Politics › Re: Buhari Eligibility Suit Withdrawn. 22/04/2015 by aresa: 4:18pm On Apr 22, 2015
In Chapter VIII, Part VI of the 1999 Constitution, Section 318 (1) gave a lucid interpretation to what the constitution meant by “School Certificate or its equivalent” thus:

“School Certificate or its equivalent” means-

(a) a Secondary School Certificate or its equivalent, or Grade II Teacher’s Certificate, the City and Guilds Certificate; or

(b) education up to Secondary School Certificate level; or

(c) Primary Six School Leaving Certificate or its equivalent and -

(i) service in the public or private sector in the Federation in any capacity acceptable to the Independent National Electoral Commission for a minimum of ten years, and

(ii) attendance at courses and training in such institutions as may be acceptable to the Independent National Electoral Commission for periods totaling up to a minimum of one year, and

(iii) the ability to read, write, understand and communicate in the English Language to the satisfaction of the Independent National Electoral Commission; and

(d) any other qualification acceptable by the Independent National Electoral Commission.”

In essence, constitutionally, a presidential contestant is eligible even if the only educational qualification he/she possesses is a mere “Primary Six School Leaving Certificate” or “the ability to read, write, understand and communicate in the English Language” or “service in the public or private sector in the Federation in any capacity acceptable to INEC for a minimum of ten years” or “attendance at courses and training in such institutions as may be acceptable to the INEC for periods totaling up to a minimum of one year.”

This is the present position of the law. Nigerians are however free to propose its amendment if there is a general believe that we need to increase qualification standard for would be presidential aspirants in Nigeria.
Based on the highlighted alone, of what relevance was certificate when ability to read and write alone guarantees your candidacy?

What about years in public service? Buhari gave us decades of public service right?

It's just sad how the PDP keep using the same regional spoilers and willing tools to distract and destabilise the country. The same set of people were used to form the fake APC....smh..

You just need to wonder the kind of people we have in this part of he world, from the onset, the buharist have always kicked against anyone asking buhari to speak up on this issue or have him provide the original certificate just to clear the air.

They resort to some senseless rant about buhari rising to become a general, attending war college and all nonsense.

If i use a fake certificate to gain admission into the university, the fact that i completed the programme without the school noticing this suddenly makes my forged certificate, the admission and degree i later obtain valid.

Smh
1. The case wasn't going anywhere to start with regarding his qualification and ability to contest the last election simply because there was no such unitary certificate requirement. You can not sue and win any case against GMB since he didn't violate any election laws and INEC also stated that he did not violate any election laws so exactly what are you suing for?

2. There are countless requirements including ability to read and write, 10 years of public service and so on so of what relevance was certificate?

That was a shameful and pathetic fools errand that wasn't going anywhere.

To all those Pessimists/PDP supporters wishing/praying for Buhari to fail you should know that "Impossible means nothing to a very focused man". There was a time when State Governments couldn't generate up to 10million IGR for the whole year (Lagos inclusive) until some right thinking and smart people did the right things.

I saw a report in the papers and on TV last week that Lagos State IGR is now in the region of 23 BILLION (TWENTY THREE BILLION!!) MONTHLY.

Now whoever thought Lagos could generate such huge sums? The money has been there all along but it wasn't properly harnessed.

We all keep labeling Nigeria as a Potential Super Power -Economic wise but despite this potentials, we haven't amounted to anything because of lack of political will of those in government.

I believe Buhari will do well.
I believe it will not be business as usual for those running the country down economically.
I believe some you praying for the down fall of the incoming Government will be alive to see the greatness of these great nation.
I believe the Poster and some of the "PDP never see anything good in buhari" people will soon eat their words and run away with their tails between their legs in shame as the man Buhari puts this country on the path of greatness again.

Just my 2 cents.
Very well said.

