Ex-Permanent Secretary Forfeits N654 Million And $137k To The Federal Government of Nigeria The Federal High Couri in Ikoyi, Lagos has ordered permanent forfeiture of the sum of N664m, $137,680.11, belonging to a former permanent secretary in the Ministry of Labor and Productivity, Mr. Clement Illoj Onubuogo, to the Federal Government of Nigeria. BY SAHARAREPORTERS, NEW YORKJAN 09, 2018 The Federal High Couri in Ikoyi, Lagos has ordered permanent forfeiture of the sum of N664m, $137,680.11, belonging to a former permanent secretary in the Ministry of Labor and Productivity, Mr. Clement Illoj Onubuogo, to the Federal Government of Nigeria. Justice Saliu Seidu today granted the order at the resumed trial of the former permanent secretary. Mr. Onubuogo was alleged to have been involved in the Sure-p scam. At the resumption of the case, counsel to Mr. Onubuogo, Mr. TS Awana, informed the court that his client has two applications, one challenging the jurisdiction of the court and the other for a discharge of the earlier order of the court granting the interim for forfeiture of the properties in question. Mr. Awana however, told the court that he would be withdrawing the applications in view of the ongoing discussion between his client and the Economic and Financial Crimes Commission (EFCC). Counsel to the EFCC, Mr Rotimi Oyedepo, confirmed the position of the move to settle out of court, stating that he will not be opposing the withdrawals of the two motions filed by the defendant. He urged the court to strike out the motions to pave way for out of court settlement. While making further submission, Mr. Oyedepo told the court that based on the discussion and agreement reached between the parties, EFCC would be applying for the discharge of an earlier interim order of the court as regards two of the properties being sought to be forfeited to the government. The properties are Clement Illoh's Mansion located at Ikom Quarters, Issala Azegba, Delta State and the property lying and situates at number 19 Madue Nwafor Street off Achala Ibuzor Road, Asaba Delta State. He then urges the court to discharge the earlier order of the court as regards the two properties only. The defendant's lawyer did not oppose the application which gave way for EFCC to move for the final forfeiture of the other properties said to have been suspected to be proceeds of illegal act. Mr. Oyedepo told the court that since the defendant has withdrawn their counter affidavit, the prosecution is left with no option than to move the motion for final forfeiture of the properties. "in view of the discussion with the defendant we want to move the motion of the 5th of September,2017 wherein we are seeking the final forfeiture of the properties listed in prayers 1,2,3 and 4," Mr. Oyedepo said. He said the motion was brought pursuant to section 17 of the Advance Fee Fraud and other Related Offences Act number 14, 2014. The prosecution said the application for final forfeiture is supported with nine paragraphs affidavit and two exhibits. The prosecution therefore urged the court to grant their application for the final forfeiture of the properties as contain in prayers 1,2,3 and 4 in the face of the motion papers.. The application was not opposed by the defendant Justice Saliu Saidu, the presiding judge, consequently granted the application. He ordered the defendant to forfeit the sum of N437,348,181.16 found in his possession, by the anti-graft agency and which was suspected to be proceeds of unlawful activity. The defendant was also ordered to forfeit another sum of N129,826,452.00 found by the commission in possession of Salisu Bala Kura, John Isakwa Kanku, Ahmed Mahmud Muazu, Muktar Safian, Udoh Nnamdi, Umar Bello Mashi, Salogu Karo, Usman Bello, Ahmed Mohammed Makki, Umar Abubakar, Aliyu Abubakar, and Enape Victoria. Mr. Onubuogo was ordered to forfeit to the Federal Government the sum of $137, 680.11 EFCC had on Monday April 3, 2016, arraigned Mr. Onubuogo, before Justice Babs Kuewumi of the Federal High Court, on a three-count charge bordering on failure to declare his assets. The accused person allegedly failed to disclose the sum of N97, 300, 613.44 Million, (Ninety Seven Million, Three Hundred Thousand, Six Hundred and Thirteen Naira, Forty-four Kobo) found in his account. He also allegedly warehoused the sum of $139, 575. 