See, It was Justice Ogbuagu [JSC] who held thus:-

"It is settled that the fact that an Appellant has wonderful, substantial, impressive and arguable grounds of appeal is not a special circumstance for granting a stay. In other words, it is not every case where grounds of appeal raise point or points of law that Stay of Execution will be granted."

Meaning that if Ikpeazu thinks he will get a stay on monday as temporary relief then he should think again.

You have done justice to this topic but let me add a little. Concerning lkpeazu stay of execution: the judge would deny him by ruling him " out of order." This is because INEC has already taken action by giving Ogah Certificate of Return; so their appeal for stay is inconsequential. Ikpeazi' s council knows this that is why they prayed Justice OK on Abang to set his entire judgement aside which the judge denied them. It's only the appellate court that can save the ex Governor.

Sorry my brother, you are the ignorant one here. Nobody could deny Ikpeazu the right of appeal. It's only appellate courts can fault a judgements of trial courts not you and supporters like you. In cases like criminal the decision of trial courts subsists and the victors reap the fruits of their labour while the others go to appellate court. When you apply for "stay of execution," it does not amount to stay unless the judge approves it. Anyway things would be clearer to you in days to come.

What are Appeal and Supreme Courts for if a Common High Court can give orders without option of appeal to quash the High court orders before the orders are implemented?

If that's the case, any High Court can hide some where and order that the president vacate his seat, name Kwankwaso, the runner up to Buhari last APC primary, to take over with immediate effect.
Kwankwaso becomes president, uses government money to buy the judiciary and remains president till the four years the case goes on in court.

Abia people. Be careful. They want to use another means to render your state useless for another four years.

it is easier to file the stay in the same court that gave the order. In that you are sure the application will be heard. If you go to appellate court they may reject and decade to hear the main suit.

Before we forget I think FIRS should accompany EFCC on all investigations of property and businesses. It will be in order for FIRS to check or ask for tax clearance or payment receipts of the proceeds if verified as legit money.Another question is: did he declear the properties with the CCB?

Which part of your constitution says that? Is it your made in Aba constitution? Every half baked lawyer can lay hold of his imagination of law to prove the substance of a mirage. For the up tenth time: a notice of appeal doesn't mean automatic stay. Uche Ogah is governor elect by virtue of lnec's certificate of return and Ikpeazu can only regain that seat through the process of appeal.

And besides that, a state high court cannot give an injunction on a federal body in Abula. They don't have such jurisdiction. If the chief judge of Abia refuses to swear the new governor in, NJC will raise panel of judges to do that and would punish him accordingly. The action of INEC today has removed Okezie officially as a governor and hence no immunity for him. This case is a test run to the removal of Ago Fayose by FG.

We all know what Buhari is trying to do is best for Nigeria but I'm afraid the task is too herculean for him. If he should spend his entire first term recovering stolen loot and prosecuting corrupt leaders then the economy will suffer greatly due to inability to multitask. Buhari with his good intentions might end up looking like a failure in the eyes of the public if he does not tone the recovery effort down and start implementing concrete economic policies. I'm afraid 2019 is fast approaching and some greedy politician is just waiting at the opportunity to use the economy against him in the election.

sincerely, inec is right, it's not an electoral tribunal case, that would have been delayed by a 21days window grace. it's a FHC ruling, except there is a stay of execution, the execution is always with immediate effect, the only exception I think, it's capital punishment, any other ruling is with immediate effect, so appeal of the ruling have no consequence on the judgement except a stay of execution order is chosen.
in respect to ikpeazu not leaving the sit, I hope it never turns to that, he might be arrested, though there might be crisis, but as it stands, the law doesn't recognize him, so he lacks immunity for now, but na Nigeria we dey sha, make we all sit down and watch the series.
You couldn't have said it better. Besides the judgment came on Monday; INEC waited till Thursday to issue the certificate. So nobody would accuse them of been in hurry. It's now clear that lkpeazu could not get an order to stay the execution of the judgement.

This is not unbelievable as the court gave a clear directive on the matter. Ikpeazu has the right to appeal the judgment but he is also to obey the subsisting order if at the end of the day his appeal is adjudicated and he wins he will come back. The high court judge gave succinct unambiguous ruling on the matter.
Besides this case is criminal and not civil in nature. Any ruling by trial court subsists while the appeal goes on. INEC can't be foolish to give certificate of return with their retinue of lawyers. Have you asked why the case was going on inspite the immunity that of Governor.

My friend this is a criminal case and not civil. The order will subsist first before any appeal from the governor. The mistake the judge made was not pronouncing any punishment for the offence.

Saraki has no case to answer, he was not a senator yet as at the time the new rule was done, he was still a senator elect, because the 7th assembly was dissolves by Sen David mark.

Saraki's council might be able to fight off the forgery charge but not the conspiracy charge. Anyboby who benefited in the forgery in the eye of the law is believed to have conspired with the forgers. See it this way, that one helped a thief to hide stolen goods.

Where is it written in their rule book that "convention and practice" could be used to replace any rule? It could have work if the used it without physically re writing some rules.
