Travel / Re: USCIS: First Name Not On Birth Certificate. Please Help! by cozybunch: 1:37pm On Jan 14, 2017
All this advise are unnecessary. Hence the copy they have is same with the original you have it remains admissible. Name match weather first name, middle last name date of birth, all needs to be same as it is in your original copy.

If you have additional documents that has your first name is ok. People just give unnecessary fear and advise

Hello all. For the sake of anonymity, I created a new nairaland account, Please I want you to read this, might be long, but I really need you to read this.
Ok, I'm 23 yes old, currently in Nigeria and I have a younger brother who is 19yrs old.. Last year January, he successfully crossed the sea to Italy, Where he was taken to the camp in Italy (cara mineo) He spent some months there, and the living condition was very terrible.. He doesn't know anyone in Europe, but after some months, he left Italy before he thumb printed.. This he did so that he would be able to seek asylum in a stronger European country, thumb printing in Italy would make it hard to seek asylum else where because of the Dublin regulation that requires European countries to send back asylum seekers back to the first EU country of entry..
He left Italy through train and tried to enter Germany but he was turned back at the boarders, he went further to Austria where he was accepted and taken to a camp there..
Life there was somehow better than in Italy, as they were given little stipends, and little food.. He got a small job there where he was earning little, but unfortunately, work control cracked down on him and stopped him, and also slammed him with a fine.. After sometime, asylum seekers where transferred to the Bush.. no lies here, no food was provided for them, and he survived on bananas for days..
He begged on the streets, and he was able to survive..
After a few months, he was victimized and unjustly punished.. He was sent to prison.. He was alleged that he physically assaulted a white man, which wasn't true.. The white man himself confirmed my bro wasn't the offender, but the Austrian officials had already cancelled his Aduro..
He was deported back to Italy where he is back to square 1..
5days upon arrival, no food no water, no where to sleep except the ground, no where to beg because of the massive population of asylum seekers begging.. His health is deteriorating sharply, and he can hardly speak..
When we chat on WhatsApp, I'm almost in tears hearing his voice..
I really don't know where to look for help except this forum..
If I remember how he crossed the desert and the sea to get to Europe, I weep.. Now getting to Europe, he's realised things r not actually greener there.. Just 19, and the trauma he has passed through, and the trauma he is passing through can never be wished to one's enemy..
I have adviced him to be patient..
Please house, I really need advice here,
Even the Italy, ppl with documents are still in the streets, no job, no where to sleep, what to eat uncertain.
I have advice him to join the French foreign legion army, but I don't know if they accept asylum seekers.. Please, if you know any advice you can give to me that will save my lil bro, please help me, we have told him to come home, but he will be taken to deportation camp where he will spend 1yr there with more terrible living conditions..
Any nairalander currently in Europe that wants to help my lil bro with garri or food please I will really appreciate please, I m not asking for money, please, if it is just food that can get to his side, I will be able to sleep at night..
Please let's help our fellow Nigerian.. some ppl have made it in Europe and in the rest part of the world, while some r struggling very hard.. Please ppl, I type in tears, If anybody can help my lil bro in Milan? please ;(..
lalasticlala
justwise
pls help me carry to FP abeg.

I have not quite read comments of others but i doubt your story or i may say it may not be 100% true picture you narrated.

1. Italy is a schenge country, no border within member states. Meaning u can take a train from italy to any menber states without inspections.
2. If caught by German authorities, he will either declare asylum or better still, handed back to country of sojourn which is italy where he will be properly documented and finger printed.
3. In Austral where according to you, he gained asylum, they can't just throw him in bush, he is under international protection atleast, up untill his case is decided ( approved or not).

I can't comment on the charges against him, because nothing to write on that, no one is there to verify that story.