50 USD, (One Hundred and Thirty-nine Thousand, Five Hundred and Seventy-Five United States Dollars, Fifty Cent) and £10, 121.52, (Ten Thousand One Hundred and Twenty-one Pounds) respectively in his account. The offenses are contrary to and punishable under Sections 23(3)(c) of the Financial Crimes Commission (Establish) Act. The accused person pleaded not guilty to the charges when they were read to him. In view of his plea, the prosecution counsel asked the court for a trial date. However, the defense counsel pleaded with the court to grant his client bail on liberal terms. Contractors owe govt N100bn in tax liabilities, Adeosun says Published January 9, 2018 Minister for Finance, Kemi Adeosun Ifeanyi Onuba, Abuja The Federal Government on Tuesday said about N100bn has been discovered as tax revenue shortfall by contractors between 2012 and 2017. The figure was given by the Minister of Finance, Mrs. Kemi Adeosun, in a statement issued by her Special Adviser, Media and Communications Mr. Oluyinka Akintunde. The minister, in the statement, said she had ordered vendors of Ministries, Departments and Agencies to display their Tax Identification Numbers on their invoices before they make payments. She said already, the Federal Government’s directive has been handed down to the Accountant General of the Federation, Ahmed Idris, for implementation Adeosun said the order was part of the government efforts to block revenue leakages. The finance minister in the memo entitled, “Compliance with tax payments by Federal Government vendors,” disclosed that persistent leakages in revenue remittances by vendors was uncovered by the government’s Project Lighthouse, a system-wide revenue intelligence data warehouse. The leakages, according to her, were due to the lack of TIN, particularly on Value Added Tax, Withholding Tax and other related inflows into the government coffers. The minister said, “In order to address these lapses in the implementation of the 2017 budget as well as boost the revenue accruable to the government, all MDAs should be directed to insist that invoices submitted by vendors for payments must clearly state the TIN. “This is to confirm tax compliance by relevant government vendors before payments are effected.” She added that the directive to the government vendors is in compliance with the provisions of both the Federal Inland Revenue Service and the Public Procurement Acts of 2007 respectively. Abuja Light Rail Set To Begin Operation, As Test Coaches Arrive January 8, 2018 By DAVID ADUGE-ANI The secretary, Federal Capital Territory (FCT) Transport Secretariat, Comrade Kayode Opeifa has disclosed that the long awaited Abuja Light Rail is now set to commence operations. Speaking when took the delivery of three coaches, meant for the test operations of the railway services in Abuja at the weekend, Opeifa revealed that the ultra-modern coaches have a total capacity of 390 passengers. He explained that the Federal Capital Territory Administration (FCTA) could not commence test runs of the rail lines, because of the preliminary logistics needed before the exercise, adding that all hands are now on deck for the commencement of the operations. The secretary disclosed that 12 stations, traversing the rail-line corridor, have been completed, including the Abuja Metro Station behind the Abuja World Trade Centre, which is known as the Central Railway Station. The facilities, especially the Metro Station, according to him, are all ultra-modern edifices with provisions for modern shopping and eateries, adding that the rolling stock depot and maintenance base at Idu, fitted with modern railway coaches repair facilities have also been completed. He also revealed that the rail lines project for Gwagwa, Jabi, Gwarimpa, Utako, Wuse Hospital and Garki, before ending at the Area 1 Park, behind the former FCT NYSC Secretariat, would commence this year. Nigeria’s external reserves hit $40.4bn JANUARY 8, 2018 By Babajide Komolafe As projected by the Governor, Central Bank of Nigeria (CBN), Mr. Godwin Emefiele at the Annual Bankers’ Dinner of the Chartered Institute of Bankers (CIBN) in Lagos last November, the nation’s External Reserves have hit a new level of $40.4 Billion. This is even as the Bank injected a total of $210 million into the interbank Foreign Exchange Market in the first