PLEASE TAKE TIME TO READ

This thread is in response to the Thread by Obiagelli's https://www.nairaland.com/2265908/buharis-social-program-very-possible. In her bid to defend the Social policy of Mr Buhari, Obiagelli insulted the intelligence of Nigerians with respect to what is accrued to the Federal Government in revenue per fiscal year. Let us start by putting things in order...

Nigeria's Revenue:
Nigeria's revenue is accrued through oil export, non oil export, oil tax and non oil tax. The Federal Inland Revenue Service is statutory responsible for the collection of both oil profit tax and non oil tax. The money for oil export goes directly to the Federation Account via the NNPC. The money generated via non oil export goes directly to the federation account through relevant Agencies.

Oil Revenue:
The total sum realised through Oil export(after operational cost) and oil profit tax is known as "Oil Revenue"

Non Oil Revenue
While the sum realised through export of other commodities(after operational cost) and the money realised from non oil profit tax is called "Non Oil Revenue".

What Did Nigeria Earn Between January 2014 and January 2015?
Nigeria Total Earning:

Jan 2014 - June 2014 = N5.109trn

June 2014 - Jan 2015= N3.676trn

Total: N8.785trn

Total Oil Revenue (Oil Export Earning + Oil taxes)
= 70% of Total Revenue ie N6.15trn

*Total Non Oil Revenue (Non Oil Export + Non oil taxes)
= 30% of N8.785trn ie N2.635 trn

Jan 2014- June 2014 = N1.08trn*
July 2014 - Jan 2015= N1.556trn [N2.635trn]

Understanding FIRS 2014 Report:
FIRS announced that the sum of N4.69trn was generated in 2014. The report indicated that N2.45 trillion, representing 52.96 per cent, was collected from petroleum profit tax while N2.24 trillion, representing 47.04 per cent, was collected from non-oil taxes during the period.
Analysis
This sum(N4.69trn) is not independent of the published N8.785trn that Nigeria was said to earn between Jan 2014 and January 2014. It is a part and parcel of the total revenue.

How Much Did FG Get In 2014?
There is a consolidated Sharing formula between FG, States, LGs and Oil Producin States(13%) after operational and other associated cost has been deducted.
FG Earnings In 2014
1st Qtr: N912 billion
2nd Qtr: N864.2 billion
3rd Qtr: N924.68 billon
4th Qtr: N617.186 billion
Total 2014= N3.318trn

2014 Budget: N4.6trn
FG Projected Earning for 2014= N3.73tr
Real Earning = N3.318trn
Deficit in 2014 Fiscal Year: N1.282trn

What this means is that the money accrued to the FG was not even enough to fund 2014 budget. We had a deficit of N1.282trn.
Also note that the fall in oil price affected our earning.

Looking At 2015 Budget:
The 2015 budget(as adjusted) stand at N4.3trn.
Projected Revenue For 2015= N3.603trn
Deficit: N1.297trn (N4.3trn - N3.603trn)

This means the 2015 budget will be run on deficit of N1.297trn (as confirmed by the Senate).

Looking At Buhari's Proposal
With Buhari's proposed N1.89tr Social program, it invariably means an additional N1.89trn will be added to the projected deficit of N1.29 trn ie N3.187trn if he is to go ahead with paying of N5000 to 25 million unemployed annually, from where will he be able to make up the HUGE deficit?.

Analysing The Argument of The Pro-Buharis
Some Pro-Buharis claim that the project will be done in phase of 5m people per year. However, the problem of "How to identify these 5m beneficiaries" and what will be the for selection?
Anyway, that is for another day. Let's go by their argument...
Unemployment benefit: 5m * N5000 = N300 billion.

*The N300b is for the payment benefit alone*. Add that to logistics, overhead and operational cost that the program will incur (approx 50% ie N150billion) annually.

Total: N300b + N150b = N450b

Feeding for 40m Public School Children = N373 billion.

Subtotal: N823 billion.

Where Will Buhari Source For the estimated N823 billion?

- Remove Subsidy? Total package for petrol and kerosene subsidies plus SURE-P fund = N166.5b. That is clearly not up to 30%.

