Why are you wasting your time with this crowd? Memo to Ambode (and 35 Others) No 2: Avoiding An IGR Decimation

On behalf of yourself and your 35 colleagues in the other states of Nigeria, please accept the sincerest thanks from me and all other salary earning Nigerians who were seeking ways to reduce our Tax burdens for providing us with a very convenient, effective and lawful way to avoid as much of our Taxes as we care. I am not a greedy, anti good governance individual so I have sparingly used your very kind gift to reduce my Pay As You Earn (PAYE) Tax burden by a mere ~50% per annum. What is a couple of million naira between friends after all? And we are friends seeing as we are both Chartered Accountants who understand how these things work. I have other friends however who aren’t as ‘obsessed’ with good governance as I am and some of them are relieving themselves of more than 90% of the PAYE burden. I repeat that you and your fellow governors handed this convenient, effective and lawful avoidance loophole to my friends and me so we are neither criminals nor are we people you should be angry with since you chose to hand us this early Christmas 2014 gift 12 months ago.

In July 2014 the Pension Reform Act, 2014 was published in a gazette without much fanfare even though it would have had massive press coverage in almost any other country. Indeed its very mooting would have caused uproar in most countries with extensive debates and the state governments, that were about to be fleeced, fighting it with every weapon at their disposal. In Nigeria, with eyes fixed on and yet blinded by our sweet light crude, no one took notice of a few changes to the boring pension law. After all, what has pension got to do with the price of gari. Yet pension industry players, who presumably lobbied this amendment through the legislative process, had tucked away, in a few innocuous sounding clauses, the ultimate poison pill for already impoverished state governments. They had subtly changed the existing constraints on withdrawal of additional voluntary pension contributions (AVC) and essentially turned them into a way of transmuting Taxable income into practically Tax free income in mere days. Under the old dispensation any AVC, over and above the minimums stipulated by law, would only be free of Tax if it is untouched for at least five years. Drawing from your AVC within the five year lockout period would result in the Tax earlier avoided being applied.

This old provision automatically limited the extent to which AVCs could be used for Tax planning (avoidance if you like) as very few salary earners could afford to lock up significant parts of their income for five years just to gain a Tax advantage. Indeed, up to when the Pension Act was upgraded in 2014, AVC was exploited almost exclusively by (married) ladies. Please don’t ask me why. Under the new law however Tax is suffered not on the AVC cashed within five years but on the income earned by that AVC i.e. if I decide to contribute N1,000,000 monthly into my AVC account and go to my Pension Fund Administrator (PFA) the first week of each succeeding month to withdraw the full N1,000,000 I would indeed avoid paying the marginal Tax rate of 21% on the N1,000,000 thus pocketing N210,000 but would only pay 21% Tax on the income earned by the N1m for the few days it was managed by the PFA. If we presume the PFA earned N10,000 on my N1,000,000 within those days I would be paying 21% of N10,000 which is N2,100 and thus enjoy a net Tax savings of N207,900 simply by passing (laundering?) my salary through a PFA.

This has proved a very popular change indeed with all the men who didn’t dare to touch AVC with a 10 foot pole under the old regime now plowing as much of their salaries as they can spare for a few days into it. Of course the ladies too have upped their game. [b]Tax payers are happy with their suddenly much lighter Tax burdens and PFAs are smiling to the bank since some of that additional cash flow does stick in their vaults [/b]but the state governments, whose predominant Internally Generated Revenue (IGR) stream is being decimated, are still asleep at the wheel despite the much reduced flow of federal allocations that should have ordinarily turned them into Tax hawks.

It beggars belief that Nigeria had 36 state governors and a Federal Capital Territory minister on duty when this updated law was proposed. Each of the 37 had someone in charge of Finance / Revenue, all had Tax departments while several contracted Tax consultants in addition yet none thought it necessary to examine the law while it was still a mere proposal. Of course most of the current office holders were not in place 12 months ago but even those new in office have had two months to look at the books and some should have noticed an ebb in PAYE inflow. I know that knowledge of this game changing law has spread slowly with bankers the first to exploit it but it is now spreading like wildfire through other affluent sectors of the economy with the potential to half PAYE inflow by the end of 2015.