,
I greet you and I have been studying this forum for quite a while, and couldn't figure out I could really ask a question until just recently where I discovered I could sign up and ask questions.
Yes, I am a professor of Internal Medicine from one of the Nigerian Teaching Hospital and I will like to ask u this question.
My wife who is a teacher recently ( in December 27th, 2015 ) travelled to the US with my last child who is just 5 years old to celebrate the christmas with a friend of hers in the US.
I actually bought their flight ticket ( delta airlines ) where her return back to Nigeria is supposed to be Jan 25th.
Besides, she suddenly decided to stay longer during this visit, probably she planned to take longer rest. Her intention has been that she will spend around 5 months before coming back to Nigeria, she was given 6 months at the POE.
Based on the above, I phoned the airline about changing her return data to May 2016, but the airlines refused, they said her ticket type does not support such lengthy extension.
Since my wife has decided to stay till May, and she might have to forfeit her return flight, meaning I will have to pay for their ONE WAY ticket back home in May, 2016.
However, I intended visiting her in a week time, right in the US where I plan to spend just 4 weeks.
My question:
Won't I have issues at the POE if asked why my wife and child still remain in the US and why she decided to forfeit her return flight. I hope you understand my question sir. Remember her i-94 indicated she has to return back to Nigeria around June, 2016. Won't I have problems at the POE as why she suddenly choosed to forfeit her return flight ?
Thanks

Why are you complicating issues, is she with a family member who is legal in u.s? Is she in a hotel or rented apartment by her self? I believe the later is not applicable. So why would you want to mention her name at point of entry if she is with a friend or family menber?

She is still legal in u.s with her visa status but you have no reasons of mentioning her name at poe. Who ever she is staying with, hence the individual has legal status she be your contact

Good Luck.

[quote author=paradisewoods post=41918696]Hi everyone, I have a couple of questions to ask. I have a visiting visa (Business visitor) to canada, however I just got married and my wife is a student in canada since last year. She just went back last week and I wish to go join her. This is my question
1. Can I apply for dependent visa inside canada or must it be outside canada
2. Proof of maintenance for me, must the account be in my name or my wife's name. Or either?

Thanks so much for your anticipated response. [/quote

Question 1: No. You must apply from nigeria. Your visitors visa must be conciled without prejudice before issueing a new visa (dependant visa)

Question 2: it does not matter. Hence, you guys are married and can prove it, thats all that matters

Visa Expiration Date is just the last date u can use the Visa to travel into the US. If your Visa expires on Dec 31 u can still travel on Dec 31 provided u will arrive in the US on the 31. The length of your stay is not on the Visa it is on the I-94. People do have expired Visa but their I-94 is still valid. A US Visa is just for u to travel to a US Point of Entry and apply for entry. The expiration date of the I-94 is the main thing.
The Immigartion Officer at the point of entry will make a decision on how long u will stay depending on your circumstances but they normally give 90 days or 6 months except for people coming for Conference or Training that has a specific end date

Well said but in reality after 9/11, it is extremely difficult unless it is a matter of urgency. Cbp officer will have problems with that. It is a dire situation

I want to ask this question.
I will be having a short break of 2 weeks from my work very soon and intend to spend like 10 days from it in the US, and that will be in February. However, I will be having another full one month annual leave in April which I will like to spend in the US
My question is this : if I travel in February to the US and later travel again in April, won't I be questioned at the POE for coming/visiting the US so closely dates; February and then April.
Thanks

Your admissibility like LadyGuinivere said is soly discretionary (hands of cbp officer) and is considered on each point of entry to the united state

Hello all.. Happy New Year, Great work here Lady G,seyewest, cozybunch, nife(sth) grin and co

On behalf of my elder sister and my younger sister, the two of them no allow us rest.. my younger sis 28yrs running her masters programmes in EKSU,single wants to accompany my elder sis 34 years, married with 3 kids (banker) to the states for the easter vac

My elder sis initially promised one of her kids(her eldest,11) a vac to Disneyworld if she could win a particular (well known, recognised) national scholarship competition and which she won and she's got a scholarship to her university level..

question 1,is it really necessary to tell the VO all ds details as a reason for their travelling or she shd just mention Vacation cos this my sis already planned going to the embassy with all my nieces awards and all and ready to explain how she won each stages, from state to national, how she got 79 schools beaten down

Question 2,my younger sis wants to go with them hence made the suggestion to include my elder sis other two kids(4 and 2) in the application to make her travelling with the family justifiable as to help out with the kids.. is it really justifiable?

