Thanks. I do have a huge concern thou. Even when you are in school, you need to keep up with your immigration status. Being in school is one thing, being legal and keeping your immigration requirements is other. Whoever tells you that it does not matter is not saying the truth. In their minds you have over stayed your immigration requirements. Yes you can even proof that you ' ve been in school all these why, but you will be asked why did you not renew your visa status. AKO1: This is a common misconception. It applies in a lot of other countries but not in the US.
For a US work visa, the company needs to prove that they'll pay you in a range suitable to the position and comparable to what they would pay an American.
They do this through the Labour Condition Application, or LCA, which would also affirm that current workers would not be adversely affected by the employment of a foreigner - that's different from saying you couldn't find an American.
In almost all instances, companies can find Americans; there are only a few jobs in the world that are so specialized that not one in 300 million+ Americans won't be able to do. In fact, the whole H-1B visa system has been criticized for many years and for many reasons, including that it displaces skilled Americans especially in tech. @ttmacoy, you are not wrong still. Both of you are right. @AKO1, you are completely right in your statement. However, what ttmacoy wrote is still part of the disposition of that bill even when it is not followed all the way. Today, Dec 30 2015 after spending the holidays with our family in Montreal my wife and step children were denied reentry into the United States because I was honest that my children were enrolled in school in New Jersey. We are in the process our I 430, I 864, and ds-260 visa completions. Our petition has been approved and we are awaiting final interview. We have gone in and out of the country several times the last few months and always been forthcoming about our pending visa status. However today the CBP denied my family entry for the simple fact that I stated that my children go to high school in New Jersey now.
Please note that we have custody of our children, I am a US citizen, and despite that they are Canadians living in the US our employers and source of income are also Canadian. My wife files taxes here and I file my 1099 annually. Meaning that to our knowledge we are not breaking any labor laws. Im a US citizen paying taxes which cover the associated costs of my childrens schooling. Additionally we are legally married in both countries and therefore have filed the I430 transfer Alien Relative visa application. Therefore they are technically still tourists going in and out of the country within the allowable time frame.
I am going to the US consulate in Montreal tomorrow on an emergency basis to get my family back in the country but need any and all advice as to how I can accomplish this successfully.
Thanks They are still considered as visitors in united states hence their migrant petition is not finalized. Yes with their canadian status they are allowed into u.s for 180 days within a year. That they go back and fort within their time visa allows them does not mean they can't be stoped if they find something. Remember they are not suppose to leave in the u.s but they do have visiting rights as canadian. I only see you finish the pending application and have them come in as residence. The denier is flaged already, you just need to finish up the process. Good Luck |

I mean, I just married my soul mate and we were traveling to a tourist destination. Unknown to me, they gave me a FAKE VISA while my wife's visa was okay. The reason(s) is/are best know to them.
What I went through can not be imagined. The worst part is that they knew but chose not to tell me. According to them, they were working on it. I got the embarrassment of my life. I was treated worse than a rag.

There is a similar case of twins now ,one has a criminal record while the second doesn't ,the papers of the innocent was used to the convict twin and the innocent twin wishes to travel now.but she cant .the embassy has said nothing again so far Please follow the thread very well. ebeekay: I got an email today from their intelligence team,someone in home office forwarded the email to the team and a guy working in the British Embassy messaged me telling me to send details of my mom's name age, birth certificate and address of impersonator if I know it so the case can be taken up he even sent me a phone number .so am guessing there is progress on the way Wounderfull, good progress. U need to follow up with a phone call to the number given. Issues like this normally has standard process but could twick a little country to country. In u.s, you report to DHS attention to ICE and police fraud department and copy to consulate office in nigeria. An auto reference is generated for you and you use that for any future contacts. Go to police.uk there are list of numbers, for callers outside the u.k. Follow the proms in that website, you can see how to report fraud crime. Follow it duly.
As mentioned by justwise, you can use one stone kill two beds. As you are dealing with the u.k police, you can still be applying for her passport. Remember they will not issue her any passport up on till the case is over and dealt with.

Why don't you try the canadian skill workers program or better still the express entry. With you level of education and specialty of discipline, you should be in demand over there.
With canadian permanent resident you get 10 yrs u.s visa to travel back and forth to canada. All the options mentioned by members are not easy to get by more coming from nigeria.
Go to CIS website and check out the two programs I mentioned. Check which one fits your need.