I have succeeded in reducing my Tax payment by ~50% but know of others who have aimed for and achieved a 90%+ reduction. I do not intend to treat my AVC as an overnight account because I see value in building up the funds over time into a significant amount for undertaking capital projects but many are pushing the envelope and fully exploiting the latitude the law provides by simply going to collect the AVC diverted from the Tax net from the PFAs a few days after payday. Most of those involved in this lawful gaming of the Tax system via AVC are the 20% paying 80% of the Taxes so the impact of typically 50%+ reduction in their Taxes is likely to be a 40%+ reduction in the largest IGR stream for states. States that currently bring in piffling amounts as IGR need not lose much sleep but those like Lagos, Rivers, Kano etc that depend substantially on IGR are going to get hammered. We are going to face a perverse situation where the strong and virile states will be rendered weak while the traditionally weak will suffer little ill effect.

To compound matters for Lagos and others, this IGR wipeout is coming at a time when federal allocations have already declined massively. This law must not be allowed to stand. State governments must come together to urgently move for a reversal to the status quo ante on AVC: a five year lockout period which when broken triggers the payment of full Taxes avoided on the capital contributed. This is essentially the threshold for ‘life insurance’ policies that enjoy similar Tax benefits. If Nigeria is serious about building up its pension reserves and providing long term funding for capital projects then it cannot afford to allow additional voluntary pension contributions and the pension system as a whole to be used as a convenient and legal money laundering vehicle. It is expected that those who lobbied for the insertion of this fiscal poison pill in the pension law will not be easily vanquished but the state governments must realize the existential nature of this threat and make its elimination the utmost priority.

Overall Taxes in Nigeria as a fraction of GDP are at single digit percentages since the Gross Domestic Product was rebased. This is well below the 20% minimum recommended by ECOWAS for its members and achieved by Ghana, Cape Verde and most well organized societies. Many other changes must be made to VAT, property and vehicular Taxes etc if we are to ever achieve the robust and diverse revenue base that will allow governments at all levels to withstand oil shocks better and provide the quantum of resources needed to translate our society from stagnation and poverty to growth and riches. After we have chased the foxes out of the barn this time we must set up a surveillance system to ensure that such laws that are antithetical to public welfare are never passed again. The lobbyists have tasted blood and, even if they are defeated this time, they will come back for more. Eternal vigilance is the price of liberty and an economically thriving democracy.

Suspected homosexual rapist shot dead in riot

A suspected homosexual rapist, identified only as Alhaji Tunji, and a landlord’s son, Ganiyu Adebayo, were shot dead in a riot which enveloped Temidire, in the Alagbado area of Lagos State on Monday.

PUNCH Metro learnt that the unrest, which started at about 11am after the landlords had ended a community meeting, resulted in sporadic shootings and fighting allegedly between Tunji’s thugs and youths in the area. The two persons were said to have been killed in the incident.

Our correspondent had exclusively reported on Thursday, June 16, that about 25 landlords stormed the premises of the Lagos State Police Command on Wednesday to report Tunji. They accused him of being a suspected land grabber and a homosexual rapist.

The complainants, who were led by the Baale, Alhaji Najimu Abioye, submitted a petition to the Commissioner of Police, Fatai Owoseni, saying that the residents’ lives were in danger.

Tunji had, however, refuted the allegations levelled against him, adding that the Baale was a usurper.

On Monday, our correspondent learnt that after the landlords had concluded their meeting, Tunji allegedly stormed the area with his thugs, who shot sporadically during which two persons at the meeting were injured.

One of the landlords at the meeting, who spoke on condition of anonymity, said while Adebayo died on the way to a hospital, the other victim survived and was being treated at the hospital.

He said, “We had barely ended the meeting, when these hoodlums arrived and shot at the people. The other man was hit in the arm, but Adebayo was hit in a critical area. He was bleeding profusely. He died while we were rushing him to a hospital. We have a police report from Alagbado.”

PUNCH Metro learnt that aggrieved youths in the area, who learnt of Adebayo’s death, organised a protest. Alhaji Tunji was said to have been shot dead during the unrest.

“He is dead. He was shot dead during the crisis. It is unfortunate. We do not know who was responsible for it. He will be buried tomorrow at his residence on AIT Road. His thugs had taken over the road in anger at the moment,” one of the landlords, who spoke on condition of anonymity, said.

Our correspondent learnt that policemen from the Alagbado division tried in vain to curtail the crisis as the hoodlums kept increasing in number and disturbed vehicular movements on the AIT Road.

Landlords and shop owners were said to have locked up their apartments, as the hoodlums threatened to avenge Tunji’s death.

