Fact is, the judiciary can not sustain the damage and disrepute this drama is heaping in them and at some point, they have to show the world that they have a reputation to protect and their profession and their reputation is bigger than the now disgraced and suspended CJ.

They must do what they should have done and what the corrupt CJ tried to prevent and sweep under the carpet by canceling the NJC meeting indefinitely which is asking the corrupt CJ to step aside pending the conclusion of the investigation and trial because he's a self confessed law breaker with unexplained wealth totaling millions of dollars.

The crooked CJ himself is not only a crook, he's a thoughtless, senseless and useless man because he should have resigned and shield his profession, the judiciary and the NJC from shame, ridicule and embarrassment.

NJC ke?

They are all corrupt and they are covering each other's asses.

The crooked and corrupt suspended CJ suspended the NJC from sitting indefinitely.

Why? So, who is the real dictator and tyrant here?

We really don't have to beg these worthless, corrupt and incompetent public officials to do their job, but we've looked the other way for decades while they sell justice to highest bidders at our collective expense.

They should have asked the corrupt and lawless judge to resign a long time ago, but they didn't, now, we must sue and force them to do their job.

Politics › Re: Ridiculing Of The Judiciary by deomelo: 7:49am On Jan 27, 2019
briefness:
The judiciary the say, is the last hope for the common man. It remains a unique arm of government and requires the highest qualification as compared to other arms of government. This should have given much credence as it will be assumed that any decision to be taken will properly guided. The judiciary is also expected to display a high level of integrity as it has the power of life and death.

The President suspended the CJN and the constitutionality and legality of such a decision is being debated. Also of great concern is the timing of the decision due to the forth coming general elections. At the same time, the integrity of the person of the CJN who is the head of the judiciary is being questioned over the non declaration of some of his assets which he reportedly admitted he forgot to declare. Bare in mind that if what is being reported is true, the assets forgotten to be declared could be much more in value compared to what was declared.

With the weight of the allegation, despite the sentiments, the judiciary should not have allowed itself to be ridiculed. The judiciary should have been courageous enough to take the necessary step, take the right actions to ensure fair hearing and as well prevent interference.

The indefinite postponement of the NJC meeting where the issue would have been raised and perhaps the decision taken in that meeting would have put the situation under control. Did the judiciary ridicule itself by the postponement, moreso without a reason? Could it have been a smart game of survival for the meeting to have been postponed by the Chairman who is the CJN?

For the judiciary, a stitch in time would have saved nine and prevented all this confusion if they had reflected on the very principle of Lady Justice, the symbol of Law. Lawyers and Judges must do everything possible to keep their profession noble to safeguard it from undue interference especially by politicians.
The only way to clean the judiciary or handle the CJ issue is to allow the CJ as the head of the NJC to investigate himself and recommend his own suspension and dismissal to the president for immediate dismissal.

Meaning we should let armed robbers be their own lawyer, prosecutor, and judge at the same time.

This is how rettarded the CJ issue is?

Just imagine, the CJ and the head of the NJC is on trial for corruption.

The head of the NBA is on trial for corruption

There are countless judges on trial for corruption

So where is the democracy we keep talking about? The one that sends the mobile phone thief to prison for years and let crooked and corrupt public officials walk away free with their stole millions and billions.

This is the fault of the judiciary because they've been getting away with corrupt judgments and financial inducements from corrupt public officials for decades, but they didn't see this coming and even after the whole thing broke, they should have suspended the CJ or at least plead with him to step down, but they deployed the same old crooked and corrupt tactics where they commandeered their corrupt friend in different courts to issue endless injunctions, delays and frivolous jurisdiction nonsense.

They need to clean house, seriously.

Just look at the clowns demonstrating @ the US embassy? It's like we are crooks in our own way so we recognize and sympathize with corrupt public officials like this crooked judge. We should have collectively asked this man to step down a long time ago, even before the president stepped in to do what we as a nation are too chicken and corrupt to do.

