It shouldn’t be a problem since you’ve already uploaded the expired passport.Your ILR comes as a card. So they don’t need your new passport. If they’ll ask for extra forms of identification if they need any… all the best

Hello Wonderful people in the house,

Please any advise on what to do if new nigerian e-passport has not come as at when one wants to apply for ILR? We have done biometrics and still waiting for passports but while filling the ILR form, i indicated that new passport is delayed and gave the reasons, i also said I'll upload new passports as soon as its delivered and at the "compulsory documents to be submitted section", it asked to submit old passports. Just want to know if this will not be an issue because i won't want passports to affect the 28 day rule.

I went online and used the below link and it was really helpful. It will ask you questions like when visa was issued, when you entered physically and BRP expiry and calculate when you should start the ILR application. It corresponded with what @Demoore advised.

Congrats in advance, you are nearly there.

You are eligible to apply for ILR Set M 28 days before the 5th year anniversary of your ARRIVAL in the UK. I suggest you aim to apply between 26 - 20 days before your 5years anniversary. All the best.

Please i need an urgent clarification, i and my kids will be 60 months in Dec 2022 but expiry on our BRP is May 2023. When can we apply for the ILR? 28 days b4 Dec 2022 or 28days b4 expiry on BRP. Really confused.

And they wouldn't know private university from the government and also read my mind to know i won't pay such amount for her to japa while still a student , I'll rather wait for her to finish and use the remaining visa validity to japa lol but ppl have done that before and worse sef , i even know somebody that came thru school to UK and spent well over 3.5M to agent and didn't even step foot in the school,

I am sorry to say that your niece is not an immediate close member of your family. Your siblings and your parents and children if any abroad comes first.

I think you are looking at it from a Nigerian or African point of view... Your niece could be from your father side or mother side and they could be numerous...

The fact that you are responsible for this person in the African way does not change the ties to you and the way the ECO look at things...

Just imagine: you have said this person is being looked after by yourself and parents are no longer but you want to spend more than she needs in a year for a 12 days visit.

Being in University or even 1 month to the exam is not a strong enough ties on its own. Giving the state of Nigerian universities and the constant strikes, it is not unreasonable that someone can still japa from the country. We have had students come on sports or cultural visits that refused to return or even Olympians.

Save the money you want to spend now and take good care of her in Nigeria and invite her when she finished her university.

Easter hols travelling for 12 days is not essential travel for her or the UK - again, sorry! Times are different now.

Really it's after some thing has happened then we start regretting. I made a mistake saying the truth that her parents are late but i didn't want anything to come back and bite me so i said the truth.

She's in final year (year 4)and will be having her convocation in November and i plan to be there, she'll graduate before Christmas and her final exams will be in July 2021, what can be done in this case? I will definitely rake loads of pictures.

I told her we'll likely reapply in 6 months time so we can build up the monthly upkeep i send to her and yes i pay her school fees, couldn't get previous receipts from my Stanbic app, could only get some from GT and others kept saying couldn't retrieve details but i tried to generate my statements and it worked so that will come handy next. I pay her fees direct to the school account.

We actually submitted a detailed letter from the school with her school ID card and i submitted pictures from when she was in primary and secondary school together but i guess it's the no ties back home but am the only tie she really has.

I'll see about the job aspect that is if we don't go the student visa route cos i don't want a 2nd refusal record ontop visit jare

Please do you have any input concerning what they mean about the accommodation?

What year is she in now?
And how long is her course in Nigeria for?
If it is a 4 year course, apply for her to come during the Christmas holidays of the 4 year course... like before her final papers.
Basically hang on the fact that she has studied for almost 4 years and is about to bag her degree and will certainly not throwaway those years to come and become an illegal in the Uk.
Pending this time, build up facts of financials been from you to her.
Say monthly u send her upkeep money for all months of the years till whenever u want to apply for d visa.
Also who pays her sch fees?
U can also do same for her fees. Like have paper eveidnece of this payment and anyothe rpayment that connects her school.

Then she should get introduction letter from her school stating when she started the course, how long she has been in d schl, what course she is in and when she is graduting.
They shud also state that she has no academic or financial deficiencies.
Also have her attach all her school reports, id card, schl payments and every and anythin that shows this school has been on for years. Basically let them know that her graduation is in few weeks or perhaps few months and she can’t throwaway all these hardwork for nothing..
this is her tie to Nigeria, bleed it very well..

