FFK, Olisah Metuh and others who are still in PDP are also in court for one corruption case or the other. Someone might argue that they will also be freed. So it should not matter what party you belong to. APC, PDP or APGA. Once you are dragged to court, your case could go either way. It is the function of the executive to drag accused persons to court, while it is the function of the Judiciary to free or jail them. |

However, at the re-arraignment today, the defendants all pleaded not guilty to the twenty-four charges preferred against them by the EFCC BY SAHARAREPORTERS, NEW YORK JAN 16, 2018 The Economic and Financial Crimes Commission (EFCC), has re-arraigned ex-minister Jumoke Akinjide, Senator Ayo Ademola Adeseun and one Chief Olanrewaju Otiti, before the Federal High Court in Ikoyi, Lagos, on Tuesday, January 16, 2018. The three defendant were first arraigned at the Oyo State Federal High Court before Justice J.O Abdul-Malik on June 22, 2017. After the first arraignment, there was a discussion of plea bargain between Mrs. Akinjide and Mrs. Otiti. Ex-minister Jumoke Akinjide However, at the re-arraignment today, the defendants all pleaded not guilty to the twenty-four charges preferred against them by the EFCC. The defendants allegedly received the sum of N650 million from a former Minister of Petroleum Resources, Diezani Alison-Madueke, to allegedly manipulate and influence 2015 general election. The money was part of the $115 million allegedly disbursed by Mrs. Alison-Madueke to influence the 2015 presidential election in favour of former President Goodluck Ebere Jonathan. On the amended charge; Mrs. Otiti was mentioned in five of the charges while Mrs. Akinjide and Senator Adeseun were mentioned ten and seventeen times respectively. Former Minister of Petroleum, Diezani Alison-Madueke, was also mentioned in the first and second charges but she remained at large. After the plea taking of the defendants, counsel to Mrs. Akinjide urges the court to allow his client continue on the bail granted by Justice Abdul-Malik. Justice Abdul-Malik granted bail in the sum of N100 million each and sureties in like sum. The surgeries must be civil servants or public servants in a level of director. The other defense counsel; Mr. Micheal Lana and Mr. Ademola Oladeji aligned with the argument of the senior advocate. The devil is in the detail as Witness goes on the run EFCC’s Failure To Produce Witness Might Damage Corruption Trial of Ex-Abia State Governor Counsel of the commission, Mr. Rotimi Jacob, told the Federal High Court in Ikoyi, Lagos that its star witness in the trial is evading appearance BY SAHARAREPORTERS, NEW YORKJAN 16, 2018 The Economic and Financial Crimes Commission (EFCC) might have its case against the former Abia State governor, Mr. Orji Uzo Kalu, damaged if it fails, again, to produce its witness. Counsel of the commission, Mr. Rotimi Jacob, told the Federal High Court in Ikoyi, Lagos that its star witness in the trial is evading appearance. At the commencement of proceedings today, January 16, 2018, Mr. Jacob informed the court that the matter was due for continuation of trial but that he could not proceed because he could not find his star witness. Mr. Jacob told Justice Mohammed Idris that the witness, Mr. Mike Udoh, had repeatedly made himself unavailable whenever he was due to appear in court. He accused some unknown persons of being behind Mr. Udoh's absence and vowed that they would be prosecuted. He said: "Our main witness that we intended to call, we have approached him for more than six months. We have noticed that each time the matter is coming up, he will just travel to Umuahia or Calabar or Cameroun. "He always has the dates of the matter and I was forced to apply for a subpoena. Your Lordship signed one, which we took to the Abia State Government because we found out that he was a civil servant. But he has since left the service. "He was supposed to come today but switched off his phone. EFCC went to his house in Umuahia yesterday and this morning but met his wife who said he travelled to Calabar. Despite all our efforts, we have not been able to bring him." He prayed for a short adjournment of about a week to enable the agency round up its case. Mr. Jacob added: "We have information that some people are behind his not showing up. We are investigating and will charge the persons. As we speak, our operatives are in Abia, but they can't pick up the wife in place of the husband." Mr. Kalu's counsel, Mr Awa Kalu (SAN), accused the EFCC of a ploy to foist an adjournment on the court. The former Abia State Attorney-General and Commissioner for Justice who is now representing Mr. Kalu said: "The defendants have been diligent in presenting themselves for trial, but the prosecution has been engaging in push and starts. The second defendant is a retired civil servant. The first defendant (Kalu) is a politically exposed person. There are four senior counsel with at least one junior all at the defendants' cost. Yet we are here only to be told of circumstances beyond the prosecution's control. There are many witnesses listed by the prosecution. The non-appearance of one of them cannot foist an appearance on this case." Second defendant (Udeogu)'s counsel, Solo Akuma (SAN), adopted his colleague’s submissions, describing EFCC's application as "a frivolous one." He said: "We abandoned everything else to come to court. My client is complaining he cannot afford my bill. The defense has never made any application for adjournment. All adjournments have been at the prosecution's instance. They must be compelled to close their case, otherwise Your Lordship should award costs to cover our transport and hotel bills." Akuma condemned the approach taken by Jacobs to bring his witnesses to court. He recalled that on November 30 of last year (2017) while the judge was adjourning the matter, Jacobs had told the court that he had four more witnesses to call, including Udoh. He wondered why none of the other three witnesses was also not produced in court, even if the prosecution had a difficulty bringing Udoh. "That shows the frivolity of the steps they have taken to bring their witnesses to court," Akuma said. He urged the court to either foreclose the prosecution's case or if the request for an adjournment would be granted, the court should order the prosecution to bear the cost of the defenses’ transportation and hotel accommodation. This, he said, is in line with the provisions of Section 396(6) of the Administration of Criminal Justice Act 2015. Counsel to the third defendant, Slok Nigeria Ltd, Mr., C. C. Nwofo, lamented the economic damages the firm has suffered because of the trial and adjournments. He said: "The third defendant is a company which has suffered and lost contracts of about $500million from China Exim Bank for ship acquisition. About $350million has been lost from African Bank in Egypt. 3,000 workers have lost their jobs because of this case. 250 expatriate workers have lost their jobs because of this case. "We have not been paid our fees in this case, but I'm doing it because I believe this case will end one day and I'll be paid. If they are not able to proceed, I propose a cost of N10million." But Mr. Jacob, who urged the court to uphold his prayer, said it was not frivolous. "If I have that man (Udoh) today, I am comfortable to close my case. I am entitled to five adjournments. He said it was due to the time spent by the defendants pursuing interlocutory appeal that the prosecution was experiencing difficult in assembling its witnesses, some of whom had died, retired or relocated out of jurisdiction. "If they had allowed us to go on within two to three years of the case, all our witnesses would have been assembled in one day," he said, urging the judge to grant his request for an adjournment and to reject the award of cost." In a bench ruling, Justice Idris upheld Mr. Jacob's application for adjournment and declined the defendants' application for cost. He noted that this was the final adjournment he would allow. Justice Idris said: "Where a witness that ought to attend court, fails to attend court and summons has been issued and served on the same witness, then the prosecution would pursue the appropriate provisions of the ACJA to compel the attendance of the witness in court...This trial will no longer be adjourned on account of unavailability of witness to attend court... It is unfortunate that a trial, which has been adjourned for hearing from day to day could not proceed due to witness unavailability," the judge said. The case continues on January 22 and 23. The three defendants were arraigned on October 31, 2016 by the EFCC before Justice Mohammed Idris on a 34-count charge of N3.2billion fraud. They were accused of conspiring among themselves to divert a total of N2.9bn from the coffers of the Abia State Government. Benue killings: You lied, Osinbajo replies Ortom Published January 15, 2018 Vice-President Yemi Osinbajo on Monday said he