Look at this cow chaser. It seems you did not read the conclusion of my post. Is a CBN governor the same as a CJN? One is a political office holder in the executive arm while the other is the head of the judiciary. The danger of suspending a CJN is far more damaging for our democracy because it puts the judiciary in the control of the executive. You fail to see the bigger picture because you're not a Nigerian. You're a mindless buhari apologist. .
[/s]

What's more damaging to our democracy than leaving corrupt and self-confessed law breaking judges with millions of dollars in a dozen bank account adjudicate tainted cases.

Your first duty as a Nigerian should be accountability and asking the judge to step down simply because confessed that he broke the law.

There's no place for such characters on the bench while on trial.

Imagine asking the same crooked judge to investigate himself as the head of NJC and even recommend his own suspension?

Going back to your other nonsense, I said regardless what arm of government the CBN and the Judiciary call home, they both have the same 2/3 stipulation so your bait and switch rubbish was meaningless.

Must the President do or demand what the citizenry should have demanded that the crooked, self-confessed and corrupt judge resing? Is this not what Nigerians should be demanding even before the president stepped in.

Nigerians totally ignored the lawless act committed by the disgraced CJ against them and their constitution, but they are going out of their way to kill the President for doing what they should have done.

Where is the sense and wisdom in allowing such corrupt, lawless and a lawbreaking character with unexplained millions of undeclared dollars in almost a dozen bank accounts remain in office?

We are so desensitized and used to corruption that it doesn't bother us, we even ignore corrupt public officials and instead fight and go after the people we actually pay to fight corruption.

If this is how we truly feel about corruption and criminal acts, then maybe we should just abolish all our law enforcement agencies and save the billions we budget on their behalf every year.

Looking Ahead

In order to save the Judiciary from further assault and embarrassment, and Nigeria from further international humiliation, a number of urgent steps must be taken by the Judiciary, the Executive Branch of Government and the legal profession.

The President must withdraw his purported execution of the order of the CCT suspending CJN Onnoghen from office, and swearing in Hon. Justice Ibrahim Tanko Muhammed as the Acting CJN of Nigeria.

This must be done immediately to stabilise the failing health of the Supreme Court that must have been occasioned by the act of the President.

Hon. Justice Walter Samuel Onnoghen must immediately resign from the office of the Chief Justice of Nigeria.

His reputation as a judge and as the head of the Nigerian Judiciary has been irreparably damaged, and his clinging to judicial office will not serve any useful purpose at this time.

His attempt to shield himself in office as exemplified by the inexplicable panicky indefinite postponement of the meeting of the NJC on 15th January , 2019, thereby robbing the NJC of its earliest opportunity to discuss the issue of his charge before the CCT is not helping him.

If anything , it portrays him, very unfortunately, as a person who is determined to cling to judicial office while the Judiciary is engulfed in crisis, flowing from issues relating to his alleged ethical infirmities.

The President of the Nigerian Bar Association, who is also facing a criminal prosecution by the Federal Republic of Nigeria ( EFCC) should either step down from the presidency of the NBA or recuse himself from the membership of the NJC, pending the conclusion of the criminal charge against him.

Even when his presumption of innocence is conceded, this is the only way to guarantee that his representation of the NBA in the NJC is not used and surbodinated in the prevailing circumstances to the pursuit of his self interest to have himself discharged and acquitted.

The NJC must meet immediately to accept the resignation of Honorable Justice Onnoghen, and forward same to the President; and recommend a new Chief Justice of Nigeria to the President for a due appointment, with the approval and confirmation of the Senate.

In the meantime, the President will now be in a position to properly exercise his powers under Section 231(4) of the Constitution to appoint an Acting CJN in the person of Hon. Justice Ibrahim Tanko Muhammed.

The NBA and members of the legal profession must be mobilised not only to condemn the Executive for its acts of interference in the Judiciary, but also to compel Hon. Justice Onnoghen to resign as the CJN with immediate effect.

The unwitting impression the legal profession creates when it condemns the Executive without demanding for the resignation of the CJN is that it is protecting the CJN and shielding him from facing the consequences of alleged involvement in corrupt practices .