If u have pictures together before her parents died or after, add all this to ur case

She can also get a part time job as a student.. or if u have a company or friend who has a company acct that can be payin her monthly for part time work this will also show her commitment to Nigeria. Did her parents leave any property in her name? House or car or anything at all? Provide this.. this shows she will come back to Nigeria, it ties her to the country.

If you can even come back to Nigeria before her next application, do come back and take lots of pictures with her. Indicate this in d application, that due to the denial u had to fly in to see her because she is your family and family rights are essential.
Also write a cover letter letting the home office know all these things and that u have no reason to want to keep her in the country illegally. Tht u feel bad and responsible and just want her to come for a holiday to take off stress from school and other things.
U have to come from all angles.

Thanks for your input. We actually submitted a letter from her school to show she's still in school and fees already paid. Plans was for her come during the Easter period hence why we put arrival and departure datrs around then.

I never mentioned tourism but to visit family in the invitation letter. We have ppl that are in the university and got visas, its just unfortunate she was refused.

Please i want to know which other family member is closer than a niece? This is a girl am paying her fees and monthly upkeep. The reason i kept it to 12 days was because she will have to go back to school and i thought staying more will be a red flag if we've said she's in school, don't you think?

I applied for her with the knowledge that being in school will help as she'll be graduating soon and we might not get a letter from the school. we've been apart for more than 3 years now, she has always lived with me with both mom and dad late.


Anyway, i believe it is what it is with UK and their visas.

Inviting someone of University age outside the main summer holidays is a red flag in my opinion.

It is probably more her age and no concrete ties to Nigeria which you have unfortunately stated inadvertently in your post here too...

Why would she return back to Nigeria after just 12 days visit.

If you are going to invite a family member for a visit - they have to be closer than your niece and not for just 12 days - what can be achieved in 12 days.

Also tourism was mentioned - no need to mention that during this present pandemic period...

Dear all,
I applied for my niece to visit me and my family but she was refused. The reasons are funny and really i cannot understand what they wanted. I said she was coning to visit family and not tourism. I included some of the transfers i made to her for her upkeep and also a transfer to the school for her school fees to show that her school fees has been paid and she'sdefinitely going back to finish her studies. Am really sad because am all she's got as her mum my sister and her father are both late.

I thought if one is sponsoring another and listed the person as unemployment cos she's still a student, then its the sponsors record they look at but they are looking at her own financial situation and accomodation and i stated truthfully that when she's not in school, she stays at my late fathers house, a family house.

Please i need advise incase of reapplication which i don't plan to do anytime soon.

U have to log in through the email u were sent when you paid. Not to go to tls page urself, log in from the email and you will be able to access tls platform.

And if u still dnt understnd, u dnt need to send any documents to Nigeria tho, everythin used is scan copy sir/ma. Simply scan to whoever will be using it and that’s all. Physical documents are not collected anymore.

Also is total of £750 ok to put as amount to use in sponsoring her, am just buying her ticket and small change for get to buy stuffs when going back to naija.

I will suggest your hubby go online and fill the form for "If your BRP has not arrived "on gov.uk/brp as it is more than 10 days after getting the decision letter. I got our BRPs before the decision letter, can you imagine? But cos there was validity error, had to send the cards back to be cancelled and 4 days after got the re-issued cards cos they said the cards will come within 7 days.

Yes, you are right cos i read on an immigration site that for ILR application, you need to present both B1 test of English and the Life in the UK test.

Immediately after i applied for the FLR, i started saving monthly using Loqbox and moneybox, don't want to start panicking close to that time and i need discipline else one thing or the other will keep taking the money out of my account.

you need the life in the UK test to apply for both the ILR and naturalization. But if you do it once, it will cover for both since i does not expire

You need to prove your english proficiency for all applications, don't know which english proficiency test you need to do because i never used test but it is required at all stages. i used Naric for spouse and FLR (same one) and i plan to use it for my ILR in next year, na application money i dey try gather now. I thought you need to do the B1 for ILR. Is the Life in the UK test not for Naturalisation and citizenship application? Which i learnt you can do that anytime b4 the Naturalisation application because it doesn't have an expiry date. From my findings, you need B1 for ILR application and Life in the UK for naturalisation/citizenship application.

Pls enlighten me, can you use the Life in the UK test for both ILR and naturalisation? If yes, then that's good, not that one will do B1 and then do Life in the Uk test again, all these tests sef.

