So therefore, when Ojukwu declared Biafra, he clearly stated that he was no longer subject to Nigeria. Now being a free nation, he had to create an army to protect the new country from invaders and this he did... Also as a free nation it had complete ownership over it resources and Nigeria no longer had it... So now having declared itself a sovereign state, it is now a country of its own... So the civil was was between two sovereign Powers...

The difference between Benin and Biafra is that Benin was under the Nigerian government therefore were subject to Gowon leadership... While Biafra was already a country of its own so they had control over their own affairs which Benin didn't have...

The critical mistake Ojukwu made was not getting a superpower on its side before going too far.