In addressing the issues that the actions of the Executive have raised, state actors and stakeholders in the Judiciary and outside it must ensure that the Judiciary is not further politicised or divided along ethnic or religious lines.

Finally, the current debacle rocking the Judiciary must be resolved to preserve and grow Nigerian constitutional democracy and rule of law and intensify the fight again corruption in Nigeria’s public life

Your first point is baseless and pointless. An ex-parte order that was issued without any application from either party.

Secondly, let me disabuse the minds of many people who say Goodluck did it to Sanusi. Get this in your head; The Central Bank Governor is under the executive arm of government. The Central Bank regulates financial institutions and executes policies to that effect. The Central Bank Governor is also a political office holder who serves at the pleasure of his president.

The CJN on the other hand is the head of an entirely different arm of government. He is not a political office holder but a judicial officer. Under the principle of separation of powers, he does not serve at the pleasure of the president and as such cannot be suspended by said president.

He can only be removed and the constitution has laid down steps and procedures for his removal. The purported suspension is not only illegal, it is also dangerous for our democracy as this can lead to anarchy in the future where presidents and governors 'suspend' their CJs for not carrying out their bidding.

*Modified*
For the zombies quoting me; Justice Ayo Salami was suspended by the NJC on the 11th of August 2011. I detest being quoted by mindless fools who fail to understand the integrity of their country is in jeopardy.
(f) is removed by the President:
Provided that the removal of the Governor shall be supported by two-thirds majority of the Senate praying that he be so removed (emphasis supplied).

https://www.legalnaija.com/2014/02/law-on-removal-of-cbn-governor.html
Regardless of the arm of government, the same 2/3 approval applies and last time I checked, GEJ didn't bother with the constitution or two-thirds majority of the Senate when he sacked the CBN governor, SLS

Be credible and consistent with your views.

8. I believe this action will facilitate quick dispensation of justice in this matter. Before the Order, the “generous SANs” representing the “poor” CJN had started taking steps that are clearly intended to frustrate his trial. They had started raising frivolous issues and making empty applications because they knew that their client had an upper hand. Now that he has been suspended, the defense counsel will be serious to prosecute the matter to its conclusion so that their client might be reinstated as quickly as possible if he is not found guilty.
This is the most disgusting side of our legal and judicial system, the manipulation of the legal system where corrupt SANs frustrate the system with frivolous delays, injunctions, appeals and ultimately shopping for and bribing corrupt judges for favorable judgments. This is how the CJ end up with millions of dollars in his bank account to start with, this is how e arrived at this junction to start with.

The suspended CJ should have resigned after admitting or confessing that he broke the law, I mean, is he expecting to continue as the CJ after breaking the law and personally confessing?

The fact that his colleagues, the NJC and the NBA didn't advise or demand that he resign and step aside shows that the judiciary is grossly immoral, shameless. They are so used to having their corrupt ways that basic common sense and a strong sense of ethics demanded by their profession flew over their heads.

I'm glad that the President cut through the chase by sparing us the endless judicial drama, legal games, shopping for corrupt judges and courts to let a self-confessed criminal, a whole CJ evade justice.

Now, with this crooked and corrupt CJ sidelined, the NJC must do the needful to save their stained and battered profession, they must ask and force the disgraced suspended CJ to resign imediatly.

Therefore, the National Judicial Council should convene and constitute a committee to investigate the allegations leveled against the Chief Justice and make appropriate recommendation to the relevant authorities."
1. The suspended CJ openly confessed to the world that he violated the laws of the FRN so what's there to investigate? To investigate his confession.

2. The next step is to ask him to resign, a step that should have been taken a long time ago, but this is Nigeria, a country where lawless corrupt people even after confessing and admission of guilt still gets support and defense to evade justice at the expense of the constitution they swore to uphold and protect.

2. The CJ violated our laws, he betrayed our trust and he self-confessed so he should have resigned honorably and even leaders like Saraki and the entire legislature should have pressed the CJ to resign a long long time, but they didn't because they are equally corrupt, lawless and unpatriotic.