The Lagos State Police Public Relations Officer, DSP Kenneth Nwosu, confirmed Tunji’s death. He added that another resident was injured during the riot.

He said, “Residents of the area were protesting against the activities of land grabbers during which Tunji was attacked and injured. He was rushed to a hospital where he later died.

“One other person was injured in the riot. Investigations are ongoing on the matter.”

Similar story almost 20 years ago in an IOC. This was a London course and both husband and wife were staff. Hubby took wife along and after the course wifey insisted they should stay on for some more days at company expense. On getting back to naija excess cost was charged to hubby's salary account but madam asked him to protest which he did. While he was still looking for trouble with his petitions the company went through a retrenchment exercise and his manager made him top of his hit list. Na so bros go home while madam continued in the IOC. I just checked her in teh email system and she is still going strong meanwhile last time I heard about bros he was selling GNLD. Madam was also going abroad every year since then but she never took bros along.

I hope the love blinded young men are taking these examples to heart. If madam retires today she would be talking almost N1m per month pension + about N100m gratuity / severance. Doubt very much if GNLD pays that kind of money.

Hence, credit should be given to Buhari. on the other hand, y should we applaud GEJ for not stealing the funds. Even armed robbers that raids banks, loose some pieces of their stolen-money in the process. This newspaper deserves a Nobel for misrepresenting what Babs said. He made it clear that, as a company regulated under CAMA, NLNG's tax for the 2014 operations wasn't due until June 2015 and so, in paying in June, NLNG hadn't willfully denied GEJ of revenue. This is hardly what the headline here says.

BTW the paper fails to report that GEJ pressured NLNG to pay the tax and its dividend ahead of May 29 but this pressure was rebuffed by patriots within NLNG who knew just how quickly the money would disappear into thin air as all the other NLNG payments in the last decade+ had disappeared under Pindipi.

How much are the best paid teachers, generals, doctors, civil servants, policemen etc paid in Nigeria relative to these entertainment moths? With the reward system so upside time we shouldn't expect a miracle (#change) any time soon in our society. Society always had comedians, minstrels etc that performed for kings and the public but they were never at the top of the reward system unlike now. In the 60s you would pray that your kids would become doctors, lawyers etc but today many parents are beginning to pray for footballer, video vixen etc kids. We all can imagine just how far this distorted value system will take us. The next time you are having a baby pls call the comedian and when your daughter doesn't understand maths get an OAP to teach her. angry angry

Pls note I speak as someone who often pays seven figure TAX in a month so this isn't envy but sorrowing over the distractions that hold us captive.

Looking at the decision logically the SE is actually the best place for BH convicts as they would have no influence among xtian, Igbo prisoners and couldn't easily arrange either internal or external jail break. Indeed they might very well be at mortal risk from fellow prisoners the way a child rapist would be in a US prison. Kindly remove your ethno religious blinkers and assess the issue rationally. Lagos—Governor Akinwunmi Ambode of Lagos State, yesterday visited major traffic points in Apapa area of the state to get a first hand experience of the gridlock which has defied solutions in recent times, just as he appealed to the Federal Government to mobilise the contractor awarded the construction of Apapa road networks to immediately return to site.

Ambode, who was accompanied on the tour by top officials of the state government and security agencies, said he was particularly disturbed about the traffic commuters and motorists are condemned to on a daily basis, which he said was largely due to the indiscriminate parking of articulated trucks attempting to access the port and tank farms located within the axis.

“What we have done in the last three hours is trying to find out what are the issues that partain to Apapa. We’ve all seen that the gridlock in Apapa is multi-faceted. We have examined things that relate to activities of trailer and tanker drivers”, the governor said in a statement signed by his Chief Press Secretary, Habib Aruna.

Alluding to the fact that the network of roads in Apapa belongs to the Federal Government, he lamented that the Tin Can Bridge, which has been under construction for about six years was abandoned, which makes tankers park indiscriminately on the road.

“It is totally unacceptable that we would be having tankers and trailers on our bridges. It is also not acceptable that they would decide to block all lanes that lead to Apapa. We’ve also seen that we must do something immediately to alleviate the challenges that the residents and business owners are facing.

“But again, you’ll also realise that the roads that lead to Apapa Wharf and Tincan Island actually belong to the Federal Government. We’ve come to this Tin Can Bridge, it has been under construction in the last six years, we’ve also seen a trailer park that can actually contain about 500 trailers at a time that has been abandoned by the Federal Government.