- Invest All Capital Expenditure + Subsidy? This will be a very silly move though. But adding Capital Expenditure and Subsidy will total N866.9 billion. Just a little above the projected N823billion.
Going this route means there will be no project for road, no infrastructure and other capital projects. In fact, it is synonymous to eating the present away.

- Will He Borrow? Borrowing to fund Social Welfare program is synonymous to eating away the future. That means indebting our future and a panacea to economic collapse likened to what happened to Greece if not worse. It also means increasing our already projected deficit of N1.29 trillion

What is the fate of this Social program? Feasible, Laudable or Laughable?
[/s]

Cutting the cost of government means sacking thousands of civil servants, there is no two ways about that. Reducing fraudulent business acts, is best imagined in this country. We refuse to restructure, so we are paying the price for inefficiency. Any form of Tax increase MUST AND WILL BE VIGOROUS OPPOSED. You will not tax hard working regions to fund loads of lazy poor people. Increasing any form of tax must be done at the state level.

Let APC take the same revenue as is today and perform their miracle, they promised Nigeria before the election.
Cutting cost means saving billions we pay out in form of fraudulent estacodes and other official looting schemes. Governors, agency directors, ministers and even the presidency organizes jamborees for themselves and their personally hired cronies specifically to pocket estacodes. Many government officials make almost same like their official salaries in one year off estacodes alone.

Cutting cost means instead of flying to Abuja with tons of aids and collecting estacodes for officials engagements including security council meetings, let them do it via video conferencing.

All the ministries practically seek conferences to jamboree to every month just to loot and collect estacodes. Cut out unnecessary travelings to attend irrelvant conferences.

Cut out embassies in places like Mali budgeting for railway and boats that doesn't exist

Cut out foreign ministries budgeting millions for fuel and generators in countries where they have uninterrupted power supply.

Cut out ministries and SGF offices looting billions every year by replacing thousands of computers and overcharging for 2 dollar softwares. Computers shouldn't be replaced every year unless absolutely necessary..

Cut out re furnishing, rebuilding and reflowering VP's, speaker of the house's and the senate president's residence every year.

Cut out ministries and agencies hiring consultants/ cronies with billions just for the consultants to send the money back into their pockets to do everything instead of government officials within the ministry sitting on their assess doing nothing..

Hiring consultants is the new and most profitable looting scheme in Nigeria today.

This is why the government spends 90% of the yearly budget maintaining themselves while Nigerians scrambles for the remaining 10% that they still loot anyway.

This is the reason why they can not spend anything on any project or program to better the people, the money is just not there.

Nearly everything GEJ awarded was done with loans from china from billions of dollars to on kpangolo railway to repainting airport, power plant, $500 million abuja cctv toy scam and so on.

We still have subsidy scam, oil theft, revenue diversion, unaccounted fees collected by federal agencies and parastatals and so on..

No, they don't have to lay off any civil servant to save billions and even trillions....

I would be quite callous to expect them to deliver on all those. Those were actually written and graphicalized by good copywriters who had very vivid and idealistic sense of imagination.

I have always praised the PR and Media arm of APC, I hope they come up with some form of abracadabra to turn off to an appreciable level, the level of expectations Nigerians have bestowed on the incoming government.

My heart goes out to Buhari, who might not be able to handle these pressures and when they start pouring in, really I fear for his health.

Why has Osinbajo gone silent?

Why are there more news filtering in on Jonathan's loss and his campaign funds. Could this be a propaganda to quell the masses demand for 5k and free meals with the excuse that Jona finished all our money on elections (which might as well be a lie)?

Why is Buhari so party conscious, this is the same path Jona took (trying to placate everyone) and lost popularity with most of the populace.

The social media painted to me, an image of a man who is ruthless, who takes no prisoners....having read his recent interview, I must say this, I am not impressed, I have to point out though, that he made some statements that showed his selflessness and will to do the Nation good.....I hope his willpower sustains that.
