Kukutenla: Why will a court discount subpoenaed witness Are such witnesses not more credible
I will just advise the three litigants to stay away from the bvas reports.
INEC will bring another report to contradict that one and they'll be back to square one.
Better they inspect the BVAS and submit the report from there The emboldened is exactly what the parties wanted the INEC to do. Let them do the BVAS-inspection.. INEC is blatantly refusing the court order for the direct inspection of the BVAS-machines.. Therefore, the parties are submitting both the BVAS-Server-Reports and the IREV-Accreditation Report. In this situation,, INEC will have no option than to agree to the court order that mandated them to do the inspection. Otherwise,, the submitted reports would be used as evidence. As for the Subpoenaed witnesses,, the Electoral-Act was so silent about that. So, the counsels relied on “Court Processes”.. But the Judges ruled that Election Litigation is different from normal court process, and relies on the Electoral Act. So, since the Electoral-Act didn't say anything about Subpoena, there is no need introducing it under any guise |

Kukutenla: Hmmm. Are you sure that's how they see it. I hope it's the case o That was what happened in Osun. Now,, no other parties had presented BVAS-Reports since after that (as far as I am aware), apart from Enugu’s LP Candidate in the governorship election. But in Enugu’s Case,, the judges said that it was a subpoenaed witness who brought the document,, and they overruled the documents,, and didn't even look at it in the first place. (They ruled that subpoenas are not acceptable,, including the NYSC subpoenaed witness too) So, now that the BVAS reports are going to be filed together with the petitions in the three states,, let's see how it is going to turn out.. |

valentineuwakwe: Becos na osita chidoka na him make the request....if it's a common man that made such request, will INEC has responded ? Since they responded to him....... That's all that matters for now. Osita Chidoka had done his possible best for democracy at the moment.. And we will recognize his works and efforts at the right time in the future.. But for now, there is more work to be done for democracy... |
Politics › Re: INEC Released The BVAS Reports Of Bayelsa, Kogi, And Imo To Osita Chidoka by BluntCrazeMan(op): 9:10pm On Dec 01, 2023 |
Kukutenla: So what happened in Osun? There were about 3 CTCs of BVAS reports. All were trashed. BVAS machine was never tendered if i recall correctly There were two BVAS Server Reports,, and one BVAS Direct-Inspection Report... The BVAS Inspection Report was used because it was regarded as the “Most Authentic” of all the reports, being that it was generated by the direct inspection of the BVAS Machines.. That didn't really mean that the BVAS Reports were irrelevant.. But since a superior evidence existed,, then it supercedes the rest of all the other evidence. |

Kukutenla: That is the exact problem. We can never tell. It shouldn't be so with court judgements most especially based on an Act that's as straight-foward as the present EA Once a case can be “successfully” proven with any evidence provided,, whether it is seventhiary evidence,, so far there is no other superior evidence to counter it,, it still holds. (At least,, that's what the Evidence-Act says) |

IRev is just a viewing portal - SC
BVAS Server report is secondary evidence and not admissible - SC
That's what is publicly known but you can never say Ok. We can never tell. Once a case can be “successfully” proven with any evidence provided,, whether it is seventhiary evidence,, so far there is no other superior evidence to counter it,, it still holds. (That's what the Evidence Act says) |

The question here is,, if there is no BVAS Inspection at-all,,, but there is BVAS Server Report, and there is IREV Accreditation data report,, what would the judges pass as their judgement?? |

Nigeria judiciary should see the result of the principles being set in electoral jurisprudence by them that you have to file all written statements on oath of subpoenaed witnesses along with petition.
Thugs have effectively put a spinner in the wheel of forensic examinations. They know that whatever evidence petitioners get after the date allowed to file petition will not be useful as the Tribunal will bind itself with this unjust principle that put road blocks to justice.
So Nigerian Judiciary by the principles they set seems to have enabled politicians to engage in the state of nature where the mighty is right. Rig elections and prevent the right to access the evidence by use of armed thugs and terrorism and then you are good to go. The rights to approach Tribunal for remedies have been effectively rendered useless. Terrible anomie.
We are in for terrible times in Nigeria democracy. What we see in Kogi is not normal. I hope our judiciary will take judicial notice of this shengenen and do the needful. We cannot pretend that all is well in our democracy. How can we continue like this. Is Kogi State law onto itself. What is the Federal Government doing. People are living in bondage and fear in Kogi. He didn't even vote on the day of election. PDP messed by giving him ticket. Guy left the National Presidential Collation Center in 2019.. He couldn't collect the Final Collation Sheet. So, he doesn't even have any grounds for contesting, because he doesn't even have the original collated results. He came back and repeated same thing in 2023.. He left the venue. And couldn't collect the final collation sheet. Now... Kogi... He absconded again. And he is calling for a boycott. Boycotting of election had never helped anybody in the past. Kukutenla:
We can only hope But I'm assuming they had no qualms about releasing these records to Osita because they know it lacks any probative value in the court of law and in their own assessments. It's just like offering someone a dud cheque to look good in public They hope to come to the court and use words to convince the judge that the evidence has no probative value due to past cases.. (There is every indication that the judges might not accept their arguments alone,, unless they produce BVAS Inspection Report) And they are Not preparing to do BVAS Inspection.. Well.. Let's watch and see if they will tamper with the original values inside the BVAS machines,, and pretend to do a fake BVAS Inspection.. (Because that's the only option left for them. The IREV Accreditation Data and this currently released data coincided very well..) |