Question 3,my elder sis already applied to usa twice 2yrs ago and was refused,1st interview she was asked if pregnant and she said no which she was but she was either scared or nervous or I don't knw y she lied sha,she wasn't even well prepared..she went a month after well prepared with lots of confidence but wasn't even asked much, the VO just smiled and said "you were here a month ago"and got refused instantly(i guessd they sensed some desperation) in the form she's filling now,she doesn't knw what reason to write as to why she was been refused the 1st and 2nd time,we only assumed mayb it's because of the lie abt the pregnancy which is even obvious because she had her 3rd child afterwards and she's applying with her now

Question 4.. my elder sis had already been to uk twice with her 1st two kids and my younger sis dubai once.. my elder sis is scared that my younger sis lack of hometies(masters student and single) and travel history will affect her application the 3rd time while my younger sis is scared my elder sis's previous refusals will affect her 1st time usa visa app which she doesn't have any choice tho, once my elder sis is refused, her app is automatically refused cos my elder sis is her sponsor but she's scared if this won't affect her future applications..and if they feel my younger sis,a student,28 and single isn't qualified, will it affect my elder sis and her kids or she alone will be denied?

Last question.. my elder sis estimated 2m for the trip but at the time of the interview, she may not have up to that as her balance, does it really matter or is it a must she has the 2m as her balance or more?

Thanks y'all.. don't mind me I always like being detailed so you can help tackle the questions with better understanding

LadyGuinivere is correct on her analysis. However, I have a little concern on your younger sister. Not that she does not stand a chance. Is just that she (younger sister) being an adult will be expected to have serious ties. Her education is not strong enough. Having said that, visa interviews are case specifics in that, the fact that your sister is the sponsor can be put into consideration.

Good Luck.

Now guys let me tell us why it is very difficult now to adjust to student status while in u.s even though yes in their website (uscis) there is a provision for that.

1. There are now technical questions that where not in place before that needs honest answers and will be checked in the background

A) what did you say that was your reasons to obtain a tourist visa
B) do you have intentions of studying while obtaining your tourist visa
C) what did you tell the CBP officer at point of entry
D) why did you not apply for student visa while in your country

And many other relating questions that will be cross checked. Now when you get your admission and you apply for change of status (also depends o quick responds) you may have been out of status with your tourist visa.

There are other serious proves that has to be met such as financial status. Now you deal with new cbn rules in nigeria with commercial banks eg remitting money from your bank in nigeria. Unless you have starched funds here in u.s with a bank ready for use.

Most cases if not 90%, adjustment to student status are denied now with uscis. They always tell you to go back. Yes in the past it was easy.

Good Luck.

Changing of status from B2 visa to f1 visa is 1000% possible and easy
It is very possible to do that. All you need to do is go to the Admission Department of the University to fill application for admission and talk to the Admission Counsellor/Advisor. The admission Counsellor/Advisor should be able to give you acceptance letter if you demonstrate you have the financial ability to pay for your education. After proving your financial capabilty to pay your tuition, the Admission Counsellor will issue what is call Form I-20 which will then be forwarded to Homeland Security/Customs, Enforcement and Immigration Services for change of Status from your B1/B2 Visa to F1 Students Visa. It takes only 21 days to process.

This has been done by a lot of Nigerians while I was in school. I have seen it done many times. I have seen Nigerian in their 40s did this just to remain in U.S because it is the easiest ways for many people to study or remain in the U.S.

I don't know how long ago you are talking about. In practice now you will be denied while in u.s

alhajiwasiu55:

Thanks sir. But if the school finally changes her status to f1, and the kid f2, isn't that legal ? And will I still have issues renewing it ? After all her status would have been changed to f1

Why are we all speculating? What they did is wrong and unacceptable but I will answer mind bubbling questions, already made statements etc.

