally irrelevant..