round of trading for the year on Monday, January 8, 2018. Figures obtained from the CBN on Monday, January 8, 2018 indicate that the External Reserves reached the $40.4 Billion mark on Friday, January 5, 2018, indicating an increase of about one billion United States dollars between December 2017 and January 2018. Confirming the figure, the Acting Director in charge of Corporate Communications at the CBN, Isaac Okorafor attributed the accretion to the country’s reserves to the Bank’s strategy to effectively manage forex demand by various sectors of the economy. Citing the CBN policy restricting access to forex from the Nigerian forex market by importers of some 41 items as the major turning point, Okorafor said the policy had helped to stop the hemorrhaging of the country’s external reserves, which hitherto witnessed heavy depletion due to huge import bills and other debt obligations. According to him, the CBN policy had ensured a decline in Nigeria’s import bills from over $5 billion monthly in 2015 to about $1.5 billion in 2017. He expressed optimism that with the determination of the Bank and the cooperation of the fiscal authorities, the external reserves will continue to enjoy more accretion in the course of 2018. Meanwhile, the CBN injected a total of $210 million into interbank window of the foreign exchange market on Monday, for requests in the wholesale, Small and Medium Enterprises (SMEs) and invisibles segments of the market. How Jonathan, Buhari contributed to Abuja-Kaduna rail project — Amaechi Samuel Ogundipe The Minister of Aviation, Rotimi Amaechi, used his speech at the commissioning ceremony of the Abuja-Kaduna axis of Lagos-Kano Railway to itemise the contributions made by successive governments to the completion of the project. President Muhammadu Buhari on Tuesday declared the standard gauge rail line open for commercial use at a well-attended ceremony. But critics, especially supporters of former President Goodluck Jonathan, said Mr. Buhari and Mr. Amaechi failed to recognise the input of Mr. Jonathan to the project. Some supporters said Mr. Jonathan “virtually completed” the project before leaving office in May 2015. But a copy of Mr. Amaechi’s speech sent to PREMIUM TIMES showed that Mr. Jonathan’s contribution to the project was acknowledged. “Today, as we gather here, we recall that the contract for Lagos-Kano railways was awarded by President Olusegun Obasanjo, partially executed by President Goodluck Jonathan and completed by President Muhammadu Buhari.” “The tracks were commissioned by President Jonathan. Under the directives of President Buhari, the stations, signalling, the communications and part of the tracks was completed by this administration,” Mr. Amaechi said. “The locomotive and coaches arrived in May, and between June and July, we had commenced the trial runs. We conveyed over 500 passengers per trip, twice a day for a month and two weeks free of charge.” Other contributors acknowledged by Mr. Amaechi in his speech also included the Minister of Finance and China’s Export-Import Bank, which financed the project through counterpart funding between Nigerian government and a Chinese construction firm. “Let me express my gratitude to the Ministry of Transportation and the Chinese government and the China Nexim Bank for their financial support. The same gratitude goes to my colleague, Mrs. Kemi Adeosun, for discharging her responsibility as directed by Mr. President. “Most importantly, it is the priority attached to transportation by the President, of which we are very grateful. We are also grateful to the contractor CCECC for keeping fate and doing a good job,” Mr. Amaechi said. Mr. Amaechi also used the speech to acquaint Nigerians the benefits of the new rail corridor, saying commercial agriculture would receive a significant boost. “Mr. President, as we invite you to officially flag-off commercial activities on the Idu-Kaduna segment of the Lagos-Kano railways, we remind Nigerians that the change agenda here impacts on housing as the poor are able to live in their houses in Kaduna and come to work in Abuja. “At the same time, it impacts on agriculture and economy as agricultural produce are conveyed from Kaduna to Abuja at much cheaper rates. Transportation is also provided to Nigerians who live between Kano and Abuja at a cheaper rate.
