Again, Court Orders Temporary Forfeiture Of Funds Linked To Patience Jonathan Channels Television Updated May 8, 2018 A Federal High Court sitting in Lagos has granted an interim forfeiture of the sum of N9.2bn and $8.4m linked to the wife of former President, Patience Jonathan. The money is to be forfeited to the Federal Government. Justice Mojisola Olatoregun granted the order following an application filed before her by the Economic and Financial Crimes Commission (EFCC) after it had consolidated all similar applications on the subject matter. On April 14, while delivering the ruling on an objection raised by Mrs Jonathan to the EFCC’s first ex-parte application on the funds, the court had held that the move by the anti-graft agency was an abuse of court process. The judge reached this conclusion because the funds which the commission sought to forfeit to the federal government were already the subject of litigation before two other judges. The judge, had, however, ordered the commission to publish the order in a national newspaper to give any interested party an opportunity to come before the court within 14 days to show cause why the sums should not be permanently forfeited. Patience Jonathan, five firms and one, Esther Oba were listed as respondents in the suit. The firms that were listed as second to sixth defendants were; Globus Integrated Services Limited, Finchley Top Homes Limited, Am-Pm Global Network Limited, Pagmat Oil and Gas Limited and Magel Resort Limited. An investigator with the EFCC, Huleji Tukura, who deposed to a 15-paragraph affidavit in support of the ex-parte application claimed that investigations by the anti-graft agency revealed that the funds found in the bank accounts and linked to Patience Jonathan emanated from the coffers of Bayelsa State. The funds were said to have been moved at a time when the former first lady served as a permanent secretary in one of the ministries in Bayelsa State. According to Tukura, Mrs Jonathan first opened a First Bank account and then “procured” the then Senior Special Assistant to former President Goodluck Jonathan on Domestic Affairs, Waripamo-Owei Dudafa, to fund the account with “proceeds of unlawful activities.” “The said Dudafa Waripamo-Owei procured one, Festus Isidohomen Iyoha and Arivi Eneji Peter, who were domestic staff attached to the State House, Abuja, to deposit the funds, reasonably suspected to be proceeds of unlawful activities, into account of the 1st respondent (Patience). “In depositing the funds into the account of the 1st respondent, the said domestic staff, in a bid to conceal their identity, deposited the funds, reasonably suspected to be proceeds of an unlawful act, into the 1st respondent’s account, using fictitious names. “The total sum of $4,036,750.00 (Four million, thirty-six thousand, seven hundred and fifty United States’ dollar) reasonably suspected to be proceeds of unlawful activities, were deposited into account No. 2022648664 domiciled in First Bank Plc in the name of the 1st respondent. “On the 28th day of September 2016, the 1st respondent, in dissipating the property sought to be forfeited, transferred the sum of $3,640,794.72 to the 1st respondent’s account No. 2031277178 domiciled in First Bank Plc. “On the 5th day of October 2016, the 1st respondent withdrew the sum of $1,000,000.00 cash from the said account leaving the balance of the sum of $3,645,013.73 which sum we are urging this honourable court to forfeit in the interim to the Federal Government of Nigeria. ”As at the time the various sums were deposited in into exhibit EFCC01, the 1st respondent was a serving permanent secretary in the employment of the Bayelsa State Government. “The funds sought to be forfeited to the Federal Government of Nigeria are not the 1st respondent’s lawful earnings but are rather reasonably suspected to be proceeds of unlawful activities”, the deponent averred. The deponent further averred that the companies mentioned in the application were not into “any legitimate income-yielding business venture” but were rather incorporated at the Corporate Affairs Commission (CAC) for the purpose of warehousing proceeds of unlawful activities for the former first lady. He claimed that every now and then domestic servants at the Presidential Villa were sent to deposit money into the companies’ accounts for Mrs Jonathan. “The depositors into this account are domestic staff of State House, Abuja, who was procured by the said Dudafa Waripamo-Owei to deposit the funds sought to be forfeited in a bid to conceal the true origin of the funds,” Tukura said. Obasanjo, who performed the groundbreaking ceremony for the construction of Azikel Refinery, the first private modular refinery in the oil and gas-rich Niger Delta region, admitted that unlike the present administration, 18 of such licences were qapproved under his administration but they failed to actulise it.. The proposed Modular Refinery, which would be built and known as Azikel Refinery is owned by Azikel Petroleum, a subsidiary of Azikel Group of Companies with Azibapu Eruani, an indigene of Bayelsa as its Group President, is located at Obunagha community in Gbarain Kingdom of Yenagoa Local Government Area of the state. The 12,000-barrels refinery is sitting on a 19.92 hectares of a swampy land that was reclaimed with over 2.7million cubic metres of sand, which dredging lasted nine months and It is expected that Azikel Refinery would come on stream in 2019. Speaking at the event on saturday, Former President Obasanjo commended President Muhammadu Buhari