“What we want to do now is firstly to appeal to the Federal Government and most especially Mr. President that the contractor working on this particular bridge should come back to site and once we are able to open the trailer park, we would be able to allow other trailer and tankers to use the park.

The governor also expressed concerns about the activities at the 57 tank farms in the area, saying they constitute great security challenge for the state government, adding that owners of the farms will be summoned for a meeting soon.

“The greater part of this challenge is posed by the tank farm owners. As we speak we have 57 tank farms around Apapa alone, that’s a major security challenge for the state government.

“We have to start to look at the security issues relating to these tank farms. All trailers across the country come to these tank farms and the tank farm owners, we are going to direct them in the next few days, they would be summoned to a meeting and they have to tell us what their remedy is to this menace that we are having in Apapa.

As a palliative measure towards ensuring free flow of traffic, Governor Ambode said a task force would be immediately set up to ensure 24 hours surveillance of traffic flow while stressing that the Lagos Road Traffic Law will be enforced to the letter.

“Right now on our part, the immediate palliative is that we will set up a task force that would involve most of our security agencies including the police and to do a 24/7 monitoring of the traffic.

“We would pay more attention to enforcement. From this evening you would see that there would be more attention on enforcement and we would also fund that enforcement which we will fund. We are going to give incentives to our law enforcement officers to ensure that the Lagos Traffic Law is obeyed.

The governor also assured that road networks in deplorable state in Apapa will also be given attention.

Governor Ambode, who also visited traffic points in Ajah Roundabout assured that a joint task force will be immediately deployed to ensure free flow of traffic.

“We’ve all agreed, we need a flyover here, but we can’t deliver a flyover until maybe about 12 to 18 months.


In his remarks, Lagos State Commissioner of Police, Kayode Aderanti, observed that the Apapa road network and the activities of tanker drivers call for great security concern, expressing optimism that with improved road network, there will be little room for hoodlums to perpetrate crime.

“What we have observed in the last one year is due to the road network, the resultant effect is that most of these trailers always collapse and when this happens, you see a lot of hoodlums coming around to steal most of the items meant to be shipped to different parts of the country.

Commodore Ikoli, Commander, NNS Beecroft, Apapa Naval Base said, “For us in NNS Beecroft, the enforcement we are running under OP MESA, we are supporting the state government and the police in ensuring security within Apapa Area. Under that same apparatus, you would agree with me that we have also been present in ensuring the traffic gridlock in Apapa, we try to ensure that everybody that moves into Apapa has free flow of traffic. But, we are going to increase our efforts to ensure that every Nigerian that comes into Apapa has a safe and secure environment to work in.”

Bolaji Dada, Executive Secretary, Apapa Local Government also added, “We had a stakeholders meeting few days ago where we came up with resolutions on how to fix this menace. One of the resolutions was to visit the Governor and we have him here already. He has seen it and has first hand information and I’m sure from now, sanity will be brought back to our roads.”

21-day ultimatum to tricycle, okada riders

Meanwhile, the Lagos State government has issued a 21 day ultimatum to motorcyclists and tricycle operators in the state.

The state government made this known during a meeting with the unions in Lagos at the Secretariat, Alausa, Ikeja.

The state government said the move was imperative on the need for their members to vacate the restricted roads.

Secretary to the State Government, SSG, Mr. Tunji Bello explained the 21-day ultimatum was for the unions to sensitize their members to vacate the restricted routes before the enforcement commences.

Bello said “We have held a meeting with the okada unions on what should be done; we have held meeting with security agencies before now. Recently, we noticed a resurgence of okada riders going back to their old ways.”

He also lamented that “some of them even drive one way on Apapa Expressway. When you go to Apapa, Lagos-Badagry Express, Gbagada, and others, you will see them. We have to call them to let them know.

“The complaint was that when the election was coming, there was relaxation and they went back. They thought there had been relaxation. They asked us to give them sometimes. We felt there was need for two weeks of enlightenment, but they said it was too short. They asked for. Two months till August and we say no, we can only give three weeks maximum because we are not doing anything new, what we are doing is to reinforce the law, it is not that we are re-enacting the law,” Bello added.

Bello noted that when the law was introduced in. 2012, okada accidents dropped, as many hospitals felt the relief, saying that Igbobi and LUTH no longer have lots of patients.