Not all Nigerian missions abroad process passport application in the embassy, it has to be done in Abuja, Hong Kong being one of them. No need go back and forth. That there are cameo activities with consulate offices in foreign lands does not make passport application process done from country of origin. Yes there may be processes done here an there from more active mission. However, processing a passport application, applications made in nigeria in u.k is so on head off, is abysmal to hear off. 2. She will not be reissued any passport because there is no passport application in progress before the investigation, she has to apply and wait for the outcome making the whole process 2x longer. First time of me hearing passport application is processed from country of origin, what is the embassy for them? Her application will only go to the home office if identity theft is dictated. Unless u.k operates differently from most consulate office. Even Nigerian consulate office in foreign countries treat passport application within the office. I don't know if by opening up the more will make you understand the two way steps stated earlier are correct. Will not go back and forth with you on this again. She does not need to write to any authority because the passport application process involves identification check and if there is an impersonator the HomeOffice will investigate that else passport will be issued to her.
Going through investigation first then application will take much longer time. I do understand where you are coming from, am going to outline both processes, with a very good analytical view, they can make a decision on what is best for them. JUSTWISE: Apply for her passport which will trigger identity check Result: passport application in progress Pitfalls: identity check will trigger first, originality of her documents. The consulate office will run her check and send information to home office who does extensive check (duration unknown) If originality found credible, investigation on the imposter begins (duration unknown) Arrest made, case closed, passport reissued (Good, 2 steps duraction, unknown) COZYBUNCH: Report identity situation if any via online, certified post address and follow up with phone calls. @ebeekay You don't need to go through the long tiring processing of writing to this and that authority about the impersonator, help your mum to start the passport application process then during the identification check the HomeOffice will pick that out if at all somebody is impersonating your mum.
They will trigger the investigation and your mum will be called in for an interview and the impersonator will be called in as well, the worst case scenario is DNA evidence from any of your mum siblings to put the case to rest.
Your mum got nothing to worry about because she has the original birth certificate and family pictures to back up her case and the HomeOffice will do the rest without your mum reporting anything to them. No way a passport will be issued if at all like you said an impersonation is in place. I know of a case semi like this and it was reported. She starts applying, they won't still issue her a thing even with all her evidences. The difference there is that it will trigger investigation which will still keep her own process of getting her passport on hold. Not here to argue with any one, what I wrote is the simpleast logical process to follow, once they finish the investigation, justice will take its course. The home office will even write her them through the consulate office on their findings. Criminal cases like this is normally standardized with a little difference in local or countries own proceedings. Which country in the world that keeps proper records will issue a passport in a case like this. Even if it is picked, it will still stop the application which makes the case even longer because they will first of all start investigating the origination of her documents which takes time before the impersonator. In the home office website, there should be a section for complains or reports, utilize it. Also as a follow up write a certified letter to their post address, attentioned to fruad department. The same letter will also be addressed to the consulate office here in Nigeria. The same report you lunched online with the home office you do the same with the office in nigeria. You can always follow up with phone calls to the u.k home office. You won't get any appointment with the deputy in nigeria, it is not his or her jurisdiction to handle such complain, you are only notifying them or copying them as a matter of formality. You should have a sorter confirmation number or auto reply from their website that you lunched a complian. You use that reference number as a correspondence whenever you are in communication with them. Good Luck |

After all due process, she can apply for her passport through the embassy here in nigeria. Going through visa process via invitation from her sister is completely unnecessary. Why will a u.k citizen apply for a u.k tourist visa? Please follow this due process, it will take some time but that will be her best bet. Claims like that takes time to investigate on and action taken. Applying for a passport wouldn't cut it, wouldn't even be given because someone is using that identity already. Before the new rules of issuing drivers license to illegal immigrants, it was difficult to make an arrest to unlicense driver unless a crime is committed such as dwi, dui, hit and run, having control substance and so on. Now they do arrest because times has changed over time, more after 9/11. In those sanctuary cities ICE find it difficult to take charge when such cases come up, thats why is called sanctuary city (san Francisco been the most recent that happened). Immigration is a complicated issue now with states stepping in when they should not. We have sanctuary states such as California, new mexico, Washington state, utar, colorado and I can go on and on that issues drivers license to illegal immigrants.