for awarding modular refinery operational licences to 22 firms, including the Azikel Petroleum. He noted that out of the 22 licenced operators, Azikel Petroleum is the only company that had actualized its dream of establishing a modular refinery. The former President said he was delighted at the commitment of Azikel Petroleum, adding that none of the 18 licenses earlier awarded by his administration came to fruition. Obasanjo said, “I have been told that President Buhari and his government gave 22 licences and Azikel Petroleum is the only license out of the 22 that is really actualized. “Before then, we gave 18 and not one was actialized.They gave all manners of excuses including insecurity and oil prices. But those excuses thy give are still there. But they were not genuine entrepreneurs. They were after collecting licenses to get crude oil. And that is why in an occasion like this we should pay special tribute to people like Eruani. “I join you all in thanking President Buhari for giving four licences more than we gave. And he (Buhari) is lucky that he has a man like Eruani to be the only one to actualize” He also commended the Bayelsa State government under Governor Seriake Dickson for creating the enabling environment for the take-off of the modular refunery project. Obasanjo also lauded the technical and financial partners of Azikel Petroleum and advised the Group President of Azikel Group of Companies not to betray the trust and confidence reposed in him by his partners. In his welcome address, the Group President, Azikel Group of Companies, thanked President Buhari for the licence and expressed hope that the refinery project would mitigate the frequent scarcity of petroleum products and curb youth restiveness in Bayelsa and in the region, Eruani, who noted that some youths who would work at the facility were currently undergoing fabrication engineering training in the United States, said that construction and production phases of the refinery project would provide about 1,000 jobs. “Our journey is one with lots of interests and challenges. But our committed drive to industrialize the Nigeria Delta is unwavering. For the first time we will refine crude oil at home. This is the beginning of reversing the incessant scarcity of petroleum products. “But more importantly, this will bring several businesses in the state and in the Niger Delta. We will puts youths to work and we will be engaging communities. This will largely curb youth restiveness”, Eruani said. In his remarks, Governor Dickson said the Azikel Refinery was very important to Bayelsa as the government creates the conducive atmosphere for private sector investment to thrive. Governor Dickson, who at the event signed two Certificates of Occupancy and handed over them over to Azikel Petroleum and Azikel Power, another subsidiary, also commended President Buhari “for finding Azikel Group fit and proper”to be granted licence, stressing that “we expect more of such friendly gestures”. He said that his administration would continue to support the refinery project and any such business ventures that would stimulate economic growth and development in the state, describing Bayelsa as a safe haven for investment. In their separate remarks, the Chairman of the event and former Military Governor of old Rivers State, Alfred Diete-Spiff, Senator Paulker Emmanuel (Bayelsa Central) and former Minister of Petroleum, Edmund Daukoru, said the establishment of Azikel Refinery was the greatest thing that has happened to Bayelsa. The refinery is a National asset and selling or concessioning it, is not something the President can do overnight. We all agree that Govt involvement in running a state business should be minimised. But you are aware of private investment encouraged by the same FG. Next year, Dangote refinery will come on board. Some modular refineries are under construction with some scheduled for completion by the end of 2018. Whether you agree or not, it does not change the facts. These are projects that are happening for the first time in the history of this country. Dangote refinery alone will cater for all our local petroleum products need with more to export.. |

Track laying commences on Lagos-Ibadan fast rail By Abdullateef Aliyu, Lagos | Publish Date: May 8 2018 Finally, the laying of tracks for the ongoing Lagos-Ibadan standard gauge project has commenced, it was observed today. This commenced during the inspection of the project by the Minister of Transportation, Mr. Rotimi Amaechi and the Minister of Information and Culture, Alhaji Lai Mohammed. However, the laying of tracks has now commenced beginning from Itori section of the project in Ogun state. The Transport Minister also confirmed the development during the ongoing inspection. Our correspondent observed two track laying machines at the project site which is a beehive of activities. It has fabricating yard housing their plants and many engineering plants. The project is being handled by the China Civil Engineering and Construction Company (CCECC). At the moment, the high-powered team is meeting at the CCECC yard to added pending encumbrances to the project like water and gas pipelines, bridges, among others. Court cases take time and its like that in most part of the world. Nigeria case is worsened due to the large number of the court cases and the large number of looters being dragged to court.Their conviction will happen. What you cannot deny is the assets recovery. Conviction too will follow. The naysayers will still have something to whine about then |