1. Can your wife adjust to student statues while in U.S?
Answer: No. Even with the promise of helping from the school, uscis will denier them and ask them to go back and file for F1. No adjustment to F1 with B1/B2 while in U.S again. Schools in states are profit motivated and will always promise because they need your money for them to function.

2. Can you be denied entry to u.s with a valid u.s visa?
Answer: No because CBP may not connect you with them unless you mention their name as people of contacts. Them they will check their status, if any violations, you will be denied entry and be bar from entry the u.s for some years.

3. Can you renew your visa?
Answer: Yes/No
Reasons for Yes: if your wife's visa conditions is tie to you being already a u.s tourist visa holder and they want to figure out your wife's conditions, you may have a problem. It may be as a matter of routine check or of concern.

Reasons for No: if there is no check on her or she got her visa on a separate condition not related to yours.

On the hind site, your privy will always undermine you. While would you want to separate your family?

Breaking news is that ICE is planning on a big immigration rake here in u.s on illegals even though some Democrats including presidential candidates like Hillary Clinton has express her concerns on it and this could start as early as this January 2016. Yes she may not be illegal now, but why work her way towards that because at a point she will become illegal if she continues to stay back

You need to do the right thing, have them come back and apply. She can get the admission from the school but her application should come from nigeria.

Good Luck.

Hello guys, i need an advice.
I got a job offer from a company in USA. I've sent the recommendation letter(from my employer), and my front passport page
to uscis and was asked to apply for the Employment Authorization Card. My question goes thus:
(1).What will it cost me to get the Employment Authorization Card.
(2).Will there be a visa interview and the likely questions.
(3) How long will it take for the visa to be ready.
Thanks

Please is good you make some research your self. Uscis has a website where most of your questions are answered.

We don't know the type of visa or authorization card you are looking for as there are a lot of those. Yes you mentioned employment from.an employer but there are still different types of employment based visa

You are right that an employer can make an offer and decide to sponsor her if they want her, but that's just one hurdle as then getting the H1 is quite difficult due to demand outstripping supply every year.

I wouldn't have getting a job in the US from Nigeria with the hope of getting a H1 visa as my main strategy to get to the US because chances are very very slim. She can always try of course but she should look at other more viable options such as via F1 or look at Canada and Australia who have more favourable requirements at the moment.

Correct analysis. I already wrote on my previous writings, that canada is a very good option for her with better health system.

Nothing wrong in trying u.s still as her first choice.

I am laughing in French right now.... It seems you have no Idea of American labour laws.
I am not saying it's impossible, but it is almost impossible- look at it this way; She said she studied Civil engineering, unless nobody in the whole of America studied Civil Engineering (Which is impossible) before the company will assume she suits a position.
Even if she had a Phd in Civil Engineering, H1 Visa's are not easily filed for, unless on very rare occasions.
It's only Canada I know that makes skilled labour hiring look easy, but USA naaaaaaaaaah... If you ain't in the US, fuhgedabowrit.

My dear I don't need to go back and fort on this. In papers what you wrote is the disposition of the bill, but in reality an employer can make an offer and apply. Once, there is visa availability, a visa will be issue.

Yes may be easier if she is in state. However, if an employer identifies her as a potential suitor may be because she will take pay cut in that position, and she accepts the position, a petition will be made on her behalf, if visa is available, she will be issue H1

Well still tricky. Do that thou, but apply for FOIA. Is freedom of information with uscis. With that you will have true or real time situation on your student status.

Good analysis, so, what then is the advantage of the invitation if the onus is still on him to meet the requirements?

It is not his merits (requirements). Is now based on the circumstance (visa issued based on a nephew invitation). I gave an example of a teenage cousin who never met requirements but visa issue. It is some times case specific.