was shocked by media reports that quoted the Benue State Governor, Samuel Ortom, as saying that he (Osinbajo) was warned ahead of the January 1 killings in Logo and Guma Local Government areas of the state. In a statement by his Senior Special Assistant on Media and Publicity, Mr. Laolu Akande, the Vice-President described as “a terrible falsehood” to suggest that he was ever informed by the governor or any one else of the killings. The statement read, “Governor Ortom wrote to the Vice President, then Acting President on 7th June 2017 protesting a newspaper publication where the leadership of Miyetti Allah was reported to have stated that it was opposed to the Open Grazing Prohibition law of the State and that they would mobilise to resist the law. “The Miyetti Allah had written to the Vice President on the 5th of June 2017 on the same law protesting several sections of the law. “The governor went on to say that the leadership of Miyetti Allah should be arrested because they used words such as ‘wicked, obnoxious and repressive,’ to describe the law, and because these were ‘utterances that are capable of undermining the peace…’ “The Vice President subsequently met with the governor, discussed the matter and the security situation in the state and then ordered law enforcement agencies to be on the alert to prevent any attacks or violence. This was in June 2017!” The statement noted that in the said letter written by the governor, there was no mention of any threat to any specific one of the 23 local governments of Benue State. It explained that the best the law enforcement agencies could do then was to await information or intelligence of an imminent attack and none of such came. It added that since then, the Vice-President had held meetings with the Benue State Governor, including a visit to the state on September 6, 2017 at the instance of President Muhamamdu Buhari during the tragic floods in the state. At all the meetings, according to the statement, the Vice-President discussed the security situation of the state with the governor. It noted that the then Acting President also convened a major national security retreat which was attended by all state governors, service chiefs and heads of security agencies. [BREAKING] EFCC in fresh moves against Patience Jonathan’s $8.4m, N7.3bn found in 15 bank accounts Published January 15, 2018 Oladimeji Ramon The Economic and Financial Crimes Commission is in fresh moves to seize funds in 15 bank accounts linked to Mrs. Patience Jonathan. The funds, which the EFCC is seeking to seize, include a total of $8,435,788.84 and over N7.35bn. The EFCC had appeared before Justice Mojisola Olatoregun of the Federal High Court in Lagos with an ex parte application, seeking the forfeiture of the funds. The move was, however, interrupted by a train of Senior Advocates of Nigeria led by Mr. Ifedayo Adedipe (SAN) and Mr. Mike Ozekhome (SAN), who challenged the court’s jurisdiction to entertain the ex parte application. They told the judge that the funds, which the EFCC seeks to seize, were already a subject of litigation. But counsel for the EFCC, Mr. Rotimi Oyedepo, maintained that the SANs had no right of hearing in the court, since his application was ex parte, wondering how they got wind of the move by the anti-graft agency. In view of the development, the judge adjourned the case till January 23, 2018 and directed the EFCC to file an affidavit to convince it that there were no pending lawsuits relating to the funds before other courts.

Youths boo Ozekhome at Gani Fawehinmi lecture Published January 15, 2018 Oladimeji Ramon There was a mild drama at the 14th Annual Chief Gani Fawenhimi Lecture in Ikeja, Lagos on Monday, as some youths booed Chief Mike Ozekhome (SAN), who was one of the discussants. The youths blocked the path of Ozekhome, who arrived the venue of the lecture at the Airport Hotel, Ikeja, at about 1.30pm, insisting that the SAN would not be allowed into the lecture hall. Ozekhome’s arrival was greeted with a loud chant of disapproval by the youths, who disrupted the lecture which was already underway. It took the intervention of the Chairman of the Ikeja branch of the Nigerian Bar Association, Mr. Adesina Ogunlana; and that of Mr. Richard Akinola, to shield Ozekhome from the irate youths. They accused the SAN of “shielding looters from justice.” Mr. Femi Falana (SAN), who was also at the event, had to also leave the high table where he sat among others to placate the youths and calm them down.