Yes you are right @Aphrodite007, i actually thought i was expected to exhaust the 42 months, JJC like me but the customer service staff explained that i could apply for ILR once am 60 months or wait 28days b4 the date on my BRP expires and enjoy the dash but at the end of the day, i got a mail from FHR2 that the validity on the BRPs were wrong so to send them back and be issued new ones. They actually sent 3 BRPs instead of 4 BRPs, they stopped the generation of the 4th one when they discovered their error.

Thank God we are hardworking people and don't give up easily so will always disappoint them. We are here to stay and give our kids a better life and not their fault, abi, na our country with very bad uncaring, wicked leaders cause am. Meanwhile na we dey work the work for here pass. corona or not. Immigrants full the health sector. You know they promised Health workers 1 years free visa extension? Well it was kind of a scam cos they still said a lot of people were not eligible quoting some silly reasons, they only planned to give just 3000 people the free extension and once they reach that number, no more.

Increasing the IHS just like that even with the current situation of cut hours, no jobs was not fair at all, very insensitive. My saving Grace was that i applied b4 the increase, how i for do with 3 children, that means extra £2,240 ontop £8,208 plus paid appointment £276. This people dey actually milk us, all we work, na for dem pocket. It is well ooo my dear. Tkia

The IHS was increased from £400 a year to £624 from October 2020 so for 2.5 years, it's £1560. Really sad but can we refuse to pay? Take heart, it's well.

don't worry it will be ok. You'll get your reply soon. Did you use the App? I used the appointment centre and got our BRPs less than 3 weeks after biometrics. A friend that used the app is yet to get a response too and he applied online since June.

Funny thing happened to me... visa was to expire 24th August, i applied for myself and 3 kids a week before but couldn't get an appointment till September 23rd and this was paid for, so ontop of the huge amount £8.2k, added £276 for paid appointment, no problem, God dey. You won't believe, not up to 3 weeks later, we got 3 BRPs in the mail dated 7th October instead of 4 BRPs. Really fast and no decision letter or mail as others received but i noticed that the validity on the BRPs was 42 months instead of 30 months making my route 6yrs+ instead of 5 years. I was shocked so i sent a mail to the email provided if there's issue with BRP validity and reply was that we don't fall under the category for Administrative review and gave me number to call, called the number and the lady said, the extra 12 months on my validity doesn't matter, that i could choose to apply for ILR when i complete 5 years or b4 the validity expires which could give me time to save and i also asked about my daughters missing BRP. She said it will come, that though we applied as a family, they are treated individually.

After waiting 10 days and still no BRP, i filled the form on gov.website and like 2 days later, i got a mail from FHR2 (written ontop of my first email for Admin review which i was told was not applicable to me) apologising that they made a mistake on the validity and to send back the wrong ones to be reissued the correct ones.

I can confirm that the incorrect expiry date was input onto your application. A stop was placed on the BRP cards to prevent delivery but the TNT courier delivered them to you in error. Your daughter- card was not issued as the mistake was realised before her card was generated.

I concluded that the Admin review forwarded my email to the right email even though they told me they couldn't assist me and this was good, my problem is with the customer service team who do not have a clue and yet dishes out advice and information which could be misleading and cause issues in future.

In all, i thank God, my employer never bothered/stopped me working cos in addition to me carrying them along, they are also aware that you are permitted to work as long as you applied b4 your visa expired and waiting for home office response and that Home office has backlogs.

I received my BRP same day my document came back. I got the document with a letter that my BRP will be sent i think in a week ( cant remeber exactly except i look for the letter) and not long after a delivery guy came with my BRP.

Please if you don't mind me asking did you receive any letter after biometrics? Also did you receive your documents before you received your BRP or did it come afterwards? Thanks

Congrats Ronvlaar,

Good decision you took and it made off. Happy for you. I actually thought of re-applying too for my kids with priority but fortunately we got an expedite hearing cos they are minors for 1st week of next month.

The best thing actually is to address their refusal and re apply if the money is available to have rest of mind cos this appeal of a thing takes time. the waiting is terrible.

I ll be going there with God and ready for them with all documents and plenty of tears. lol�

yes 4 weeks excluding the time to receive the biometric letter. really i can't remember the exact time frame btween when i posted the replacement form and when i got the enrolment letter but i remember that 2/3 days after i posted the form, they deducted the money.