Thank you for your reply. Yes my friend is inviting his uncle for a visit and all expenses on my friend, he's working full time and has the money to provide for his uncle's feeding and other expenses. His uncles got 2 yrs US visa and he recently returned from US visit. This why i asked the question here if its ok for my friend to sponsor his uncle, but Vicjustice who knows better than me said:

''Inviting a dependant "uncle" to visit you abroad has always been a tough thing. This is because, an uncle does not qualify for family visit visa: therefore, unlike the case with his visit to his own children in the US where he was allowed to be sponsored, he is not eligible for sponsorship in this instance: therefore, he needs to personally fulfil the requirements for a tourist visa. Happy Christmas to you too''

Vicjustice was right

I understand he (uncle) is not considered as direct dependant to him. It is a standard with most advance countries. However, an invitation is still open. In this case a circumstantial one. What do I mean (senior citizen). Yes may not have the money but the nephew takes care of his leaving expenses.

Visa can be given on that. Yes normal invitation requires the invited to meet tourist requirements, burdens normally rest on the invited but it all comes down to case by case as it is applied.

A teenager eg a cousin can be invited ( requirements not met) as a tourist, but visa issued base on the circumstance of the invitation.

Good Luck.

The is a difference between the visa expiration date and the duration of status.

If he has been within the duration of his F1 status then he will be fine even if the visa has expired.

If he is outside his duration of status i.e. stopped full time education then he will have issues.

Perfectly do understand that. Not withstanding, it is still a concern. He has to prove his student status which would've been avoided if he renewed it.

If he goes home without sorting it out here, it becomes difficult with the consulate office in Nigeria. Little things that matters, could matter a lot.

Good Luck.

Thank you Vicjustice, info passed cheesy. The uncle is not in a position to personally fulfil the requirements for a tourist visa, for the following reasons: (1) He is not working. (2) I am not sure if a tourist can claim that he know someone in the country that he's travelling to. (3) Don't you think it'll look suspicious for an old man over 70 who is not working and claiming to travel as Tourist & will use hotel, don't you think they will suspect that he definitely know someone there waiting to receive him?

The uncle is not working according to my friend. Any other suggestion as per sponsor level? Although he asked me about applying as a tourist, but i told him that it would be difficult because of his age and the visa officer may refuse him as per he's not working, not even enough in his account that will convince them that he's going as a tourist, hotel, e.t.c. , which is the reason i told him to relax to let me confirm if he can sponsor him since he's inviting him. Or can the uncle's children in US sponsor their dad's trip to Ireland as a tourist, using their bank statements and booking hotel for him?

Am finding it difficult to understand you. If your friend in ireland has the money to provide for his feeding and other expenses he may in cure while leaving with him, why would he not invite him for a visit.

His age is even an advantage even though they will start questioning his motive for visit eg health reasons. If he is in good health he can be invited, all expenses on your friend.

He is not sponsoring him for migration but normal invitation to see his nephew, what is wrong with that? If he will be given visa or not is a different subject

Good Luck.

Hello all. How true is it that Canadian embassy does not give visa to people without travel history. Hubby and I plan to travel next year for a holiday during our annual leave. We will also use the opportunity to attend the graduation ceremony of his younger sister. What are our chances of being given visa under the following circumstances;
1. We hope to be away for two weeks.
2. We have two kids but won't be going with them
3. We both work here in Nigeria
4. We hope to get a letter from his younger sister inviting us to her graduation ceremony.
5. Our passports are fresh. We have never travelled out before.
What is our chance of being given the visa and how many entries/how long may be given us?

There is no problem with that. Yes they can be meticulous, but which embassy does not. You need to have enough money in your account thou, they are one mission's office that looks into it.

Good Luck

My piece of advice, apply as u going to settle your daughter, cic know your daughter is going to school and when applying say u accompanying your daughter to school to help her settle down
Ma, get a letter from work saying u are accompanying your daughter to school and they are aware
Employment letter
Daughter study permit
When applying there is a question of are u accompanying someone who just recently got approved of visa your answer is yes
There is high chances of you getting a visa with your daughter study permit than a relative invitation
School start Jan 1st week so put like Jan 3 u will be surprised how fast you get the visa
Applied for sister accompanying mum for visiting to canada Nov 4 or 3 visa out Nov 23 note travel date was Dec 18.
Use online to could be quick at times
Parent doesn't usually have problem getting visa as along has kids are here or on their way

You are right on your analysis but I can't bet on how soon the visa is approved.

Good Luck
